Cleaning Department. (a) The Employer will supply each employee with two (2) sets of clothing or uniforms for every calendar year. A uniform will consist of one (1) shirt, one (1) pair of pants, or one (1) xxxxx. Clothing will be supplied by April 1st of each year or whenever the employee is recalled from lay-off whichever date is later. (b) The Employer will supply each employee with one (1) winter coat every two (2) years for those employees who are required by the Employer to work outside or in an area that is not heated during the winter months (November 15th - March 15th). Distribution takes place on or about November 15th. If requested, the Employer will also supply each employee with one (1) pair of coveralls annually. Those employees who are required by the Employer to work outside or in an area that is not heated during the winter months (November 15 - March 15) may select an insulated coverall in place of a regular one. (c) Should any employee be required to work in water, the Employer will supply him with a rain suit and a pair of rubber boots which will be replaced yearly if required provided the rain suit and rubber boots are returned first. (d) The Employer will contribute eighty dollars ($80.00) per year towards the cost of safety footwear for each employee. This contribution will be paid within ten (10) days of provision of proof of purchase.

Cleaning Department. (a) Each employee shall receive vacation pay as follows: Upon completion of twelve (12) months employment but less than five (5) years of continuous employment while on the Seniority List - 2 weeks or 4% of gross earnings (exclusive of previous year's vacation pay) Upon completion of five (5) years of continuous employment while on the Seniority List as of January 1st - 2 weeks or 6% of gross earnings (exclusive of previous year's vacation pay) Upon completion of ten (10) years of continuous employment while on the Seniority List as of January 1st - 8% of gross earnings (exclusive of previous year's vacation pay). Upon completion of eighteen (18) years of continuous employment on the Seniority List as of January 1st - ten percent (10%) of gross earnings (exclusive of previous years vacation pay). Note: Earnings are those July 1 to June 30.
Cleaning Department. (a) Pay for sick leave is for the sole and only purpose of protecting employees against loss of income when they are legitimately ill. (b) Employees, other than probationary employees, shall accumulate sick leave credits at the rate of 3/4 day per month. Probationary employees, other than students, shall, upon completion of the probationary period, be credited with one (1) days sick credit. Effective May 1, 1999 sick leave credits accrue on the basis of time worked. (c) Accumulated sick leave credits may be utilized from day one of the accident or illness until the number of days accumulated has been exhausted. (d) In order to qualify for payment of sick credits, the employee must give prior notification to the Department Head or designate of any absence from work. (e) Employees absent due to illness shall co-operate in keeping the Department Head informed of the progress of the employee's condition and estimated return to work date as requested by the Department Head including providing physician's certificates not more frequently than monthly for absences in excess of 30 calendar days. (f) A record of the employee's sick credits will be provided to each employee in writing in January and July annually. There will be no carry over of sick day credits from year to year. At each year end or at seasonal layoff, whichever occurs first, there will be a pay out at the rate of fifty (50) percent for every unused sick day credit accrued in that calendar year. Such payments will be included on the last paycheque prior to layoff. (g) Existing accrued sick day credits, up to and including April 30, 1999, which will not be eligible for pay out, may be utilized for medically verifiable, non- occupational illness or long-term disability defined as a disability in excess of one (1) week. These accrued sick day credits may be used only as described in this clause of Article 43 and are to be carried over until used.
Cleaning Department. (a) Jobs shall consist of those functions currently being performed by employees in the classifications concerned. (b) For purposes of this Agreement, the term "classifications" shall mean those job functions that are listed in Schedule "A" hereof.

A revised copy of each Seniority List shall be posted on the appropriate bulletin board and sent to the Union in January and July of each year. (b) Full-time employees will accumulate seniority on the basis of their continuous service in the bargaining unit from the last date of hire, except as otherwise provided herein. Part-time employees shall accrue seniority on the basis of hours worked, 1725 = 1 year. Seniority will operate on a bargaining unit wide basis. (c) Notwithstanding this provision, seniority shall accrue during pregnancy and parental leaves or for a period of 90 days if an employees' unpaid absence is due to illness or disability. (d) It is expressly understood and agreed that, notwithstanding anything else contained in this agreement, the employer shall have the right to discharge or discipline any probationary employee at any time prior to his having been placed on the seniority list and such discharged or disciplined employee shall not have the right of recourse to the grievance procedure.

