VACATION PAY AND ENTITLEMENT. 18.01 The vacation year is defined from January 1st to December 31st of the same year. Nurses are expected to take all of the vacation in the year it is earned. That is, this vacation is available to be taken as it is earned. Nurses may schedule vacation according to the vacation they will accrue that year. 18.02 Nurses who reach an anniversary date increasing their vacation benefit level will begin to earn vacation at the new vacation benefit level as of the 1st of the month in which the anniversary date occurs. 18.03 Nurses who have less than one (1) year of service as of December 31st will be granted one (1) day’s vacation with pay based on 4% of gross earnings for each month of service to a maximum of ten (10) days. 18.04 Nurses with one (1) or more years of service as of their anniversary date on or before December 31st of the current year shall receive two (2) weeks’ vacation with pay based on 4% of gross earnings. 18.05 Nurses with three (3) or more years of service as of their anniversary date on or before December 31st of the current year shall receive three (3) weeks’ vacation with pay based on 6% of gross earnings. 18.06 Nurses with ten (10) or more years of service as of their anniversary date on or before December 31st of the current year shall receive four (4) weeks’ vacation with pay based on 8% of gross earnings.

VACATION PAY AND ENTITLEMENT. The Company shall give to each employee vacation pay in an amount equal to the amount indicated in this Article. Vacation is calculated on a yearly basis, from July 1st to June 30th, and the length of vacation as well as the vacation pay is based on the employee’s service as follows: (a) The Company will provide vacation pay of four percent (4%) of earnings to all employees with less than one (1) year of service with the Company as of July 1st of the vacation year. (b) The Company will provide two (2) weeks of vacation with pay equal to four percent (4%) of the years wages provided the employee has one (1) year of continuous service with the Company as of July 1st of the vacation year. (c) The Company will provide three (3) weeks of vacation with pay equal to six percent (6%) of the years wages as follows: (i) Employees with a seniority date of July 31, 2002 or earlier shall be eligible for the above after three (3) years of service. (ii) Employees with a seniority date of August 1, 2002 or later shall be eligible for the above after five (5) years of service. (d) The Company will provide four (4) weeks of vacation with pay equal to eight percent (8%) of the years wages provided the employee has ten (10) years of continuous service with the company as of July 1st of the vacation year. (e) The Company will provide four (4) weeks of vacation with pay equal to ten percent (10%) of the years wages provided the employee has fifteen (15) years of continuous service with the company as of July 1st of the vacation year. (f) The Company will provide five (5) weeks of vacation with pay equal to ten percent (10%) of the years wages provided the employee has twenty (20) years of continuous service with the company as of July 1st of the vacation year. (g) Employees who work less than 1200 hours during the twelve (12) month period prior to July 1st of the vacation year shall only be entitled to time off in keeping with the provisions of the Employment Standards Act. (h) All vacation pay computations will be based on gross earnings for hours worked and lunch time paid inclusive of vacation pay previously paid. (i) The Company will pay vacation pay on the Thursday prior to the plant vacation period, but further agrees to hold vacation pay to the week(s) of vacation, if the employee(s) requests. (j) Operating conditions permitting, employees may be allowed to take pay in lieu of vacation time off for the third and/or fourth week of vacation.

Provided the employee has worked at least twelve hundred hours (1200hrs) during the year, he shall receive as vacation pay four weeks pay at his straight time rate of pay, if this is greater than the 8% vacation pay. a) Employees who have eighteen (18) years of service as of June 30th in any year shall receive a vacation of five (5) weeks and shall be paid vacation pay at the rate of ten percent (10%) of their previous years total earnings. Provided the employee has worked at least twelve hundred hours (1200hrs) during the year, he shall receive as vacation pay five weeks pay at his straight time rate of pay, if this is greater than the 10% vacation pay. b) Employees who have twenty-eight (28) years of service as of June 30th in any year shall receive a vacation of six (6) weeks and shall be paid vacation pay at the rate of twelve percent (12%) of their previous years total earnings.   • Vacation Entitlement i) A transferring employee will accrue vacation in accordance with the collective agreement of the designated employer. ii) A transferring employee will have pre-approved vacation requests honoured. iii) Vacation entitlement not used by the employee at the time of transfer shall transfer with the employee to the designated employer, if applicable. iv) Vacation scheduling will be in accordance with the applicable collective agreement and the practice of the designated employer.

  • Vacation Pay Paid Union leaves. All other payments, premiums, allowances etc. are excluded.

