SENIORITY/CONTINUOUS SERVICE. 16.1 An employee’s seniority/continuous service will accumulate and shall be calculated as follows:
(a) from the date of appointment to the regular service for those employees with no prior service in the Ontario Public Service.
(b) for a fixed term employee appointed to a full time position in the regular service, from the date established by adding the actual number of full time weeks worked during his or her full time employment back to the first break in employment that is greater than thirteen (13) weeks. When calculating seniority in this situation, a period of part time fixed term employment shall neither constitute a break in service nor be counted towards seniority except that any full time weeks worked during such part time employment shall be calculated into the employee’s seniority; or
(c) for a fixed term employee appointed to a regular part time position in the regular service, the greater seniority of:
i) the later of January 1, 1984 or the date he or she commenced a period of unbroken, part-time employment in the fixed term service, immediately prior to appointment to a regular part time position; or
ii) the actual number of full time weeks worked as a full time fixed term employee calculated pursuant to Article 16.1(b) above. Notwithstanding the above, subject to Article 27, seniority is not credited until completion of the probationary period.
16.1.1 For purposes of application of this article, any break in service of less than thirteen
SENIORITY/CONTINUOUS SERVICE. Seniority shall continue to accumulate while an employee is receiving Workers Disability Compensation benefits. Time so spent will be counted as continuous service for benefit accrual rate purposes only. The above supplemental compensation shall be issued in periodic payments to the employee, at intervals of not more than thirty (30) calendar days, beginning with the
SENIORITY/CONTINUOUS SERVICE. (a) Employees employed in the Mental Health Centre Penetanguishene in the AMAPCEO bargaining unit on December 14, 2008 who transferred employment to the Hospital on December 15, 2008, shall retain their seniority and continuous service dates from the OPS for all purposes in determining seniority under this collective agreement.
(b) Employees employed by the Mental Health Centre Penetanguishene outside the AMAPCEO bargaining unit on December 14, 2008 shall retain their seniority and continuous service dates from the OPS for all purposes, save and except for the purpose of exercising bumping rights under Article 27, which shall be based on the date of hire into the AMAPCEO bargaining unit.
(c) For employees hired by the Hospital after December 15, 2008, seniority shall be based on the date of hire with the Hospital for all purposes, save and except for the purpose of exercising bumping rights under Article 27, which shall be based on the date of hire into the AMAPCEO bargaining unit.
SENIORITY/CONTINUOUS SERVICE. An employee’s seniority/continuous service will be calculated as follows:
SENIORITY/CONTINUOUS SERVICE. 16.1 An employee’s seniority/continuous service will accumulate and shall be calculated as follows:
(a) employees previously employed by the Crown immediately prior to the April 1, 2011 transfer date shall retain their seniority/continuous service date from the OPS, for the purpose of determining seniority under this Collective Agreement.
(b) For all other employees seniority will accumulate and be calculated from the date of hire as a regular employee subject to successful completion of the probationary period, subject to sub-paragraphs (c) and (d) below.
(c) For a fixed term employee who is later hired as a regular full time employee, seniority will accumulate and be calculated from the date established by adding the actual number of full time weeks worked during his or her full time employment back to the first break in employment that is greater than thirteen (13) weeks. When calculating seniority in this situation, a period of part time fixed term employment shall neither constitute a break in service nor be counted towards seniority except that any full time weeks worked during such part time employment shall be calculated into the employee’s seniority.
(d) For a fixed term employee who is later hired as a regular part time employee in the regular service, seniority will accumulate and be calculated from the greater seniority of:
i) the date he or she commenced a period of unbroken, part-time employment in the fixed term service, immediately prior to appointment to a regular part time position; or
ii) the actual number of full time weeks worked as a full time fixed term employee calculated pursuant to Article 16.1(c) above.
16.1.1 For purposes of application of this article, any break in service of less than thirteen (13) weeks shall neither constitute a break in service nor be counted towards seniority.
16.1.2 For purposes of this Article:
SENIORITY/CONTINUOUS SERVICE. 15.1 An employee’s seniority/continuous service will be calculated as follows:
(a) Seniority/continuous service will accumulate from the date of last hire, regardless of whether the employee was initially hired in the AMAPCEO bargaining unit or not.
(b) An employee’s continuous service date will be calculated from the date of last hire, subject to the provisions set out in this Article. Note: The seniority for “RICN” employees is governed by the Letter of Understanding – ARTICLE 15 – Prior Service
(c) A full time employee’s seniority will be calculated on the basis of hours worked, where one year of continuous service is credited/deemed to be 1891 hours worked.
(d) The seniority for employees who are not full time will accumulate on the basis of hours worked since the date of last hire. No employee, full time or otherwise, can accumulate more than 1891 hours worked in any twelve (12) month period.
(e) A change in employee type (full time, part time, etc.), shall not constitute a break in continuous service.
(f) For the purposes of this Agreement it is agreed that employees who transferred with continuous service for the Ontario Public Service (OPS) on December 15, 2008 or July 1, 2011 to OAHPP shall have such service recognized for the purposes of seniority and service.