Provided that nothing contained in this Article is intended to confer upon or shall be construed as conferring upon employees in the bargaining unit, benefits other than those benefits to which such employees may be entitled from time to time under the terms and conditions of The Employment Standards Act as amended from time to time. (b) Subject to the foregoing: (i) the following days shall be recognized as statutory holidays with pay: New Year's Day, Good Friday, Victoria Day, Dominion Day, Labour Day, Thanksgiving Day, Christmas Day and Boxing Day. (c) Subject to clause (d) and except as otherwise provided in this Article, each employee shall have a holiday on a day that is a holiday and shall be paid his regular daily wage rate for such holiday. (d) Clause (c) does not apply to an employee who: (i) is employed for less than three months;

(f) It shall be the duty of the employee to notify the Employer promptly of any change in address. If an employee fails to do this, the Employer will not be responsible for failure of a notice sent by registered mail to reach such employee. (g) Shifts will be drawn up in accordance with the seniority standing of the employee and the staffing requirements for each shift.

(e) Where a public holidays falls upon a working day for an employee, an Employer may, with the agreement of the employee or his agent, substitute another working day for the public holiday which day shall not be later than the next annual vacation of the employee and the day so substituted shall be deemed to be the public holiday. (f) Any dispute as to an employee's entitlement to pay under The Employment Standards Act and thus under this Article shall be determined by the Director appointed for the purposes of The Employment Standards Act in the manner provided by the said Act.

  • Department of Transportation Bridge Maintenance employees, when actually climbing the cable stays of the Penobscot Narrows Bridge for inspection and/or repair, shall be compensated at the rate of ten dollars ($10.00) an hour in addition to their regular hourly rate of pay. Employees shall be compensated for a minimum of one (1) hour of such work regardless of the length of the climbing assignment.

  • Environmental Protection (i) Except as set forth in Schedule 9 attached hereto, neither the Borrower nor any of its Restricted Subsidiaries nor any of their respective Real Property or operations are subject to any outstanding written order, consent decree or settlement agreement with any Person relating to (A) any Environmental Law, (B) any Environmental Claim or (C) any Hazardous Materials Activity; (ii) Neither the Borrower nor any of its Restricted Subsidiaries has received any letter or written request for information under Section 104 of the Comprehensive Environmental Response, Compensation and Liability Act (42 U.S.C. § 9604) or any comparable state law; (iii) There are no and, to the Borrower’s knowledge, have been no conditions, occurrences, or Hazardous Materials Activities which could reasonably be expected to form the basis of an Environmental Claim against the Borrower or any of its Restricted Subsidiaries that, individually or in the aggregate, could reasonably be expected to have a Materially Adverse Effect; (iv) Neither the Borrower nor any of its Restricted Subsidiaries, nor, to the Borrower’s knowledge, any predecessor of the Borrower or any of its Restricted Subsidiaries has filed any notice under any Environmental Law indicating past or present Release of Hazardous Materials on any Real Property, and neither the Borrower nor any of its Restricted Subsidiaries’ operations involves the generation, transportation, treatment, storage or disposal of hazardous waste (other than hazardous waste generated in the ordinary course of business, and which is not reasonably likely to materially adversely affect the Real Property or have a Materially Adverse Effect), as defined under 40 C.F.R. Parts 260-270 or any state equivalent; and (v) Compliance with all current requirements pursuant to or under Environmental Laws will not, individually or in the aggregate, have a reasonable possibility of giving rise to a Materially Adverse Effect. Notwithstanding anything in this Section 4.1(z) to the contrary, to the knowledge of Borrower or any of its Restricted Subsidiaries, no event or condition has occurred or is occurring with respect to the Borrower or any of its Restricted Subsidiaries relating to any Environmental Law, any Release of Hazardous Materials, or any Hazardous Materials Activity which individually or in the aggregate has had or could reasonably be expected to have a Materially Adverse Effect.

