Lead Authority. 5.1 Worcestershire County Council shall be the lead authority for the Panel and shall provide such administrative support through its Head of Legal and Democratic Services and other professional support through the Adult and Community Services Directorate as will be necessary to enable the Panel to undertake its functions which will be funded by Home Office grant.
Lead Authority. 6.1 The current lead authority responsible for the administration of the Pool shall be Leeds City Council.
6.2 The lead authority will normally act as such for a full year and may only be replaced at the year end. A lead authority wishing to relinquish the role at the financial year end (i.e. 31st March) must give a minimum of four months’ notice.
6.3 Each member of the Pool will be jointly and severally liable for any payments required to the Ministry of Housing, Communities and Local Government but, notwithstanding that, the lead authority will take responsibility for all matters in relation to the administration of the Pool including (but not limited to): all liaison with MHCLG and other government departments including the completion of all forms and returns associated with the Pool; administration of payments to and from the Pool and all calculations relating to the collection fund for the Pool; producing an annual report showing how income has been distributed and preparing periodic monitoring reports for Pool members; calculation of the costs of administering the Pool which are to be deducted from the rewards of the Pool. If the excess income generated by the Pool was insufficient to cover the administrative costs of the Pool in any year, then the shortfall would be shared between the Pool members in proportion to their spending baselines; The lead authority will ensure that the pooling arrangements, annual reports and other financial information is published and is freely available on the lead authority’s website or elsewhere as appropriate.
Lead Authority. The Authorities will appoint a Lead Authority. which is, for the time being, the Authority providing the Chairman of the MKS Board. Any external support to develop business cases may be funded from the MKS budget with a Lead Director for each business case appointed from among the Authorities.
Lead Authority. 5. 0 Xxx Xxxxxx Xxxxxxx xx Xxxxx Xxxxxxxxx shall be lead authority for the Panel and shall provide such administrative and other support as will be necessary to enable the Panel to undertake its functions.
Lead Authority. 9.1 Denbighshire County Council is appointed from the date of this Agreement as the Lead Authority for the purposes mentioned in paragraphs 9.3 to 9.11 below
9.2 The role of the Lead Authority shall be exercised subject to the approval of the Joint Committee and shall be as follows:-
9.2.1 to undertake the duties and responsibilities of the Lead Authority referred to in the Agreement
9.2.2 to act on behalf of the Joint Committee when this achieves Best Value or adds value to the attainment of the Objectives or the performance of the Functions or when it is necessary or desirable to do so in order to attract or secure external funding or other resources from outside the Authorities and/or;
9.2.3 to make and provide all appropriate banking accounting and audit arrangements and services required for the due and proper receipt, holding and application of the Joint Committee’s funds and/or;
9.2.4 to be the legal point of contact with suppliers for all joint procurements and/or;
9.2.5 subject to paragraph 5.6, to provide such administrative resources as shall be reasonably necessary to enable the Joint Committee to discharge their respective roles, duties and functions and which are not otherwise provided for under this Agreement.
9.2.6 to provide the secretariat for any relevant meetings of the Associated Bodies.
9.3 Each of the other Authorities shall (and hereby duly undertake with the Lead Authority to) indemnify the Lead Authority against and/or contribute and pay in equal shares all or any liabilities claims costs and/or expenses of or reasonably incurred by the Lead Authority in or in connection with or in the course of or as a result of:-
9.3.1 performing or discharging its roles and/or responsibilities in paragraph 9.2 of this Agreement as the Lead Authority: and/or
9.3.2 undertaking any contract or commitment on behalf of the Joint Committee for the purposes of or pursuant to this Agreement contrary to proper local government practice or local government law or substantial or persistent failure (after due notice) to redress performance of the duties of the Lead Authority which shall not comply with the requirements or the standards of or set by this Agreement
9.4 The Lead Authority shall owe no duty of care to the other Authorities and have no liability or responsibility in respect of or in relation to the performance or discharge of (or omission to perform or discharge) any role or function referred to in Clause 9.2 the discharge or exercise of which ...
Lead Authority. 5.1 The Lead Authority for each function listed in Clause 4.6 shall act on behalf of all the Authorities in respect of that function.
5.2 The Lead Authority shall act under the direction of the Board.
5.3 Where the Lead Authority for a particular function incurs any costs or liability in discharging that function, that Authority shall promptly inform the Treasurer of the cost or liability.
Lead Authority. 7.1 The Constituent Authorities have agreed that Dundee City Council shall be the Lead Authority.
7.2 The Lead Authority shall be the employing or secondee authority for the Programme Manager, the PMO and any other person appointed by the Joint Committee.
7.3 The Clerk to the Joint Committee may appoint a depute or deputes as appropriate subject always to agreement by the Constituent Authorities.
7.4 The Treasurer to the Joint Committee may appoint a depute or deputes as appropriate subject always to agreement by the Constituent Authorities.
7.5 The Lead Authority shall provide administrative, professional and technical support services as may be required, which services shall include financial, legal, audit, human resources, information technology systems and security and any other professional or technical support services as required to enable the Joint Committee to deliver its functions.
