General Leave of Absence Without Pay. 12.11.1 The District may, in its sole discretion, and upon the written request of the unit member and the recommendation of the Superintendent, grant a leave without pay for any reason satisfactory to the District. Permission for such leave will not be unreasonably withheld. 29.2 Leave of absence without pay will be granted where an employee is required to be absent from employment as a result of service as a Reservist in the Canadian Forces, upon sufficient notice. 29.3 Applications for leave of absence without pay stating the reason will be submitted in writing to the Out-of-Scope Head or Out-of-Scope Designate with a copy forwarded to Human Resources. For leaves of five days or less, the application shall be submitted at least two weeks in advance. For leaves of more than five days the application shall be submitted at least two months in advance. The Out-of-Scope Head or Out-of-Scope Designate will respond to the application in writing in a timely manner. 29.4 An application may be made to extend a leave for up to one further year by following the procedures in 29.3. The maximum leave is for two consecutive years. 29.5 If the APT member wishes to return early from a leave of six (6) months or longer, the member shall provide a minimum of one month’s notice, in writing to the Out-of-Scope Head or Out-of- Scope Designate. 29.6 The time requirements for notice may be waived by the Out-of-Scope Head or Out-of-Scope Designate.

General Leave of Absence Without Pay. The Board may grant an unpaid leave of absence for a period of up to one year upon written request of a bargaining unit member to the Director of Human Resources. If the Board approves the request for an unpaid leave of absence, shorter durations (i.e. less than one year) may be granted if a mutually agreed upon date can be arrived at between the bargaining unit member and the Superintendent/Designee. One additional year may be requested but the Board retains full discretion as to whether it will be granted. The decision of the Board to grant or deny a request for this leave shall not be subject to the grievance procedure. General leave is intended to offer opportunities to staff members in unusual circumstances. General leave does not apply to a leave required for medical reasons which is otherwise addressed in law or other Board policies. If the need for a leave is addressed by other provisions of the contract or Board policy, those provisions will supersede. Such leave may not be used to take employment as a teacher or administrator in a public school district in the State of Ohio. Nor may such leave be used to engage in leisure travel or recreational activities. Except in emergency situations, as determined by the Superintendent, all general leave without pay shall end at the conclusion of an academic quarter, semester, or prior to the beginning of the subsequent school year. Upon return from leave, the teacher shall be reinstated to a position (if available), shall assume the same placement on the salary schedule held prior to the leave, and shall retain her/his position on the seniority list. The teacher’s assignment, insofar as practicable, shall be comparable to that held prior to the leave. Bargaining unit members on unpaid leave are subject to reduction in force under provisions of Article 17 of the Collective Agreement.
General Leave of Absence Without Pay. Leaves of absence without pay may be granted to tenured employees who desire to return to employment in a similar capacity at a time mutually consistent with the needs of the District as determined by the Board. Each approved leave of absence shall be of the shortest possible duration required to meet the purpose for the leave consistent with a reasonable continuity of instruction for students. Leave of absence without pay for not more than one year may be granted to tenured teachers according to the following conditions: 1. Written requests for leave of absence without pay should be made at least ninety (90) days before the leave is desired, subject to approval by the Board. The ninety (90) day parameter may be waived by the Board of Education. 2. Dates of departure and return must be acceptable to the administration and determined prior to initiating the request. 3. Leaves of less than one month, if acceptable and approved by the Superintendent, will not require Board approval nor three (3) months' notice. 4. Employees will not advance on the salary scale while on any approved leave of absence without pay unless working at least ninety (90) days in any given school year in which leave is effective. 5. The employee shall inform the Superintendent of his/her intent to return to a similar position for the following school year not later than March 1. 6. A teacher on leave of absence without pay shall not lose tenure. An unpaid leave of absence shall not count when determining District seniority. 7. Teachers on such leave may continue insurance benefits subject to the insurance carrier and if they reimburse the District the cost of the insurance premium at least ten (10) days prior to the due date.
General Leave of Absence Without Pay. (a) An employee may request a leave of absence without pay for a period of up to one (1) year, which may be granted at the sole discretion of the Fire Chief. (b) The employee’s request for leave of absence without pay shall be in writing and include the following information: (i) the commencement and completion dates of the requested leave, and (ii) the reason(s) for the requested leave. (c) The employee’s request for leave of absence without pay shall be submitted to the Fire Chief at least four (4) weeks before the requested commencement date, unless a shorter period of time is agreed to by the Fire Chief. (d) The Fire Chief shall provide a written response within two (2) weeks from the date on which the employee’s request was submitted under paragraph (c) above. (e) An employee, who wants to return to work from the general leave of absence without pay effective on a date earlier than indicated pursuant to sub-paragraph (b)(i) above, may make such a request to the Fire Chief. The decision whether or not to grant the employee’s request shall be at the sole discretion of the Fire Chief. (f) The employee’s seniority shall be maintained, but shall not accrue, for the full period of the leave when the leave of absence without pay which is granted is in excess of thirty (30) days.
