RIGHTS AND OBLIGATIONS OF THE EMPLOYER. 12.1 The Employer undertakes to become and remain the registered owner of the Property until the Completion Date.
12.2 The Employer acknowledges that there will be construction work in the vicinity of the Property and that certain inconvenience may be caused thereby. The Contractor shall not be held liable for such inconvenience or any damages that flow there from and shall be entitled, (where necessary) to enter upon the Property for purposes of obtaining access to adjacent xxxxx in the course of such construction work.
12.3 The Contractor will be liable for the payment of all water consumption accounts received from the Local Authority as from the date of commencement of the Works by the Contractor until the Completion Date.

Where the Employer has registered a mortgage bond against the Title Deed of the Property and utilises such mortgage bond to effect payment of the Contract Price or any part thereof, then and in that instance the Employer is liable for the payment of interim interest to the financial institution. All such interest must be paid in full before the Completion Date.
RIGHTS AND OBLIGATIONS OF THE EMPLOYER. 8.1. The Employer has the right:
8.1.1. For freedom of choice when hiring;
8.1.2. To amend, to supplement, to terminate and to cancel the Contract with the Employee in the manner and on the reasons established by the Labor Code of the Republic of Kazakhstan;
8.1.3. To issue Acts within its authority;
8.1.4. To establish and to join associations in order to represent and protect own rights and interests;
8.1.5. To demand the Employee to fulfill the terms and conditions hereof, rules of labor regulations and other acts of the Employer;
8.1.6. To encourage the Employee, to impose a disciplinary sanction, to bring the Employee to material liability in cases and in the manner prescribed by the Labor Code of the Republic of Kazakhstan;
8.1.7. For compensation of damage caused by the Employee during performance of its duties;
8.1.8. To appeal to the court in order to protect its rights and legitimate interests in the sphere of labor;
8.1.9. To set a probationary period for the Employee;
8.1.10. To provide workers with professional training, retraining and raising their qualification in accordance with the Labor Code of the Republic of Kazakhstan;
8.1.11. For reimbursement of their costs related to the Employee training in accordance with the Labor Code of the Republic of Kazakhstan;
8.1.12. To appeal consistently to the conciliation commission, the court for the resolution of an individual labor dispute in the manner prescribed by the Labor Code of the Republic of Kazakhstan;
8.1.13. Other rights provided by the current legislation of the Republic of Kazakhstan.
8.2. The Employer is obliged to:
8.2.1. Observe the requirements of the labor legislation of the Republic of Kazakhstan, this Contract and the issued own Acts;
8.2.2. When hiring, to conclude a contract with an employee in the manner and on the terms established by the Labor Code of the Republic of Kazakhstan;
8.2.3. When hiring, to require documents necessary for the conclusion of the employment contract, in accordance with Clause 32 of the Labor Code of the Republic of Kazakhstan;
8.2.4. Provide the Employee with the work stipulated hereby;
8.2.5. Pay the Employee wages and other payments timely and full amount provided for by regulatory legal acts of the Republic of Kazakhstan, this Contract, Acts of the Employer;
8.2.6. Familiarize the Employee with the Rules of the Labor Procedure, other Employer's Acts that are directly related to the work (labor function) of the Employee;

The Employer will be liable for the payment of all water consumption accounts received from the Local Authority as from the date of commencement of the Works by the Contractor and the Contractor does not accept any responsibility towards the payment of such accounts nor for any damages that the Employer may suffer or any delays that might occur as a result of non-payment of the accounts by the Employer.
RIGHTS AND OBLIGATIONS OF THE EMPLOYER. 2.01 Nothing in this Agreement shall affect the authority of the Employer:
(a) to determine the mission, budget, organization, number of employees, and internal security practices of the agency, and
(b) in accordance with applicable laws:
(1) to hire, assign, direct, lay off, and retain employees in the agency, or to suspend, remove, reduce in grade or pay, or take other disciplinary action against such employees;
(2) to assign work, to make determinations with respect to contracting out, and to determine the personnel by which agency operations shall be conducted;
(3) with respect to filling positions, to make selections for appointments from:
(A) among properly ranked and certified candidates for promotion, and
(B) any other appropriate source, and
(4) to take whatever actions may be necessary to carry out the agency mission during emergencies.
2.02 The Employer shall be free in situations of emergency to take whatever action may be necessary to carry out their assigned mission regardless of any prior commitment. When practicable, within the time limits dictated by the emergency, the Employer shall confer with Union representatives prior to taking action which would alter or violate previous commitments.
RIGHTS AND OBLIGATIONS OF THE EMPLOYER. 5.1. The Employer shall be obliged to:
5.1.1. acquaint the Employee with the effective Internal Regulations, Code of Ethics and Academic Code of Ethics, Conduct, programme implementation, education process and other governing regulations/rules, relating to the Employee’s activity, and place draft amendments to these documents at announcement board and/or official webpage (xxx.xxxx.xxx.xx);
5.1.2. create the safest environment for Employee’s life and health; provide him/her with the information on special conditions and risks relating to the activity;
5.1.3. provide the Employee with adequate working conditions, care about improvement of working conditions and provide opportunities for involvement of the Employee in university life;
5.1.4. compensate costs of labor, executed overtime work and business trip of the Employee;
5.1.5. issue statement of employment upon request of the Employee, containing information on work done, employee pay and validity term of labor contract;
5.1.6. fulfill obligations and protect rights of the Employee in accordance with the effective Law of Georgia.
5.2. The Employer shall be entitled to:
5.2.1. by means of notification of the Employee (in writing or in digital format, via Employer’s e-mail), specify particular aspects of execution of works to be done under this Contract, which do not change terms and conditions of the Contract materially. Changes shall be considered agreed and become in legal force, if within 01 (one) week of notification the Employee submits no written comments. Material changes of the terms and conditions of this Contract shall be allowed on the basis of written agreement between the parties. Material change of terms and conditions of this Contract based on changes in legislation shall not require consent of the Employee;
5.2.2. adopt rules, instructions and/or other, during labor relationships, within the framework of executed contract, which are relating to the work to be done, organization of work and carrying out of activity by the Employee during working time fixed under the Contract;
5.2.3. demand from the Employee fulfillment of the terms and conditions of the Contract, requirements of Internal Regulations, Code of Ethics and Academic Code of Ethics, Code of Conduct, programme implementation, education process and other governing regulations/rules;

11.2 Neither the Employer or any person acting on his behalf shall issue any instructions or orders to any person in the employment of the Contractor or any Subcontractor on the building site.
11.3 The Employer acknowledges that there will be construction work near the Property and that certain inconvenience may be caused thereby. The Contractor shall not be held liability for such inconvenience or any damages that flow there from and shall be entitled, (where necessary) to enter upon the Property for purposes of obtaining access to adjacent xxxxx during such construction work.
11.4 If more than one Employer signs this Agreement, the Employers will be jointly and severally liable for the due performance of the terms and conditions of this Agreement. The Signatory shall in his personal capacity be liable for the due fulfilment of all the terms and conditions of this Agreement.

12.3. The Contractor will be liable for the payment of all water consumption accounts received from the Local Authority as from the date of commencement of the Works by the Contractor until the Completion Date.

If the Contractor is Liquidated after the commencement date but before the completion date or there is a delay due to a dispute between the Contractor and the Employer, the Employer will make sure that the Works are completed in the timeframes stipulated in this agreement, failing which the erf shall be restored to its previous state before commencement of the Works. This clause is to prevent half completed structures being left for an unreasonable time.
