ABSENCE AND LEAVE. SECTION 1. This article applies to employees covered under the CMLA as described by the Federal Labor Relations Authority (FLRA).

ABSENCE AND LEAVE. During the Term, Executive shall be entitled to the same paid absence (whether for vacation, sick leave or personal time) and continuous service leave benefits and on the same terms and conditions, as generally apply to executive employees of the Company.
ABSENCE AND LEAVE a. An employee will not receive credit for annual or sick leave accruals during any pay period in which he/she accumulates 80 hours of LWOP (furlough time). b. When an emergency furlough is required, employees on approved annual leave on the effective date of the furlough will have their annual leave canceled and they will be permitted to remain absent from work for the duration of the furlough. 1. Upon expiration of the furlough, employees who were on approved annual leave that did not extend beyond the end of the furlough will report for duty. 2. Employees who have had annual leave canceled due to a furlough will be given every opportunity to reschedule that leave. 3. Employees who have had annual leave canceled or who were prevented from taking scheduled annual leave due to a furlough, and who make reasonable efforts to reschedule their leave and are denied an opportunity to take use or lose leave by the Employer, are entitled to request restoration of any excess leave under exigency of the public service leave regulations. If regulatory requirements are met, the Employer will grant requests under these circumstances. c. When an emergency furlough is required, employees on approved sick leave on the effective date of the furlough will have their sick leave canceled and they will remain absent from work for the duration of the furlough. 1. Upon expiration of the furlough, employees who were on approved sick leave that did not extend beyond the end of the furlough will report to duty unless their medical status precludes them from doing so. 2. If an employee’s medical status precludes him/her from reporting to work upon the expiration of the furlough, the employee must request sick leave in accordance with applicable procedures. d. Employees may not use any type of paid leave on scheduled furlough days. x. Xxxxxxxx days do not count against Family Medical Leave absences and entitlements. f. Employees in continuation of pay (COP) status will remain in COP status in accordance with Department of Labor regulations during a period of furlough.

If an employee is unable to use the employee’s scheduled “use or loseannual leave due to furlough, and if they are unable to reschedule it during the rest of the year, the leave will be carried over into the next leave year, when permitted by regulation. E. In accordance with Department of Labor regulations, employees in continua- tion of pay (COP) status will remain in such status for the length of the furlough. F. When an emergency furlough is required, employees on approved annual or sick leave on the effective date of the furlough will have the employee’s leave canceled and will be permitted to remain absent from work for the duration of the furlough. Upon the furlough’s expiration, employees who were on approved leave that did not extend beyond the end of the furlough will be required to report back to duty. Employees who have had the employee’s annual leave canceled because of the fur- lough will be given every opportunity to reschedule that leave.

Teachers needing to be absent for reasons set forth in this Article shall notify their principal or designee and specify the category and length of the leave in order that a substitute may be obtained. b. A teacher returning from a leave of absence in excess of six (6) months is not guaranteed a return to his/her former position unless required by law. The teacher is guaranteed a position if an open position for which the teacher is qualified exists. c. Teachers shall not have any leave days deducted when school is closed by the Superintendent, the School Board, or a governmental entity. d. All leave must be taken in four- or eight-hour increments. e. Any teacher who is absent from school under a paid absence category of this contract shall not lose pay for hours from the paid category involved if the school(s) is/are closed by the Board, the Superintendent, or a governmental entity and as long as a substitute was not paid for the day.

ABSENCE AND LEAVE. A full-time employee who is relieved or prevented from working on a day designated as a holiday is entitled to pay with respect to that day for 10 hours. When an employee has 3 consecutive non-workdays off and the holiday falls on one of these non-workdays, the following rules will apply in designating the workday as the "in lieu of" holiday: (1) When the holiday falls on a Sunday, and is officially observed on Monday and that Monday is the employee's scheduled compressed day off, the employee will receive Tuesday as their “in-lieu of” holiday. (2) When the holiday falls on a Monday, an employee with a Monday compressed day off would have the preceding Friday off as their “in-lieu of” holiday. (3) When a holiday falls on a Friday, and the employee with a compressed day off as Friday, would receive the preceding Thursday as their “in- lieu of” holiday. (4) When a holiday falls on a Saturday, and is observed on a Friday, an employee with a Friday compressed day off would have the preceding Thursday off as their “in-lieu of” holiday. (5) Time off during an employee's basic work requirement must be charged to the appropriate leave category unless the employee is authorized compensatory time off or an excused absence. For example, a full-time employee who takes one day of annual leave will be charged 10 hours. This results in 40 hours of annual leave for an entire workweek similar to a full-time employee on a normal 8-hour/5-day tour of duty.
