Xxxxx Act (Xxxxx Act) commencing with section 3512 of the Government Code, and has as its purpose the promotion of harmonious labor relations between the State and the Union; establishment of an equitable and peaceful procedure for the resolution of differences; and the establishment of rates of pay, hours of work, and other conditions of employment, including health and safety.
ENTIRE AGREEMENT AND DURATION. This Agreement contains the entire agreement of the parties hereto, as amended on September 20, 2005, and February 6, 2007, and supersedes any prior written or oral agreements between them concerning the subject matter contained herein. Each party represents and warrants that the Agreement is lawful and binding on the parties, and enforceable by the remedy of specific performance and injunctive relief. There are no representations, agreements, arrangements, or understandings, oral or written, between the parties hereto relating to the subject matter contained in this Agreement which are not fully expressed herein.

Pursuant to Public Employment Relations Board decision S-SR-17, the State recognizes CSEA Union Local 1000, SEIU, as the exclusive representative for Registered Nurse Bargaining Unit 17, hereinafter referred to as Xxxx 00. Xxxx 00 consists of all employees in the job classifications listed by title in Appendix "D" attached hereto and incorporated by reference as a part of this Contract. Any new classes established and assigned to Xxxx 00 xxxxx xx incorporated in the contract. B. The State further recognizes the professional nature of the duties and responsibilities of Unit 17 employees in their contribution to the successful performance of the mission of State government. C. Pursuant to Government Code Sections 19815, 19815.4, and 3517, Union Local 1000, SEIU, recognizes the Director of the Department of Personnel Administration or his/her designee as the negotiating representative for the State and shall negotiate exclusively with the Director or his/her designee, except as otherwise specifically spelled out in the contract.
ENTIRE AGREEMENT AND DURATION. SEC. 1 This Agreement supersedes any and all agreements, whether written or oral, previously recognized by or entered into by the Hospital and the Union. This Agreement contains all of the terms and conditions agreed to by both parties, and the parties acknowledge that during the negotiations which resulted in this Agreement, each had the unlimited right and opportunity to make demands and proposals with respect to any subject or matter not removed by law from the area of collective bargaining and that the understandings and agreements arrived at by the parties after the exercise of the right and opportunity are set forth in this Agreement.