  • Joint Funded Project with the Ohio Department of Transportation In the event that the Recipient does not have contracting authority over project engineering, construction, or right-of-way, the Recipient and the OPWC hereby assign certain responsibilities to the Ohio Department of Transportation, an authorized representative of the State of Ohio. Notwithstanding Sections 4, 6(a), 6(b), 6(c), and 7 of the Project Agreement, Recipient hereby acknowledges that upon notification by the Ohio Department of Transportation, all payments for eligible project costs will be disbursed by the Grantor directly to the Ohio Department of Transportation. A Memorandum of Funds issued by the Ohio Department of Transportation shall be used to certify the estimated project costs. Upon receipt of a Memorandum of Funds from the Ohio Department of Transportation, the OPWC shall transfer funds directly to the Ohio Department of Transportation via an Intra- State Transfer Voucher. The amount or amounts transferred shall be determined by applying the Participation Percentages defined in Appendix D to those eligible project costs within the Memorandum of Funds. In the event that the Project Scope is for right-of-way only, notwithstanding Appendix D, the OPWC shall pay for 100% of the right-of-way costs not to exceed the total financial assistance provided in Appendix C.

  • Environmental Health and Safety i. Environment, Health and Safety Performance. Seller acknowledges and accepts full and sole responsibility to maintain an environment, health and safety management system ("EMS") appropriate for its business throughout the performance of this Contract. Buyer expects that Seller’s EMS shall promote health and safety, environmental stewardship, and pollution prevention by appropriate source reduction strategies. Seller shall convey the requirement of this clause to its suppliers. Seller shall not deliver goods that contain asbestos mineral fibers.

  • Department Chairs The release time required to perform the administrative functions of the Department Chair positions shall be deducted from the total workload of the Department Chair with no less than fifty percent (50%) of this release taken from direct instructional duties.

  • Cleanliness and Safety; Entry Resident agrees to maintain the assigned bedroom space, the apartment and the common areas of the Property in a clean, safe and sanitary condition, to exercise all due care in the use of same, and to cooperate fully with the Property pest control program as requested. Resident will be responsible for the cost of treatment for bedbugs and similar pests to the extent Owner’s pest control vendor reasonably determines that an infestation has originated within Resident’s assigned space and during Resident’s occupancy. Resident will place all trash in provided receptacles and will be responsible for the cost of cleaning the interior or exterior of the apartment if not kept in sanitary condition. When outdoor temperatures are below 40 degrees Fahrenheit, Resident will keep the apartment’s heat turned on to prevent frozen or burst pipes, including during vacations. When outdoor temperatures exceed 85 degrees Fahrenheit, Resident will keep the apartment’s air conditioning turned on and set to a reasonable temperature to prevent mold or mildew growth, including during vacations. Owner and its agents, employees and contractors may enter any apartment and bedroom space to perform routine maintenance, inspections, showings and other ordinary functions, provided that Owner will provide advance notice to residents of an apartment before such entry. Owner reserves the right to enter an apartment and any bedroom space without prior notice (including a passkey and/or disarming the alarm or other means of entry if locks have been changed) for emergency maintenance or repair purposes, or when there is reasonable cause to believe that a situation exists that could cause danger to life, safety, health or property. Owner may confiscate any item deemed to cause a danger and is under no obligation to pay compensation for or to return such items.

  • Health and Safety Plan Consultant shall prepare and submit a Health and Safety Plan (“HASP”) for the portion of Consultant’s work that will involve field work, assessments, or investigations of certain Project elements. The HASP shall describe how Consultant plans to complete field work, assessments, and/or investigations at the RWF. Consultant’s HASP must comply with the CIP HASP and shall be updated as new conditions are encountered.