(g) No employee as of the date of ratification shall have his or her seniority reduced as a result of the application of this Article.
(h) Full time employees shall have their seniority recorded separately from employees described in (d) above.
15.2.1 An employee’s seniority/continuous service shall accumulate from the date determined in Article 15.1 and shall include the period of service during which an employee:
(a) is in receipt of LTIP or WSIB benefits; or
(b) is absent on pregnancy or parental leave; or
(c) is absent on any authorized leave without pay of thirty (30) calendar days or less; or
(d) is absent on Family Medical Leave.
SENIORITY/CONTINUOUS SERVICE. 16.1 An employee’s seniority/continuous service will accumulate and shall be calculated as follows:
a) from the date of appointment to the classified service for those employees with no prior service in the Ontario Public Service.
b) for an unclassified employee appointed to a full time classified position, from the date established by adding the actual number of full time weeks worked during his/her full time employment back to the first break in employment that is greater than thirteen
SENIORITY/CONTINUOUS SERVICE. 16.1 An employee’s seniority/continuous service date is calculated from the employee's hire date, following the successful completion of the employee's probationary period, unless otherwise specified in this or any other article of the collective agreement.
16.1.1 No employee who was hired before the date of ratification of the first collective agreement shall have his or her seniority/continuous service date reduced as a result of the application of this article.
16.2 An employee’s seniority/continuous service shall accumulate unbroken for any period during which an employee:
(a) is in receipt of LTIP or WSIB benefits; or
(b) is absent on pregnancy or parental leave; or
(c) is absent on any authorized leave with pay; or
(d) is absent on any authorized leave without pay of less than thirty (30) calendar days; or
(e) is absent on Family Medical Leave; or
(f) is on layoff and retains recall rights under Article 16.4 of the collective agreement.
16.2.1 When an employee’s seniority/continuous service does not accumulate, or ceases accumulating, such period of leave shall not be included in the determination of his or her seniority/continuous service. However, periods of service immediately before and after such absence shall be considered continuous and shall be included in determining seniority/continuous service.
16.2.2 Where a part time employee becomes a full time employee, any service as a part time employee which forms part of his or her unbroken service shall be calculated according to the following formula: Weekly hours of work as a Years of Continuous Service Part time Employee x as a Part time Employee Full time weekly hours of work
16.3 At the beginning of every calendar year thereafter, the Employer will post the seniority/continuous service list on the AMAPCEO bulletin board and on the Employer’s intranet and will provide AMAPCEO with a copy of the updated seniority/continuous service.
16.4 Seniority/continuous service shall be deemed to have terminated if:
(a) an employee resigns or retires; or
(b) an employee is dismissed unless such dismissal is reversed through Article 22 (Dispute Resolution); or
(c) an employee is absent for a period greater than five (5) consecutive days, without notifying the employer; or
(d) an employee is laid off under Article 27 (Layoff and Recall) and not recalled or otherwise reassigned for more than twelve (12) months.
SENIORITY/CONTINUOUS SERVICE. Employees shall retain and accumulate seniority and continuous service while on layoff subject to the requirements of the break-in-service provisions.
SENIORITY/CONTINUOUS SERVICE. 16.1 Employees previously employed by the Office of Child and Family Services Advocacy prior to the October 5, 2007 transfer date, shall retain their seniority/continuous service date from the OPS, for the purpose of determining seniority under this collective agreement. For all other employees, seniority will accumulate from the date of hire, subject to successful completion of the probationary period.
16.1.1 For purposes of application of this article, any break in service of less than thirteen (13) weeks shall neither constitute a break in service nor be counted towards seniority.
16.1.2 For purposes of this Article:
(a) Unbroken service‖ is that which is not interrupted by separation from the EMPLOYER as per Article 16.4;
(b) Full time‖ is continuous employment as set out in the hours of work article for the position;
(c) Part time‖ is continuous employment with hours worked being less than full time hours per Article 16.1.2(b);
(d) Regular part time‖ means part time employment in the classified service.
16.1.3 For the purpose of calculating vacation entitlement, no employee as of the date of ratification shall have his or her seniority/continuous service reduced as a result of the application of this article.
16.2.1 An employee‘s seniority/continuous service shall accumulate from the date determined in Article 16.1 and shall include the period of service during which an employee:
(a) is in receipt of LTIP or WCB benefits; or
(b) is absent on pregnancy or parental leave; or
(c) is absent on any authorized leave without pay of thirty (30) calendar days or less; or
(d) is absent on Family Medical Leave.
16.2.2 Except for the situations described in Article 16.2.1, where an employee is absent on a leave without pay that exceeds thirty (30) calendar days, the period of leave shall not be included in the determination of his or her seniority/continuous service. However, periods of service immediately before and after such absence shall be considered continuous and shall be included in determining seniority/continuous service. Notwithstanding the above, the period of leave shall be included for purposes of determining the rate of vacation credit accrual. It is understood that an unpaid leave of absence greater than thirteen (13) weeks is not a break in service.
16.2.3 Notwithstanding Article 16.1(c), where a regular part time employee becomes a full time classified employee, any service as a part time employee which forms part of his or her unbroken service ...