  • VACATION AND VACATION PAY 9.01 All employees who are covered under this Agreement shall receive as vacation pay ten percent (10%) of the employee's total earnings exclusive of each Employer's contribution to the Union's Benefit Plan. Income tax shall be deducted weekly from the employee's earnings increased by the amount of vacation pay. 9.02 Vacation periods shall be arranged by mutual agreement between each Employer and each employee. Employees shall be granted their vacation periods as requested insofar as it is practicable and in accordance with years of employment, unless an Employer decides to grant all vacations at one time, in which case that Employer shall give the employees at least six (6) weeks advance notice. 9.03 Each Employer agrees to remit the Vacation Pay of each employee as agreed upon in Article 9.01 of this Agreement and in accordance with the regulation set by the Employment Standards Branch, Ministry of Labour, monthly before, but not later than the fifteenth of the following month to the Union using a separate cheque marked "Vacation Pay", accompanied by a list on which all deductions and contributions as mentioned in Articles 6.01, 12.02, 17.01, 18.01 and Schedule "A" are recorded. 9.04 In accordance with the agreement with the Employment Standards Branch, Ministry of Labour, the Board of Trustees of the Union's Vacation Pay Trust Fund, is obligated to take any steps which may be available to them either in law or in equity or in bankruptcy as may be necessary or desirable to effect collection from delinquent Employers. All costs incurred in the collection of said payment will be charged to such defaulting Employer. 9.05 Each Employer agrees to give the auditor of the Union's Trust Fund the privilege to examine that Employer's records concerning hours and monies forwarded to the Union, if and when the auditor so desires. Any date for such an examination will be pre-arranged in writing between the auditor, that Employer and the Union.

  • Vacation Payout Where an employee requests in writing to have a specific number of vacation days paid out, and the Employer agrees to the request, the Employer will issue pay in lieu of vacation. Pay in lieu of vacation, if agreed, will be granted only after a minimum of 15 days' vacation time has already been taken in the year.

  • Entitlement to Vacation Leave With Pay An employee is entitled to vacation leave with pay to the extent of his earned credits but an employee who has completed six (6) months of continuous employment may receive an advance of credits equivalent to the anticipated credits for the vacation year.

  • Benefit Entitlement When an employee is on a WCB claim all benefits of the Agreement will continue to accrue. However, an employee off work on WCB claim shall receive net wages as defined by (A) above, and benefits equalling but not to exceed their normal entitlement had they not suffered a compensable injury. For the first twenty (20) work days on claim, an employee will accrue paid holidays and vacation credits. Once the claim exceeds twenty (20) work days, paid holidays and vacation credits will not accrue. However, unused vacation credits accrued prior to the claim shall not be lost as a result of this clause.

  • Vacation Benefits During the Term, the Executive shall be eligible for 20 vacation days annually, which shall be accrued and used in accordance with the applicable policies of the Company. During the Term, the Executive shall be eligible to participate in such medical, dental and life insurance, retirement and other plans as the Company may have or establish from time to time on terms and conditions applicable to other senior executives of the Company generally. The foregoing, however, shall not be construed to require the Company to establish any such plans or to prevent the modification or termination of such plans once established.

  • Annual Vacation Entitlement (a) An Employee shall be entitled to receive annual vacation leave with pay: (i) each year during her first forty-eight (48) months of service at the rate of one and one-quarter (1 1/4) days for each month of service; and (ii) each year after forty-eight (48) months of service at the rate of one and two-thirds (1 2/3) days for each month of service; and (iii) each year after one hundred and sixty-eight (168) months of service at the rate of two and one-twelfth (2-1/12) days for each month of service; and (iv) each year after two hundred and eighty-eight (288) months of service at the rate of two and one half (2 ½) days for each month of service. (b) An Employee who, as of February 19, 2001, has earned entitlement to more vacation than provided for in Article 17.01(a) of the collective agreement by virtue of her terms and conditions of employment with a predecessor employer shall retain that entitlement. Any future increase in vacation entitlement for such Employees shall be pursuant to Article 17.01(a).

  • Part-time Vacation Pay If the Employer currently has the computer systems’ capability to implement bi- weekly vacation pay, they shall do so by the start of the next vacation year or earlier. Those Employers with no computer capability will endeavour to implement bi- weekly vacation pay if there is no significant administrative burden, by the start of the next vacation year or earlier. If the Employer does not so implement, it will provide reasons in writing to the Union. Where possible without extensive programming changes, the amount of vacation pay will be separately identified on the pay stub.
