To be considered for the position of Lieutenant, the applicant must be a Sergeant with the University of Cincinnati Police Department who has successfully completed his/her probationary period. If there are no internal applicants, the Employer may select an applicant with similar supervisory experience from another force. If there are no applicants at that level, the employer may select a University of Cincinnati ULEO 3 who has successfully completed his/her probationary period or an applicant with similar supervisory experience from another force.
SUPERVISORY VACANCIES. Should a supervisory position be established that is in the classified service, the following process shall be used.

Section 14.2. It shall be the sole right and responsibility of the Employer to administer and evaluate all promotional examinations, assessments and testing procedures, and to cause to be developed all promotional examinations, assessments and testing procedures. Prior to the administration of any examination, the Employer shall post on department bulletin boards, with a copy to the FOP, the structure of the examination with the weight to be granted for each factor or part of the examinations. The bargaining unit will be given the opportunity to make suggestions of the topics to be included in this exam.
Section 14.3. If the structure of an examination includes credit for seniority and/or efficiency, an employee must achieve a passing score on all other factors in order to

Eligibility lists established by examinations, assessments and testing procedures shall remain in effect for one (1) year from the date of certification of the results by the testing service, or until the list is exhausted, whichever comes first. The parties may by mutual agreement extend the eligibility list for one (1) year. Copies of eligibility lists shall be provided to the FOP. Any bargaining unit member may inspect his/her written examination within thirty (30) calendar days from the date of certification.
Section 14.5. The selection shall be made from the top five (5) employees on the eligibility list for each position.
Section 14.6. Nothing in this Article shall be construed to limit or prevent the Employer from temporarily filling a vacant...

For the purposes of this article, Supervisory Positions are defined as those positions promulgated by the Civil Service Commission (CSC) or Appointing Authority as necessary for the effective and efficient running of any and all work units as they exist throughout any Department in State Service.

SUPERVISORY VACANCIES. (a) Supervisory vacancies in any bargaining unit position shall be advertised within thirty (30) days from the time the vacancy occurs. The Chief of Police shall call for applications from interested police officers currently in the rank and police officers in the respective promotional pool. Each applicant shall complete an application form and include a résumé, outlining training and work experience.
(b) The Chief of Police, or his designate, will choose the successful candidate based upon supervisory ability, qualifications, training, merit and experience. In the case of all these being determined equal as among the applicants, the senior applicant will be chosen.
(c) A candidate selected for a promotion who is being investigated in relation to a disciplinary matter may have the decision regarding a promotion stayed, at the discretion of the Chief of Police. The candidate shall maintain his or her status in the promotional pool and the Chief of Police may or may not fill the vacancy temporarily, pending the resolution of the matter.
(d) The police officer chosen by the Chief of Police, or the Chief of Police’s designate, to receive the promotion shall be paid the higher rate of salary from the date of promotion or from the 30th day from the date the vacancy occurred, whichever comes first.
SUPERVISORY VACANCIES. The parties agree that vacancies in the classification of T.S. and above and permanent R.F.I. and above will be posted pursuant to Article 12.2 and the selection of the successful applicant will be based on the relative abilities of the applicants. Where two (2) or more applicants are of equal ability the senior applicant will be awarded the position.

SUPERVISORY VACANCIES. When a first level non-certificated supervisory vacancy occurs, notice of such vacancy will be posted on the classified employees bulletin boards throughout the district prior to the appointment. Those employees desiring consideration for appointment to a supervisory position will file a written letter of application with the Superintendent of Schools or designee. Due consideration will be given to bargaining unit employees who may apply. Any bargaining unit employee who is appointed to a supervisory position shall have a trial period not to exceed thirty (30) consecutive work days. If, during the trial period, the Employer determines that the employee is not satisfactorily performing the duties of the supervisory position or if the employee determines that he/she is unable to perform the duties of the supervisory position, the Employer shall return the employee to his/her previous position. If at the conclusion of the trial period, the employee is reinstated to his/her previous position, he/she shall be reinstated with all previous seniority rights which are guaranteed to bargaining unit employees. Effective on the date of his successful completion of the trial period, any bargaining unit employee who is officially appointed to a supervisory position shall forfeit all rights and benefits, including seniority, guaranteed to him by this Agreement. Any actions under this section shall not be subject to the Grievance Procedure of this Agreement.
