Construction Observation Services. (hereinafter the "Services"). City hereby contracts with Consulting Engineer/Architect for the furnishing of Services in connection with the Project. The Services are more particularly described in Exhibit A, attached hereto and incorporated by reference herein. By executing this Agreement, the Consulting Engineer/Architect represents to City that Consulting Engineer/Architect is professionally qualified to provide these Services for this Project and is licensed to practice engineering/architecture by all public entities having jurisdiction over Consulting Engineer/Architect and the Project.
Construction Observation Services. 1. The CONTRACTOR shall attend the preconstruction conference scheduled by the COUNTY.
2. When requested by the COUNTY, the CONTRACTOR shall attend meetings with county, federal, state and/ or local representatives. The CONTRACTOR shall prepare brief minutes of all meetings attended and submit those minutes to the COUNTY within seven

Provide construction observation services by one (1) staff member to observe work in progress in an effort to verify that work performed by contractors is in accordance with contract documents. 240 hours of construction observation time is included, with an approximate breakdown as follows:
2. Eight (8) road locations, 30 hours per road, schedule to be determined, during 60-day installation period = 240 hours.
3. Pre-Construction Meeting, Substantial & Final Completion, Project Closeout - 20 hours.
4. When on-site, our construction observer will seek to determine that construction work is carried out in compliance with the contract drawings and specifications. The purpose of the construction observation services is to provide the Client with a greater degree of confidence that the contractor's work generally conforms to requirements of the contract documents and that the integrity of the design concept illustrated by the contract documents has been implemented and preserved by the contractor(s).
5. Xxxxxxx & Associates shall not, on the basis of its observations of the contractors' work or its presence at project site, supervise, direct, or have any control over the contractors' work nor shall Xxxxxxx & Associates have authority over, or responsibility for, the means, methods, techniques, sequences, or procedures of construction selected by the contractors, for safety precautions and programs incidental to the work, or for the contractors' compliance with laws, rules, regulations, ordinances, codes, or other orders applicable to the contractors furnishing and performing their work. Accordingly, Xxxxxxx & Associates can neither guarantee performance of construction contracts by the contractors nor assume responsibility for the contractors' failure to furnish and perform work in accordance with contract documents.
Construction Observation Services. 1. Observation of the construction in progress as required.
2. Observation of the testing required by the specifications, and any re-testing which may be necessary.
3. Final review of the complete sewer main extension and preparation of a report setting forth any deficiencies that may exist.
4. Review of deficient work as corrected and final two-year review.
5. Final review of the completed sewer extension and examination of require documents to assure that the District has legal title to the necessary easements and/or rights-of-way, review and approval of the Developer's warranty and bill of sale and preparation of a final recommendation of acceptance of the sewer system by the Water District. The fee for Construction Observation Services shall be on an actual time and expense basis. An estimated deposit shall be made to cover the actual time and expense cost of providing Construction Observation Services. for Construction Observation Services, if required. Additional charges or credits will be made depending on the final costs of the additional services provided.
Construction Observation Services. 1. The CONSULTANT will familiarize the construction documents (plans, specifications, easements, schedule, etc.) and visit and familiarize themselves with the project site prior to the pre-construction meeting.

c. The CONSULTANT will prepare for and attend weekly construction progress meetings.
d. The CONSULTANT will review and recommend Contractor’s schedule of values and pay applications.
e. The CONSULTANT will maintain a daily diary of the project activities, and submit daily reports using the City’s Report Form
f. The CONSULTANT will measure, record, and document project quantities.
g. The CONSULTANT will maintain and provide project photos documenting the daily construction progress and project site conditions.
h. The CONSULTANT will coordinate materials testing, document the results, and take necessary actions when needed.
i. The CONSULTANT will provide oversight of erosion control measures for compliance with plans and specifications.
j. The CONSULTANT will maintain and deliver a set of red-lined construction drawings
k. The CONSUTANT will perform customary services for daily field observation (including but not limited to: RFIs, change orders, communication with Owner, Contractor, and residents)
l. The CONSULTANT will submit inspection reports to the City weekly.
4. The duration of the project will be approximately 18 months. There will be occasions during that time for the CONSULTANT’s Construction Inspector to have time off (vacation time, sick time, etc.) and the CONSULTANT’s Construction Inspection Manager will fill in during those days.
5. The CONSULTANT’s Construction Inspection Manager will regularly visit the project site to be knowledgeable about the project, for QA/QC review of the inspection procedures, and attend weekly construction progress meetings.
6. The CONSULTANT will complete a substantial completion inspection and punch list.
7. The CONSULTANT will complete a final completion inspection and punch list. All additional work requested by the CLIENT will be billed on an hourly basis according to the rate schedule attached or a negotiated lump sum...
Construction Observation Services. 1. The Golf Course Designer shall assist the Owner by making periodic visits to the site of the Project to familiarize himself generally with the progress and quality of work to determine in general if the Project is proceeding in accordance with the Contract Documents. On the basis of his on-site observations, he shall endeavor to identify defects and deficiencies in the work of the contractor. However, the Golf Course Designer shall not be responsible for construction means, methods, techniques, sequences or procedures, or for safety precautions and programs in connections with the Work, and he shall not be responsible for the Contractor’s failure to carry out the Work in accordance with the Contract Documents. The Golf Course Designer shall not be required to make exhaustive or continuous on-site inspections to check the quality or quantity of the Work. As used herein, the term “Work” shall mean the construction required by the Contract Documents and shall include all labor used in such construction and all materials, equipment and course accessories incorporated or to be incorporated into such construction.

