Return to Bargaining Unit. Any employee transferring out of the bargaining unit but remaining in the employ of the Employer shall retain his/her seniority rights, with no accumulation of seniority during the period of such employment out of the bargaining unit.

Return to Bargaining Unit. A. Promotion to Sergeant/Detective Sergeant or a Non-Union Administrative Position: In the event that a bargaining unit member is promoted to Sergeant or Detective Sergeant or a Non-Union Administrative Position, and within twelve (12) months of the promotion, the employee requests to return to the Deputy classification, or is demoted by the Sheriff, the employee will be permitted to return to the bargaining unit and shall retain as classification seniority all time spent as a Deputy and as a Sergeant or Detective Sergeant, or in a Non-Union Administrative Position.
Return to Bargaining Unit. Where an employee is promoted or transferred from a bargaining unit position to a non-bargaining unit position and is subsequently unable to perform satisfactorily in the non-bargaining unit position (whether by reason of disability or skill considerations), within ninety (90) calendar days from the date of promotion or transfer, the University shall return such employee to the bargaining unit classification previously held, without complying with the posting and bidding requirements of Article 18. Upon such return, the employee's wage rate and seniority shall be as if he/she had never left the bargaining unit classification. In the event that the ninetieth (90th) calendar day probationary period has passed, the University may return such employee to any vacant position which is the same as, or lower than, the classification the employee previously held. The employee shall be paid at the current rate of pay for that classification according to that employee's seniority.
Return to Bargaining Unit. When bargaining unit members accept positions outside the bargaining unit but still within the College, they can apply for bargaining unit positions as external applicants if such application occurs within six (6) months of the date of leaving the bargaining unit. Return to Bargaining Unit. Any Sergeant who is laid off may return to this bargaining unit replacing the Police Officer having the least departmental seniority, provided that his own department seniority is greater and that he is otherwise qualified for the position. This section shall apply only to those Employees who held the rank of Police Officer in this department. Employees who are promoted to the classification of Sergeant may re-enter this bargaining unit at any time during their probationary period, even if the Police Officer with the least departmental seniority must be laid off. Return to Bargaining Unit. Employees who are promoted from the classification of correction officer to the classification of corrections corporal or sergeant may return or be returned to the bargaining unit without loss of bargaining unit seniority for the first six (6) months following promotion. Employees (former corrections officers) shall have their seniority frozen upon promotion. Should any employee return beyond six (6) months, they shall return with the seniority they left with for the purposes of preferences and layoff. Any other sheriff’s department employee entering the corrections unit shall have day one (1) seniority for purposes of layoff, recall, and for benefits predicated on bargaining unit or classification seniority.
Return to Bargaining Unit. If the employee returns to the bargaining unit, reinstatement will be in the same job classification with the group classification held prior to leaving the bargaining unit, provided the employee has the seniority to hold the job and there is a vacancy. The employee may also assume the first position available in a lower classification, provided seniority allows. The time spent out of the bargaining unit will not be counted toward seniority within the unit.
