Return to Bargaining Unit. A. Promotion to a Non-Union Administrative Position: In the event that a bargaining unit member is promoted to a Non-Union Administrative Position, and within twelve (12) months of the promotion, the employee requests to return to the Corrections Sergeant classification, or is demoted by the Sheriff, the employee will be permitted to return to the bargaining unit and shall retain as classification seniority all time spent in a Non-Union Administrative Position. B. Freezing of Classification Seniority: After completion of the twelve (12) month period in section A, the employee’s classification seniority within this bargaining unit shall be “frozen” at the date of promotion. Employees promoted prior to January 1, 2003 will receive credit for all time spent within the bargaining unit prior to that date in determination of their “frozen” classification seniority. Any employee who requests to return to the Corrections Sergeant classification, or is demoted by the Sheriff, will be permitted to return to the bargaining unit with classification seniority as “frozen” on the date of their promotion, or January 1, 2003. Any loss of seniority under the provisions of Article 11, section 1 of this agreement shall include the loss of all “frozen” seniority.
Return to Bargaining Unit. Where an employee is promoted or transferred from a bargaining unit position to a non-bargaining unit position and is subsequently unable to perform satisfactorily in the non-bargaining unit position (whether by reason of disability or skill considerations), within ninety (90) calendar days from the date of promotion or transfer, the University shall return such employee to the bargaining unit classification previously held, without complying with the posting and bidding requirements of Article 18. Upon such return, the employee's wage rate and seniority shall be as if he/she had never left the bargaining unit classification. In the event that the ninetieth (90th) calendar day probationary period has passed, the University may return such employee to any vacant position which is the same as, or lower than, the classification the employee previously held. The employee shall be paid at the current rate of pay for that classification according to that employee's seniority.
Return to Bargaining Unit. (a) An employee who accepts a position with the District outside the Unit shall have the option to revert to the employee’s former position for a period of 6 months without loss of seniority or other fringe benefits. (b) An employee who accepts a position with the District outside the bargaining unit who is rejected pursuant to Article 17.7(b), except by reason of discharge for just cause, shall have the option to revert to the position most recently occupied prior to the promotion, without loss of seniority or other fringe benefits. (c) In the event of (a) or (b) above if the previously held position is occupied, dislocation of employees shall be made in the reverse order of appointments which were made as a consequence of the original promotion. If the previously held position has been abolished, the employee shall have bumping rights based on seniority to a position within the highest classification previously held and dislocations which result thereby shall be treated in the same manner. (d) Any employee who has been employed in a District position outside the Unit for a period of more than 6 months may be placed in a position for which the employee meets the minimum qualifications. No current employee shall be transferred, demoted or terminated to create a vacancy for the returning employee.
Return to Bargaining Unit. When bargaining unit members accept positions outside the bargaining unit but still within the College, they can apply for bargaining unit positions as external applicants if such application occurs within six (6) months of the date of leaving the bargaining unit. If such individuals accept an offer of a bargaining unit position, they will return at the pay level applicable to the position. The pay step is determined as follows:

Return to Bargaining Unit. An EMPLOYEE who has been promoted out of this bargaining unit, from within this bargaining unit, whose position has been eliminated, may assume any vacant position within the bargaining unit, for which that person is qualified, providing that all promotional rosters within the bargaining unit shall first be exercised resulting in the available vacancy being the lowest classification available.
Return to Bargaining Unit. Any Sergeant who is laid off may return to this bargaining unit replacing the Police Officer having the least departmental seniority, provided that his own department seniority is greater and that he is otherwise qualified for the position. This section shall apply only to those Employees who held the rank of Police Officer in this department.