Construction Observation Services. 2.1 Observation of the Work. The CONSULTANT shall inspect the Work of the Contractor whenever or wherever appropriate including any final inspection required by the Contract Documents. The purpose of such inspections shall be to determine the quality, quantity, and progress of the Work in comparison with the requirements of the Contract for Construction. In making such inspections, the CONSULTANT shall identify defects or deficiencies in the Work. Following each such inspection the CONSULTANT shall submit a written report of such inspection (in electronic and hardcopy format), together with any appropriate comments or recommendations, to the CITY. The CONSULTANT shall provide periodic photographs of the work and a copy of the inspection reports in a project notebook to be delivered to the City monthly. Furthermore, the CONSULTANT shall require and review all tests required by the Contract Documents and shall report in writing to the CITY the results thereof; A part-time inspector and periodic site visits by the Engineer of Record (EOR) is budgeted for project construction duration.
2.1.1 The CONSULTANT shall provide the part-time construction observation services and provide services to observe key activities of the Contractor, and reporting during the periods the CONSULTANT is on-site. When on-site, the CONSULTANT shall observe the work and shall keep the CITY fully informed of the progress and quality of the work. The CONSULTANT shall not, absent written approval from the Contractor, communicate with the Contractor's subcontractors. The CONSULTANT shall record the receipt of all shop drawings, submittals, and samples as well as any action taken in connection with same by the CONSULTANT or the Contractor. The CONSULTANT shall, when on-site, provide immediate written notification to the Contractor in the event the Contractor commences any work without necessary shop drawings, submittals or samples having first been submitted to the CONSULTANT. The CONSULTANT shall record in writing, and immediately report to the CITY, any defective, deficient, faulty, or unsatisfactory work performed by the Contractor. The CONSULTANT shall witness and verify all tests required by the Contract Documents as well as the removal of equipment and systems by the Contractor. The CONSULTANT shall maintain detailed records relating to any such tests. Construction Observation Services. A. Where such services are included, K&W will observe the work of the contractor at intervals agreed to in writing between K&W and Client to determine and report to client whether the work of the contractor is proceeding in such a way that when completed, it will be in general compliance with such drawings and specifications. Such observations shall be limited to those specific aspects of work which are identified in the written agreement. K&W’s Observation Services do not include exhaustive or on-site inspection of the work of the contractor nor any supervision or direction of work of any contractor or subcontractor, or their respective employees, agents or servants. K&W will not be responsible for any contractor’s or subcontractor’s compliance with the provisions of any contract nor for the observation or supervision of any contactor’s or subcontractor’s use of personnel, machinery or equipment. Under no circumstances shall K&W have control over, be in charge of, or be responsible for construction means, methods, techniques, sequences or procedures in connection with the work, or for the contractor(s)’s safety programs or procedures at the site.
Construction Observation Services. If Consultant’s construction observation services are included as part of the scope of services in the Agreement, Consultant will provide personnel to observe construction to ascertain that when completed the work being performed, will generally be in accordance with the design work performed by Consultant. However, such activity shall not be deemed to be create a supervisory role or deemed the provision of Consultant’s opinion on the suitability of any part of the work performed, nor approval of the means and methods, such being the sole province of the contractor. . Consultant’s sole duty shall be to report observed deviations from plans and specification to the client. Consultant’s services do not make Consultant a guarantor of any work by contractor or any subcontractors/consultants (collectively and individually herein “Contractor”), and such Contractor(s) will continue to be responsible for the accuracy and adequacy of all construction or other activities performed by them. The Contractor(s) will be solely responsible for the means and methods of construction, supervision of personnel and construction, control of machinery, falsework, scaffolding and/or other temporary construction aids, safety in or about the job site, and compliance with OSHA and other applicable laws and regulations.
