VACATION AND VACATION PAY a. Vacation and vacation pay shall be based upon the employee’s years of service, as of July 1st of the current year in accordance with the following schedule: 0 – 5 years 2 weeks 10% 5 years to 10 years 3 weeks 10% 10 years to 15 years 4 weeks 11% 15 years to 20 years 4 weeks 12% 20 years or more 5 weeks 13% b. Vacation pay is the indicated percentage of an employee’s total earnings. An employee’s total earnings is, for the purpose of calculating vacation pay, exclusive of Employer’s contributions to the Union’s Benefit Plan. Income tax shall be deducted bi-weekly from the employee’s earnings increased by the amount of vacation pay. a. A blank schedule will be posted each January 1st and all employees will have until February 28th each year to provide the Employer in writing with up to two (2) weeks of their vacation time. The Employer shall post an approved vacation schedule no later than March 10th. Any conflict with regard to too many requests for the same time off shall be decided on the basis of seniority. b. After March 10th, any employee with more than two (2) weeks’ vacation entitlement shall have until March 20th to provide a written request to the Employer for the remainder of their vacation entitlement. Any conflict will be decided by seniority. c. Requests received after either March 10th or March 20th, as the case may be, will be treated on a “first come, first served” basis. d. If an employee fails to provide, or decides to change their vacation dates after March 20th, a minimum of three (3) weeks’ written notice must be given to the Employer. e. If a statutory holiday as listed under Article 10.01 falls during an employee’s vacation time, the employee will have the option to take the holiday at the end of the vacation period. This must be scheduled when the employee schedules their vacation time. f. The Union and the Employer understand and agree that any one (1) employee may be limited to taking two (2) consecutive weeks of vacation time off. 9.03 The Employer agrees to remit the Vacation Pay of each employee, as agreed upon in 9.01 of this Agreement and in accordance with the regulation set by the Employment Standards Branch, Ministry of Labour, monthly before but not later than the fifteenth of the following month to the Union using a separate cheque marked "Vacation Pay" accompanied by a list on which all deductions and contributions as mentioned in 6.01, 12.02, and Schedule “A” are recorded. 9.04 In accordance with the agreement with t...

VACATION AND VACATION PAY. 9.01 All employees who are covered under this Agreement shall receive as vacation pay ten percent (10%) of the employee's total earnings exclusive of each Employer's contribution to the Union's Benefit Plan. Income tax shall be deducted weekly from the employee's earnings increased by the amount of vacation pay. 9.02 Vacation periods shall be arranged by mutual agreement between each Employer and each employee. Employees shall be granted their vacation periods as requested insofar as it is practicable and in accordance with years of employment, unless an Employer decides to grant all vacations at one time, in which case that Employer shall give the employees at least six (6) weeks advance notice. 9.03 Each Employer agrees to remit the Vacation Pay of each employee as agreed upon in Article 9.01 of this Agreement and in accordance with the regulation set by the Employment Standards Branch, Ministry of Labour, monthly before, but not later than the fifteenth of the following month to the Union using a separate cheque marked "Vacation Pay", accompanied by a list on which all deductions and contributions as mentioned in Articles 6.01, 12.02, 17.01, 18.01 and Schedule "A" are recorded. 9.04 In accordance with the agreement with the Employment Standards Branch, Ministry of Labour, the Board of Trustees of the Union's Vacation Pay Trust Fund, is obligated to take any steps which may be available to them either in law or in equity or in bankruptcy as may be necessary or desirable to effect collection from delinquent Employers. All costs incurred in the collection of said payment will be charged to such defaulting Employer. 9.05 Each Employer agrees to give the auditor of the Union's Trust Fund the privilege to examine that Employer's records concerning hours and monies forwarded to the Union, if and when the auditor so desires. Any date for such an examination will be pre-arranged in writing between the auditor, that Employer and the Union.
VACATION AND VACATION PAY. 9:01 The Employer agrees that Vacation Pay shall be six (6%) percent of gross earnings. 9:02 The Vacation Pay shall be paid every pay period or upon termination of employment, whichever is sooner. 9:03 Each employee shall be entitled to four (4) weeks annual vacation to be taken at a time mutually agreed upon by the Employer and the employee. The Employer may require sufficient notice for scheduling purposes. In addition, written approval confirming the employeesvacation schedule shall be provided upon request of the employee.

VACATION AND VACATION PAY. 18.01 An employee shall receive an annual vacation in accordance with the length of employment with the Employer. All vacations must be taken by the end of the vacation year and cannot be accumulated from one vacation year to the next unless agreed to by the parties in writing. Any unused vacation monies shall be paid out at the end of the vacation year. The vacation year shall be from May 1st to April 30th of the following year. Employees shall be permitted to take one (1) week (For employees with 4 weeks or more of vacation - two (2) weeks) of their vacation in separate days. 18.02 The Employer will post a notice by January 15th of each year giving employees until March 1st an opportunity to indicate their preference for vacation. The Employer will endeavour to accommodate employees' preferred vacation periods by order of seniority. The Employer reserves the right to make final approval of the vacation schedule. The approved vacation schedule will be posted by March 15th. After the March 1st date the Employer will consider vacation requests, on a first come, first served basis. Such requests shall be submitted two (2) weeks prior to the posting of the work schedule. Approved or denied requests will be returned to the employee within 48 hours not including weekend and statutory holidays. 18.03 Vacation pay shall be paid on the employees regular pay day for the vacation period scheduled. 18.04 Employees shall be granted vacation with pay according to the following schedule: Less than one (1) year 4% of gross earnings for the period worked; Time off at the rate of one (1) day per month to a maximum of ten (10) days.
