Work of the Unit. Employees not covered by the terms of this Agreement will not perform duties normally assigned to those employees who are covered by this Agreement, except for the purposes of instruction, experimentation, or in emergencies when regular employees are not readily available.

In order to protect the standard of nursing care, the Employer shall not contract out the work normally performed by members of this bargaining unit except: for purposes of instruction, in the event of an emergency situation, when performing developmental or experimental work, or when employees are not available due to an employee not reporting for work as scheduled or not being available for work. Reassignment to other employees of work normally performed by members of the bargaining unit shall not result in the termination, lay-off or reduction in hours of any member of the bargaining unit. When it is decided to not fill a position following an employee's resignation, the Home will provide the rationale in writing for this decision to the Union. The Union may request a meeting to make representations on this matter.
Work of the Unit. The District shall strive to ensure that Unit members are only assigned the work of the Unit. The District and the Unit recognize that, for the good of the District or the College, temporary duties may be assigned as needed. A unit member shall not be assigned work of another Unit for more than sixty (60) working days, absent extenuating circumstances that would require consultation between the unit member, the campus Administrator’s Unit representative and the College President. The use of volunteers to perform bargaining unit work, as covered by this agreement, shall not be expanded beyond the extend of existing practice as of June Effective October the Hospital shall submit to the Union figures indicating the number of volunteers as of September Thereafter, the Hospital shall submit to the Union, at three month intervals, the number of volunteers for the current month and the number of hours worked. Written request for a personal leave of absence without pay will be considered on an individual basis by the Executive Director or his designate. Such requests are to be submitted at least four weeks in advance, except in cases of emergency, and a written reply will be given within fourteen days except in cases of emergency in which case a reply will be given as soon as possible. Such leave shall not be unreasonably withheld. The Hospital shall grant leave of absence without pay to employees to attend Union conventions, seminars, education classes and other Union business in connection with the administration of the collective agreement provided that such leave will not interfere with the efficient operation of the Hospital. Such leave will not be unreasonably denied. The cumulative total leave of absence, the number of employees that may be absent at any one time from any one area, and the number of days of absence shall be negotiated locally and are set out in the Local Provisions Appendix. During such leave of absence, the employee's salary and applicable benefits shall be maintained by the Hospital on the basis of what his normal regular hours of work would have been, provided that the Union reimburses the Hospital in the amount of such salary and applicable benefits within thirty days of billing. Notwithstanding the above, time spent by the eight Executive Board members of the Ontario Council of Hospital Unions to fulfill the duties of the position shall be in addition to leave for Union Business under this clause. Upon application by the Union, in writing, the hospital shall grant leave of absence, pay, to an employee elected or appointed to full-time Union office. Work of the Unit. Persons whose jobs are not in the bargaining unit shall not work on jobs which are in the bargaining unit to the extent that bargaining unit employees are laid off, and it is further agreed that all work or services performed by the employees shall not be contracted out to the extent that bargaining unit employees are laid off or lose work. No contract, written or oral, shall be entered into between an employee(s) and the Employer, or any of its duly representatives, that directly conflicts with the terms of this agreement. The parties to this agreement shall have the right at any time to the assistance of an outside representative. Where an outside representative is being used, the other party shall be so advised in advance. Any representative of the Union who is in the employ of the Employer shall have the right to attend meetings held working hours without loss of remuneration for scheduled hours missed due to attendance at such meeting, when the meeting is called into session by the Employer or where permission is granted by the Employer. Stewards may be granted leave during working hours in order to investigate and process grievances. Stewards will not leave work during working hours without obtaining the permission of the supervisor. Such permission shall not be unreasonably withheld. The Union agrees that the Employer has the right to make and alter from time to time rules and regulations to be observed by the employees covered by this agreement which are not inconsistent with the provisions of the agreement. Any changes in such rules and regulations will not be implemented without prior notice and discussions with a committee of the Union.
