Voluntary Leave. A. A tenure teacher may be allowed to take an unpaid voluntary leave for a period not to exceed one (1) year without loss or gain in seniority. Such leave must be in accordance with Article 7-Reduction in Staff. B. The Board agrees to provide for unpaid voluntary leave with the stipulation that there be no financial obligation as related to salary or fringe benefits while such person is on leave and provided that a certified and qualified replacement is available to insure that the quality of student instruction would not be diminished. C. It is agreed that the teacher may continue his/her insurance coverages during the leave by paying premiums to the District in accordance with the District’s policies and time lines, to the extent permitted by the respective carriers. Voluntary Leave. The following voluntary leave of absence provisions shall be made available to all temporary and permanent Local 79 employees on the following basis:
Voluntary Leave. A leave of absence for up to one school year without pay and benefits may be granted solely at the discretion of the employer to a teacher provided the teacher properly requests such leave in writing to the Superintendent at least sixty-five (65) calendar days prior to the requested start of leave. Such request shall include the exact dates requested for the starting and ending of the leave. Any leave granted will be conditioned on the School Corporation obtaining a replacement teacher that the School Corporation determines is properly licensed and sufficiently qualified to replace the teacher in all duties of the teacher. In the event the School Corporation fails to obtain such replacement by thirty (30) calendar days prior to the requested start of said leave, the teacher shall be required to return to his or her position and forego any such requested leave. Any unemployment compensation the School Corporation may have credited to its experience account or be required to pay to any such replacement teacher upon the return of a teacher from leave shall be reimbursed to the School Corporation by the teacher to whom such leave was granted. Such reimbursement shall occur within fifteen (15) days after distribution of each unemployment check to said teacher. Voluntary leaves will not be granted to teachers who while on leave will receive compensation for work performed excepting work as part of a professional development project, a university work study program, or in the best interests of the School Corporation.

Voluntary Leave. 1. The Board shall grant a voluntary leave of absence, upon request, to an administrator without pay or fringe benefits, for a purpose(s) not enumerated in this Agreement. Administrators may take a one (1) semester or one (1) year leave under this provision providing a certified replacement can be obtained. 2. The administrator who has placed his seniority in escrow may continue all fringe benefits by reimbursing the district at the group rate. 3. Any administrator who has been granted three (3) consecutive years, or six (6) consecutive semesters leave under this provision shall return to employment status or be terminated. 4. These provisions shall apply to any administrator on employment status, leave status or layoff status. 5. The provisions of ARTICLE X, Section K, subsection 1 are not applicable to this Section. 6. An Administrator returning from leave under this article shall be placed in an administrative position for which he/she is qualified and certified at the discretion of the Superintendent. 7. An administrator applying for an initial voluntary leave shall provide such written request to the Personnel Department not later than June 1 of the school year preceding for a full school year leave, and not later than December 1 preceding for a second semester leave. Request for voluntary leave extensions shall be considered only for full school years and such request must be provided in writing to the Personnel Department not later than June 1 of the preceding school year. Leaves may be granted beyond these deadlines with the concurrence of the Superintendent and the association president.
Voluntary Leave a. A Teacher (or Teachers) with greater seniority than those selected for lay-off may request a one-year unpaid leave of absence, provided such a leave will result in the prevention of a District Teacher being laid off or the immediate re-hiring of a District Teacher already on lay-off. Voluntary leaves shall be granted or not granted, at the sole discretion of the Board. The Board's decisions are final and non- grievable. b. Such a request shall be in writing and shall be for the duration of a full school year. Generally it shall be submitted to the Board prior to May 1 of the calendar year in which the leave is to begin. One-year renewals may be requested in writing. Such leaves and renewals will be at the discretion of the Board. c. Any Teacher on voluntary leave shall be given credit for service to the District on the seniority list during the duration of the leave. d. A Teacher returning from voluntary leave shall be reassigned to the position held prior to the leave, provided such a position still exists. If the Teacher's position no longer exists then reassignment shall be to a similar position for which he/she is certified and qualified. e. Voluntary leaves may be canceled by mutual consent of the Board and the affected Teacher. f. A Teacher on voluntary leave shall receive full benefits outlined in Article XVIII.

Voluntary Leave of Absence - When the requirements of the Company permit, an employee upon written request through his immediate supervisor may be granted a voluntary leave of absence without pay for a period exceeding fourteen (14) consecutive calendar days but not exceeding six (6) months. Time off requests for less than (14) consecutive calendar days will be handled in accordance with article 7.05. 11.01.01 The granting of leave is at the sole discretion of the Company, however, requests will be considered in order of seniority among those on hand at the time of granting. 11.01.02 The Company will indicate its approval of the leave in writing, including the commencement and termination dates, preferably fourteen (14) or more calendar days prior to the requested commencement date of the leave. Once approved, a leave may not be cancelled except by mutual agreement between the employee and the Company. 11.01.03 If the employee wishes to return to work prior to the approved termination of the leave, the employee will make the request in writing to his/her immediate Manager. The Company may authorize a return to work on the date requested or another day mutually acceptable to both the Company and employee, or the Company may deny the request.
Voluntary Leave. (1) A tenured unit member shall be eligible for a voluntary leave of absence for a period of one school year without pay or benefits if he/she notifies the Human Resources Office in writing by April 1st preceding the school year desired for leave of the intention to take leave. In addition, a tenured unit member may be granted a voluntary leave of absence after April 1 for a period of one school year without pay or benefits with the approval of the Superintendent. (2) Upon conclusion of said leave, the unit member shall be entitled to reemployment in the school he/she left if a vacancy is available or in another school in a position for which he/she is certified. (3) However, to be entitled as in 2 above, said unit member shall notify the Human Resources Office in writing by February 1st of the year prior to expected return of intention to return. If notification is not received by said date, said unit member loses entitlement to reemployment.
Voluntary Leave. 26.7.1 Permanent bargaining unit members, with ninety (90) calendar days prior notice to the Human Resources Office, may request a leave of absence without compensation. The unit member shall specify the reason for the request unless to do so would cause the divulging of personal information of the kind that would normally be considered confidential. Approval or denial of such requests is at the sole discretion of the Board of Education. 26.7.2 For bargaining unit members on leave as of January 1 through the remainder of the school year: (a) By January 5, the District shall notify bargaining unit members by US Mail of their duty to state their intent to return or not to return for the succeeding school year, (b) By February 5, the bargaining unit member shall respond by written communication, (c) Failure to notify the District by February 5 of the bargaining unit member’s intent to return is notice that the bargaining unit member will not be returning, that position is then vacant, and as of February 5 the bargaining unit member is deemed to have resigned irrevocably as of June 30. Bargaining unit members may apply for an extension at least thirty (30) calendar days prior to the end of first leave. Extension of voluntary leave shall be at the discretion of the Board and only granted for extraordinary circumstances. 26.7.3 Upon returning from a voluntary leave, the bargaining unit member shall follow Appendix I, “Order of Eligibility for Vacancies in Positions Represented by the LEA Bargaining Unit.” 26.7.4 Bargaining unit members may not be employed in public education while on leave. 26.7.5 A bargaining unit member may suspend the leave in an emergency situation and apply for available positions, including substitute positions, for the duration of the original leave.
