LEAVE FOR SPECIAL CIRCUMSTANCES. Employees shall be allowed leave of absence with pay and without loss of seniority and benefits for the following reasons: Reason Leave of absence Serious fire or flood in employee's household up to 3 days Moving employee's household 1 day per contract year Serious household/ 1 day per contract year domestic emergency Formal hearing to become a Canadian citizen 1 day Part-time employees will be granted the number of days leave provided for in this Article, but will receive pay on a pro-rated basis for leave taken.
LEAVE FOR SPECIAL CIRCUMSTANCES. Section 1. In the event of a death in an employee’s family, the employee may request up to ten (10) days of annual leave or leave without pay (LWOP). The Agency shall make every reasonable effort to grant such requests. For the purposes of this Agreement, “family” is defined as the employee’s father, mother, son, daughter, brother, sister, grandparent, grandchild, uncle, aunt, cousin, nephew, niece, husband, wife, father-in-law, mother-in-law, son- in-law, daughter-in-law, brother-in-law, sister-in-law, step-father/mother/ sister/brother/son/daughter, half-brother, half-sister, and life or domestic partner.
Section 2. Requests for annual or sick leave for emergencies involving illness or injury in the family shall be given priority.
Section 3. An employee whose personal religious beliefs require the abstention from work during certain periods of time may, after advanced approval by the Agency, elect to engage in overtime worked for time loss for meeting those religious requirements. Any employee who so elects shall be granted equal compensatory time off from the employee’s scheduled tour of duty (in lieu of overtime pay) for such religious reasons, not withstanding any other provision of law.The earned compensatory time is used to cover the absence for the religious observance.The Agency may disapprove an employee’s request if work schedule modifications would interfere with efficient accomplishment of the FAA mission.
Section 4. In accordance with the Family Medical Leave Act (FMLA), upon request, an employee is entitled to a total of twelve (12) administrative work weeks of leave without pay (LWOP) during any twelve (12) month period for one (1) or more of the following reasons:
a. the birth of a son or daughter of the employee and the care of such son or daughter;
b. the placement of a son or daughter with the employee for adoption or xxxxxx care;
c. the care of a family member (including pregnancy related medical conditions) who has a serious health condition; or
d. a serious health condition (including pregnancy related medical conditions) of the employee that prevents the employee from performing the essential functions of his/her position. An employee may elect to substitute sick leave, annual leave, compensatory time, or credit hours for LWOP under FMLA.
Section 5. Employees may request annual leave or LWOP to care for members of their families under the following circumstances where an employee:

LEAVE FOR SPECIAL CIRCUMSTANCES. The Employer may grant leaves with or without pay for reasons not defined in this agreement. When the employee requests this leave, the employee either at the time of the request or upon his return to work, shall provide details, in writing, of the special circumstances requiring such leave. If the employee requests this leave due to illness in the family, a medical certificate may be required indicating the employee's presence is necessary. An employee required to appear in Court as a subpoenaed witness or summoned juror shall be given a leave of absence with pay for that purpose provided that the employee shall pay any fees received from that appearance to the County, up to a maximum of the employee's salary. An employee shall use a leave of absence only for the purpose for which it is granted. If a leave of absence is used for any other purpose, the employee may be subject to discipline in accordance with Article
LEAVE FOR SPECIAL CIRCUMSTANCES. 15.1 An employee required to appear in Court as a subpoenaed witness or summoned juror shall be given a leave of absence with pay for that purpose provided that the employee shall pay any fees (excluding expenses paid by the courts) received from that appearance to the Employer, up to the maximum of the employee's salary.
15.2 Where an employee attends the birth of their child, the Employer will provide up to one (1) day leave with pay.
15.3 The Employer may grant leaves with pay and with benefits, with pay and without benefits, without pay and with benefits or without pay and without benefits for reasons not defined in this Collective Agreement. In these instances the Employer may require the employee to provide, in writing, the reasons for such leave.
15.4 Subject to Clause 2.3 and with prior authorization by the Employer, regular employees shall be granted up to five (5) personal leave days per year. Leave under this section may only be taken in periods of one half (½) day or more.
15.5 All accumulated leaves of absences covered by this Collective Agreement shall be reported on the employee’s pay statement.
LEAVE FOR SPECIAL CIRCUMSTANCES. 21.10.1 An employee who will be a primary care giver to an immediate family member or household member who is terminally ill, may use their entitled sick leave for carers leave purposes. This will allow an employee to care for the person, whilst being able to access their entitled sick leave.
21.10.2 This entitlement will only apply to employees who need to provide care for a terminally ill family member. To access this entitlement a letter from a medical practitioner needs to be submitted to the employer, detailing:
(a) The name of the person requiring care and their relationship to the employee
(b) An estimated time the employee is required to provide that care
(c) Any other matters that may assist the employer to determine the employee’s entitlement to the leave.
21.10.3 Each matter will be dealt with on a case-by-case basis, and the employer will consider allowing the employee access to their accrued annual leave and long service leave in the first instance.

The Employer may grant leaves with or without pay for rea- sons not defined in this Agreement. such leave. An employee shall be granted two (2) days leave with pay per year to care for an injured or ill spouse, child or parent. An employee required to appear in Court as a subpoenaed witness or summoned juror shall be given a leave of absence with pay for that purpose provided that the employee shall pay any fees receivedfrom that appearance to the Employer, up to a maximum of the employee's salary. Section 2. Annual leave or sick leave requests for emergencies involving illness or injury in the family shall be given priority.
Section 3. Eligible BUEs, whose appointments are not limited to one (1) year, are entitled to fifteen (15) calendar days of military leave per fiscal in accordance with 5 U.S.C. § 6323(a). Unless operational requirements do not permit, the Employer shall adjust the schedule for any BUE who is a military reservist to allow them to attend weekend reserve training drills.
Section 4. Requests for annual leave to observe the Sabbath, a religious event, or an ethnic holiday will be given priority consideration for approval.
Section 5. To the extent that modifications in work schedules do not interfere with the efficient accomplishment of the Employer’s mission, a BUE whose personal religious beliefs require that they abstain from work at certain times of the workday or workweek will be permitted to work alternative work hours so that the BUE can meet the religious obligation in accordance with applicable law, rule, and regulation. The hours worked in lieu of the normal work schedule may not create any entitlement to premium pay (including overtime pay).
Section 6. After consulting a physician, a BUE may request a modification of their work duties/schedule due to working conditions that may have a detrimental effect on the BUE or to an unborn child, if the BUE is pregnant.
Section 7. In accordance with 5 U.S.C. § 6327, BUEs may use up to seven (7) days of paid leave each calendar year to serve as a bone-marrow donor, and up to thirty (30) days of paid leave each calendar year to serve as an organ donor. Leave for bone marrow and organ donation is a separate category of leave that is in addition to annual and sick leave.
Section 8. A BUE, having volunteered their services and/or having been recommended to the Employer by the Federal Emergency Management Agency for pre-emergency training programs or test exercises, and who is approved by the Employer to participate, shall be excused, without charge to leave or loss of pay, for a period not to exceed forty (40) working hours in any calendar year for such participation.
Section 9. Requests for leave under this Article shall be given priority consideration over other leave requests.

Any full-time BUE whose appointment is not limited to one (1) year is entitled to military leave. 5 U.S.C 6323(a) provides fifteen (15) calendar days military leave per fiscal year for active duty, active duty training, and inactive duty training. Unless operational conditions do not allow, the Employer shall adjust the schedule on any BUE who is a military reservist to allow him/her to attend weekend reserve training drills.
