Shift Selections. Qualified employees will be allowed to exercise their shift preference within their respective classifications and department, based upon their department seniority, except in those instances where the approval of such preference will place an unreasonable hardship upon the Department. If two or more employees have equal seniority within the department, the employee with the greater bargaining unit seniority shall be accorded the position. Changes of shifts pursuant to this provision may be exercised once each calendar year. All shift changes within the department shall occur at one time, on a date to be selected by the Court Administrator in the month of January of each year.

(e) If present in the Department or Classification and where applicable, the senior Trainee will be appointed to the vacant non-Trainee position at the close of the shift selection and the Trainee vacancy shall be posted. (f) Should there be a vacant position still available at the close of the shift selection, this vacancy shall be posted, as per Clause 15. (g) To avoid delay, employees will endeavour to leave a list of preferred shifts with their immediate Supervisor prior to going on vacation or other extended leave. (h) If an employee is absent during a shift selection due to medical reasons, he may make a selection in absentia until his return. Where it is not possible for the employee to make a selection, he will be assigned an available shift at the close of the selection process and will retain the shift until the next shift selection. In either case, the shift will then be filled through temporary posting, as per Clause 15.03.

Shift Selections. Employees will select shifts in seniority order within each classification in March of each year. Shift selections will be effective in the first full work week in April. No overtime will be incurred as a result of such shift selections. Employees who fail to select a shift will remain on their current shift if their seniority permits. Employees who are not able to remain on their shifts will select an alternate shift as soon as possible. When positions are posted, Employees in those classifications may select those shifts, in seniority order, prior to filling the vacancies. Exceptional circumstances that arise as a result of shift selections will be resolved by mutual agreement. The Employer may change the shifts of individuals to meet operational requirements. Except in emergencies, the Employer will provide 48 hours notice of such shift change. If less than 48 hours notice is provided, overtime will be paid for such changed shifts worked during the 48 hours. Employees will be returned to their normal shift as soon as possible provided they receive at least nine (9) hours off work between shifts. Notice will not be required if a change is to return an Employee to his normal shift. Employees will be permitted to trade shifts with the Supervisor’s approval. No overtime will be paid for such trades.
Shift Selections. The Employer will permit employees that have completed their probationary period to indicate a preference for shift assignments. Employees will be scheduled for shift assignments on the basis of preference, according to departmental seniority, except where operational requirements of the department preclude such assignments. For each pick, employees will have three (3) of their regularly scheduled work days to submit their requests. If an employee does not submit within three (3) of their regularly scheduled work days, the Employer may bypass to the next employee in seniority order and continue down the list. Shift selections will be conducted in as close to 6-month intervals as will facilitate an orderly procedure by which the selections may be processed in advance. Shift rotations will be on a quarterly basis.
