SENIORITY AND RECALL. 21.01 Seniority is defined as the length of continuous service with the Midland Police Service, and for the purpose of this Article shall be applied in determining the order of recall of members. 21.02 Seniority shall be effective from the date employment commences with the Midland Police Service. 21.03 The BOARD shall maintain an up-to-date list, showing the date upon which each member’s service commenced. A copy of the Seniority List shall be made available to the ASSOCIATION upon request. 21.04 Seniority rights shall cease in the following circumstances: a) if a member resigns; b) if a member is discharged under the Police Act and not reinstated; c) if a member retires; d) if a member is laid off for a period in excess of five (5) years; e) if a member who has been laid off does not report for work within fourteen (14) days of recall, as provided for in Article 21.06. 21.05 Where the BOARD has made a decision to reduce the complement of the Police Service and such reduction of personnel cannot be accommodated through attrition, and where such action is not in contravention of the Police Services Act of Ontario, the members shall be laid off in order of reverse seniority and shall be recalled in order of seniority when a vacancy in the compliment of the Service exists. 21.06 Members laid off due to a reduction in staff and who fail to return to work within fourteen (14) working days after notice to return to work has been forwarded by registered mail to the last known address of such member shall be deemed to have severed their service with the BOARD and shall forfeit all seniority rights, except in the case of sickness or other just cause. 21.07 No new members will be hired until those laid off members have been given the opportunity of recall. 21.08 A member who is laid off by the BOARD shall have the option to have their benefit coverage continue for a period of twenty-four (24) months from the date of layoff provided he/she reimburses the BOARD as required to cover costs.

SENIORITY AND RECALL. (a) A casual employee shall be recalled for work at his/her point of assembly based on his/her current standing on the recall list subject to his/her ability to meet the requirements of the job. (b) If a casual employee changes his/her point of assembly s/he shall retain his/her service seniority. His/her recall order at the new point of assembly shall be determined by the first day for which pay is received at the new point of assembly. (c) A casual employee shall continue to accrue service seniority on approved leaves of absence of less than 30 days. (d) A casual employee shall be terminated if s/he works less than 240 hours during the preceding twelve month period. Included within the 240 hours is the time a casual employee would have worked when on an approved medical or education leave.

Seniority will accumulate only during regular and probationary appointments to a class title covered by this Agreement. 16.1.2 Seniority shall be based on the length of continuous regular and probationary service with the Employer from the date the employee was first appointed to a class title covered by this Agreement. 16.1.3 In the event it is determined by the Employer that it is necessary to reduce the workforce, employees will be laid off by class title based on inverse length of seniority in that class. 16.1.4 Whenever possible, a two (2)-week notice shall be given any employee laid off during the school year. 16.1.5 Any employee who becomes surplus personnel under layoff, or the process of reduction, shall be declared laid off and shall hold recall rights to his/her former title for twenty-four (24) months from the effective date of the layoff. 16.1.6 An employee on layoff who has been offered and has refused the offer of an assignment equivalent in the number of regularly-scheduled-hours assigned prior to the layoff, forfeits any and all rights to recall. 16.1.7 An employee on layoff who accepts any assignment with the District during the recall period other than an assignment deemed temporary by the Employer from the outset, is considered recalled, and has no further rights of recall. 16.1.7.1 An employee in the title of Special Needs Bus Driver who is laid off may bump the least senior employee in the title of Van Driver, provided the Special Needs Bus Driver has greater seniority than the least senior Van Driver.

SENIORITY AND RECALL. A. SENIORITY - GENERAL RULES 1. Seniority within the Transportation Department shall be defined as the length of continuous service in the employ of the District in the classification as a regular driver, since last date of hire. In accordance with such definition, such seniority shall commence with the actual starting date of active employment as a regular driver. 2. Substitutes have no seniority and time spent as a substitute in the Transportation Department or other departments in the District will not accrue seniority for bumping or layoff protection. 3. Seniority will not accrue while on layoff. 4. Seniority with the Greece Central School District will be lost in accord with items 1 and 2 under Recall Rights, below. 5. An employee who loses seniority and is subsequently rehired will be considered as a newly hired employee. 6. Seniority will not accrue while on unpaid leave of absence.
SENIORITY AND RECALL. In cases of retrenchment, seniority shall be used to determine the order of retrenchment at the campus suffering the financial exigency. The Jamestown Campus and the Cattaraugus County Campus shall each have separate seniority lists. If it becomes necessary to transfer faculty members from one campus to the other, they shall carry their seniority with them. However, no faculty retrenched from either campus shall oust full-time, continuing contract faculty from the other. The above provisions are meant to apply to ‘non-teaching’ faculty members of the Association, as well as to ‘teaching’ faculty. 6.10.1 The college shall make every effort to re-employ within the institution in some other positions for which they are qualified those persons whose services have been terminated. A tenured faculty member retrenched for financial exigency will have the right of first refusal if his or her position is reinstated. This right shall be applicable for two years from the date that his or her employment ends. Upon recall, the affected faculty member shall be returned to a salary and benefits level containing no less than 75% of the negotiated salary increases and 100% of the negotiated benefits attained by actively employed faculty during time of retrenchment. 6.10.2 The college will conduct a comprehensive review of the seniority of its faculty annually. A comprehensive list will be developed and made available to employees upon request, with a copy going to the Faculty Association. The college will provide an updated seniority list to the Association no later than November 1 of each academic year.
