Supplier’s Obligations and Warranties. The Supplier shall fulfil its obligations under the Agreement and is responsible, subject to clause 3.8, for the Services and the Implementation Result meeting the Agreed Specification in all material respects. The Supplier shall comply with all applicable law in delivering the Services to the Customer. Supplier and Sub-contractors shall observe and comply with all Customer policies, procedures and guidelines which are specifically identified in the Order Form. If such procedures or guidelines are amended or new rules are provided (compared to the procedures and guidelines referred to in the Agreement or otherwise known to the Supplier when entering into the Agreement) and if adherence to such amended or new procedures and guidelines increases the Supplier’s costs to provide the Services more than insignificantly, the Customer shall reasonably remunerate the Supplier on a required resources basis for such cost increases; subject, however, to prior approval by Customer in accordance with the Contract Change Procedure The Supplier shall use commercially reasonable endeavours to make the Services available in accordance with the Service Levels which are set out in the Order Form.
