Delegates Rights. (a) The company recognises the role of elected union delegates within the enterprise. The employer will treat delegates fairly and to allow them to perform their role as union delegate without any discrimination in their employment. The employer recognises and respects that endorsed union delegates speak on behalf of union members in the workplace.
(b) A union delegate shall have the right to:
(i) discuss work-related matters of concern of any employee or to convey information relating to the workplace to employees during working hours.
(ii) paid time to attend industrial tribunals and/or courts where they have been requested to do so by an Employee (which may include themselves) whom they represent in a particular dispute in their workplace;
(iii) paid time to assist and represent Employees who have requested them to represent them in respect of a dispute arising in their workplace, including by preparing, attending and participating in dispute resolution proceedings and collective bargaining meetings and proceedings;
(iv) represent an employee when requested in relation to a grievance, dispute or a discussion with a member of the Union;
(v) represent the interests of members in their workplace to the Union, Employer and industrial tribunals/courts; and
(vi) place notices on notice boards within the enterprise. Such notices shall be within the policy of and authorised by the Union.
(c) The union delegate will not unduly interfere with the work in progress and the supervisor of the shift or section will be informed of the union delegate’s intention
(d) The union delegate shall have access to a telephone, fax and email to contact the union office or to progress enquiries on behalf of a member on work-related matters. The union delegate shall be provided with a suitable lockable cupboard or filing cabinet and facilities to enable the union delegate to keep records, union circulars and documentation to efficiently carry out union responsibilities.
(e) The employer shall not dismiss or injure a union delegate in employment or alter the employee’s position to the employee’s prejudice because the employee is a union delegate.
(f) The employer shall supply the union delegate with a copy of this agreement and of the Award and with all subsequent variations and will post such agreement or award on the notice board.

Delegates Rights. Union delegates play an important and legitimate role in the workplace. This includes representing their members and supporting Employee access to union officials, and providing Employee views to the agency. 507. The role of union delegates is to be respected and supported.
Delegates Rights. (i) The company shall recognise TWU delegates and shall ensure that TWU Delegates have the following rights: The right to be treated fairly and to perform their role as Union Delegate or workplace Representative without any discrimination in their engagement. The right to formal recognition by the company that endorsed Union Representatives speak on behalf of Union members in the workplace. The right to bargain collectively on behalf of those they represent. The right to consultation, and access to information about the workplace and the business. The right to paid time to represent the interests of members to the company and to attend industrial tribunals. The right to paid time during normal working hours to consult with Union members. The right to paid time off to participate in the operation of the union. The right to paid time off to attend accredited Union education and training. The right to address new transport workers about the benefits of Union membership at the time that they commence work with the company. The right to discuss Union and workplace matters with all transport workers at the workplace. The right to access to a telephone, facsimile, photocopying, internet and email and office facilities for the purpose of carrying out work as a delegate and consulting with workplace colleagues and the Union. The right to place Union information on a notice board in a prominent location in the workplace. The right to up to 3 months paid time off to work with the Union.
(ii) The company acknowledges, and will in no way hinder, the following functions of TWU delegates: To provide awareness and understanding of the Union’s aims and achievements whenever possible. To know the profile of Union members in the workplace. To recruit and involve transport workers in the workplace in the Union and its activities. To be approachable and helpful to Union members in the workplace. To seek out and encourage other Union members to take on roles and responsibilities. To provide up to date and relevant Union information to Union members in the workplace To regularly undergo Union education and training. To represent the views of the members. To represent Union members fairly and accurately in negotiations and in relation to individual grievances. To keep in regular contact with the Union Organiser and other Union Representatives in the workplace.
Delegates Rights. 50.1. The Company agrees to recognise the following Workplace Delegates’ Rights in addition to those set out under section 350c of the Act and any relevant provisions contained in the Award as varied from time to time:
(a) The right to be treated fairly and to perform their role as union Delegate without discrimination in their employment;

The right to be treated fairly and to perform their role as union delegate without any discrimination in their employment; The right to formal recognition by the employer that endorsed union delegates speak on behalf of union members in the workplace; The right to bargain collectively on behalf of those they represent; The right to consultation and access to reasonable information about the workplace and the business; The right to paid time to represent the interests of members to the employer and industrial tribunals; The right to reasonable paid time during normal working hours to consult with union members; The right to reasonable paid time off to participate in the operation of the union; The right to reasonable paid time off to attend accredited union education; The right to address new employees about the benefits of union membership at the time that they enter employment; The right to reasonable access to telephone, facsimile, photocopying, internet and E-mail facilities for the purpose of carrying out work as a delegate and consulting with workplace colleagues and the union; The right to place union information on a notice board in a prominent location in the workplace; The right to take reasonable leave to work with the union. These rights are basic and fair. Union delegates are entitled to know their role is recognised and respected.
Delegates Rights. (1) Union delegates play an important and legitimate role in the workplace. This includes representing their members and supporting employee access to union officials, and providing employee views to Austrade.
(2) The role of union delegates is to be respected and supported.
(3) Austrade and union delegates will work together respectfully and collaboratively.
(4) Austrade respects the role of union delegates to:
(a) provide information, consult with and seek feedback from employees in the workplace on workplace matters;
(b) consult with other delegates and union officials, and get advice and assistance from union officials;
(c) represent the interests of members to the employer and industrial tribunals; and
(d) represent members at relevant union forums, consultative committees or bargaining.
(5) Austrade and union delegates recognise that undertaking the role of a union delegate is not the primary purpose of an employee’s engagement, and must work with and not unreasonably impact their regular duties. Honorary officials may request additional time and facilities from time to time.
(6) Union delegates will be provided with reasonable paid time during their normal working hours to perform their union delegate role. The paid time provided should not result in disruption to critical services or operational requirements.
(7) To support the role of union delegates, Austrade will, subject to legislative and operational requirements, including privacy and security requirements:
(a) provide union delegates with reasonable access to Austrade facilities and resources, including for paid or unpaid meetings between employees and their unions and to communicate with union officials;
(b) advise union delegates and other union officials of the Austrade facilities and resources available for their use, which may include telephone, photocopying, internet, and email;
(c) allow reasonable official union communication appropriate to Austrade from union delegates with employees, including through email, intranet pages and notice boards. This may include providing a link to a union website for employees to access union information. Any assistance in facilitating email communications does not include an agency vetoing reasonable communications;
(d) provide access to new employees as part of induction; and
(e) provide reasonable access to union delegates to attend appropriate paid time training in workplace relations matters, during normal working hours.

Delegates Rights. 1.12.1 For the purposes of this clause (clause 1.12 – Delegate Rights), the following definitions apply:
(a) ‘Union delegate’ is a person appointed or elected, in accordance with the rules of an employee organisation, to be a delegate or representative (however described) for members of the organisation who work in a particular enterprise.
Delegates Rights. Insertion of a new clause to recognise the newly legislated delegates’ rights including the existing provision of a union noticeboard and the union would like to discuss measures to facilitate involvement of delegates and members in specified union meetings.