7.6 In particular the Lead Authority shall:-
i. develop, in consultation with the Heads of Legal Services or equivalent of the other Constituent Authorities, all necessary governance documents for the effective operation of the Joint Committee;
ii. ensure that the PMO budget and funding are used legally and appropriately;
iii. prepare regular consolidated budget monitoring statements for consideration of the Joint Committee;
iv. prepare the annual report and accounts for the Joint Committee and arrange for audit of the said accounts;
v. ensure that any decisions in delivering the Functions conform with relevant legal requirements including equalities, environment, European Union legislation, sustainability and best value;
vi. allocate and account for distribution of Tay Cities Deal grant income and enter into grant agreements on behalf of the Joint Committee with the relevant Constituent Authorities, Constituent Member Organisations and third parties in respect of the specified projects required to deliver the TCD Programme;
vii. prepare and circulate all meeting agenda, reports and minutes;
viii. publish the Joint Committee processes and outcomes;
ix. facilitate engagement with the UK and Scottish Governments; and x. manage Joint Committee communications including the Tay Cities Deal website.
Lead Authority. 6.1 The North Yorkshire Council shall be lead authority for the Panel and shall provide such administrative and other support as will be necessary to enable the Panel to undertake its functions.
6.2 As host authority, the Council will ensure that support and guidance is provided to executive and non-executive members and officers of the Authorities in relation to the functions of the Panel as and when required.
Lead Authority. 9.1. Cumbria County Council will act as the Lead Authority for the Cumbria Business Rate Pool.
9.2. The responsibilities of the Lead Authority are: With reference to Schedule 1 to make payments on behalf of the Pool to central government and Pool Members on time and in accordance with the schedule of payments; To liaise with and complete all formal Pool returns to central government on behalf of Pool Members; To keep Pool Members informed of all communications with central government, To manage the resources of the Pool in accordance with this Agreement; To prepare quarterly monitoring reports and consolidate intelligence on future resource levels on behalf of the Pool; To prepare the annual report of the Pool’s activity; To co-ordinate the annual review and refresh of the Pool’s governance arrangements and the methodology for the allocation of resources; To secure the completion of any legal agreements, accounting and audit arrangements required to support the operation of the Pool; With reference to Schedule 1 to consult on and administer the schedule of payments between Pool Members in respect of all financial transactions that form part of the Pool’s resources; With reference to Schedule 1to lead on the timely provision of the information required by Pool Members, in preparing their annual Statement of Accounts in relation to the activities and resources of the Pool; and To administer the continuation or the dissolution of the Pool in future years.
9.3. To assist the Lead Authority in fulfilling this role, the responsibilities of individual Pool Members are: With reference to Schedule 1 to make payments to the Pool on time and in accordance with the schedule of payments; With reference to Schedule 1 to provide accurate, timely information to the Lead Authority to enable all formal Pool returns to central government to be completed; To inform the Lead Authority, as soon as is practical, of any intelligence that may impact on the resources of the Pool either in the current year or in future years; To provide such information as the Section 151 Officers agree is reasonable and necessary to monitor/forecast the Pool’s resources within the timescales agreed; To provide such information as the Section 151 Officers agree is reasonable and necessary on the use of the Pool’s resources for inclusion in the Pool’s annual report; and With reference to Schedule 1 to provide accurate and timely information on the end of year financial performance of the business rat...
Lead Authority. 6.1 COLC, as the Lead Authority, shall continue to act as the accountable body to Government and administer the Pool. The Participating Authorities hereby acknowledge that the Lead Authority is carrying out valuable services on behalf of the Participating Authorities, and that it is entitled to reimbursement of its reasonable costs and expenses in providing those services. This MOU makes provision for the reimbursement in the calculation of Financial Benefit.
6.2 The GLA shall provide transactional support to the Lead Authority, including administering and operating treasury management and making any monetary transfers between Participating Authorities in respect of the Pool on behalf of the Lead Authority including any sums due to the GLA.
6.3 These monetary transfers between Participating Authorities will be collected or paid by the GLA on the basis of a schedule of payments which will be determined by the GLA in consultation with the COLC, reflecting the Government's Payment Requirements and scheduled instalment dates. which are prescribed in secondary legislation. (This reflects the fact that the GLA already has the systems in place to manage payment flows to and from Billing Authorities for the existing business rate retention scheme).
6.4 The GLA shall also transfer any sums required to COLC based on the schedule of instalments agreed with MHCLG so that COLC as Lead Authority can pay the net Tariff payment payable by the Pool as approved in the Local Government Finance Settlement.
6.5 COLC shall also transfer any sums COLC receives from MHCLG in Safety Net payments to the GLA so that the GLA can distribute this to Participating Authorities if applicable.
6.6 The Lead Authority's responsibilities shall include:
6.6.1 all accounting for the finances of the Pool and the balance of SIP funds remaining from prior years including payments to and from the Government;
6.6.2 management and administration of the Pool;
6.6.3 receiving payments from Participating Authorities and making payments to Government on behalf of Participating Authorities on time;
6.6.4 maintaining a cash account on behalf of the Pool and paying Interest on any credit balances;
6.6.5 liaising with and completing any formal Pool returns to central government;
6.6.6 administering the schedule of payments between Participating Authorities in respect of the financial transactions that form part of the Pool's resources;
