Filling Temporary Vacancies. A. The Employer has the option, but is not required, to post a temporary vacancy that is expected to be less than thirty (30) calendar days in length. A temporary vacancy that is expected to be thirty (30) calendar days or longer shall be posted. The posting shall indicate that the vacancy is temporary, and the expected duration of the vacancy.
B. A temporary vacancy that is posted shall be filled by the most senior applicant who, in the opinion of the Director of Transportation, is qualified and capable of adequately performing the assignment. An employee shall be deemed to be “qualified and capable of adequately performing the assignment” for an assignment in the same classification as the employee’s current assignment. [Example: A bus driver will be deemed to be qualified and capable of adequately performing the assignment for all driving positions.] A temporary vacancy that is not required to be posted shall be filled at the Employer’s discretion.
C. If no bargaining unit member bids on a posted temporary vacancy, the temporary vacancy shall be offered to a person on layoff within that classification who is qualified to perform the duties of the temporary position in accordance with the recall provisions in this Agreement. Pay shall be at the lowest step on the salary schedule for that classification.
D. If no bargaining unit member bids on a posted temporary vacancy, and there are no laid off employees who accept the temporary assignment, the vacancy may then be filled through temporary transfers or employment of substitutes or outside temporary workers at the Employer’s discretion.
E. If a bargaining unit member bids on and is assigned to a temporary vacancy, the regular permanent position of that bus driver may be filled through temporary transfer or employment of substitutes or outside temporary workers at the Employer’s discretion, until the conclusion of the temporary assignment, when the driver shall return to his/her regular permanent assignment.
Filling Temporary Vacancies. The Superintendent of Schools or her/his designee shall be responsible for the filling of temporary vacancies due to promotion, discharge, resignation or retirement.
Filling Temporary Vacancies. (a) Whenever a vacancy occurs in any job classification, Company may temporarily fill it by assignment. In making temporary assignments to fill job vacancies, Company shall first consider employees in Relief classifications, and then, when practicable, consider the employees at the headquarters in which the job vacancy exists in the order of their preferential consideration under Section 205.7. The foregoing shall apply whether or not the vacancy is one which must be filled on a regular basis.
(b) If the vacancy cannot be filled as outlined in (a) above, and if there is no next lower classification in the headquarters, and the temporary vacancy is for more than one week, and the Company still desires to fill the temporary vacancy, the senior qualified prebidder within the Bidding Unit residing within a commutable distance (30 miles or 45 minutes road time) from the temporary headquarters shall be offered the vacancy. (Amended 1-1-91)
(c) Except in limited circumstances where the requirement is justified, temporary vacancies shall only be filled by employees who have qualified for such promotion in the same manner as would be required if the employee were to fill the job vacancy on a permanent basis. (Amended 1-1-88)
Filling Temporary Vacancies. 12.1 The parties hereto agree that the hiring of temporary casual employees is a management right, responsibility and discretion.
Filling Temporary Vacancies. In cases where a Civil Service list is not used, temporary vacancies will be offered to permanent exempt employees based upon affirmative action, program needs and seniority. All things being equal, such openings will be offered first to permanent exempts. Permanent exempt employees may accept temporary appointments with longer hours if they are willing to resign from their exempt positions. Upon the request of a former permanent exempt employee who resigned to accept a temporary position, the Student Nutrition Services Department will make every effort to reappoint such an employee to a suitable permanent exempt vacancy.
Filling Temporary Vacancies. The Board will give serious consideration to current employees when filling temporary vacancies or positions subject to the following.
(a) A temporary posting may be filled by a qualified continuing or continuing temporary employee if such temporary vacancy or position is at a higher pay grade or at a higher number of hours than the current employee’s position.
(b) Any employee who has commenced a temporary vacancy or position shall complete that temporary assignment. The employee is eligible to post into another temporary vacancy or position provided it has a commencement date following the completion of the current temporary vacancy or position.
(c) Employees will be able to post into a lateral temporary vacancy or position from a continuing assignment once per school year.
(d) Employees who obtain their first continuing assignment must complete their probation prior to being eligible to apply for a temporary vacancy or position.
(e) An employee may post into a second temporary posting provided the schedule/hours do not conflict with the employee’s current assignment.
Filling Temporary Vacancies. (1) Whenever a vacancy occurs in any job classification, Company may temporarily fill it by assignment. In making temporary assignments to fill job vacancies, other than vacancies in beginner's classifications, Company shall first consider regular full-time employees at the headquarters in which the job vacancy exists in the order of their preferential consideration under Section 18.8. The foregoing shall apply whether or not the vacancy is one which must be filled on a regular basis.
(2) The following guidelines shall be applied in the application of Subsection 18.3(a)(1):
Filling Temporary Vacancies. (a) The University may fill vacant positions or new positions on a temporary basis (six months or less) at its discretion. After six months, all vacancies will be filled through the competitive bid process, unless otherwise agreed to by the parties.
(b) The University may fill vacant or new positions on a temporary basis with Contract Employees. Contract employees shall have no rights under the following Articles of this Agreement: 10 (except 10.11), 11, 12 (except 12.05 (b) – after fifteen (15) months continuous service – and 12.06), 13, 14 (except for those leaves mandated by the Employment Standards Act), 15 (except 15.09), 16.04, 17, 18 (except 18.05), 19, 21 (except 21.03), 22, 23 (except 23.02 and 23.03), and 24.
(c) The University may fill vacant or new positions on a casual basis for up to eight (8) weeks with Casual Employees. Casual employees shall have no rights under the following Articles of this Agreement: 10, 11, 12 (except 12.06), 13, 14 (except for those leaves mandated by the Employment Standards Act), 15, 16 (except for statutory holidays as mandated by the Employment Standards Act), 17, 18, 19, 21 (except 21.03), 22, 23 (except 23.02 and 23.03), 24 and the Letters of Understanding re Christmas Closing.
Filling Temporary Vacancies. (1) Whenever a vacancy occurs in any job classification, Company may temporarily fill it by assignment. In making temporary assignments to fill job vacancies, other than vacancies in beginner's classifications, Company shall first consider regular full-time employees at the headquarters in which the job vacancy exists in the order of their preferential consideration under Section 18.8. The foregoing shall apply whether or not the vacancy is one which must be filled on a regular basis.
(2) The following guidelines shall be applied in the application of Subsection 18.3(a)(1):
i. To the senior qualified 18.8(a) bidder in the department and headquarters of the vacancy; and then (b) bidder in the department and headquarters.
ii. To the senior qualified 18.8(a) bidder in the headquarters of the vacancy; and then
(b) bidder in the headquarters.
Filling Temporary Vacancies. 10.1 The parties hereto agree that the hiring of casual employees is a management right, responsibility and discretion.
10.2 However, the employer agrees that it will not, for the term of this agreement, employ substitute bus drivers for the sole purpose of replacing or displacing employees covered by the terms of this agreement. Substitute bus drivers shall be used to supplement the work force and/or fill vacancies caused as the direct result of employee absence due to extended or job-related injury or illness, and/or allow regular employees to stay at or under forty (40) hours per week.
10.3 In the event of a temporary vacancy of not more than 90 days, a substitute driver may be employed to fill that vacancy. The ninety (90) day limitation may be extended to continue filling the same temporary vacancy, provided, however, the vacancy is the direct result of an employee absence due to an extended illness or work related injury. The employer will notify the Association of the persons involved and the estimated length of the vacancy.
10.4 When the temporary vacancy is closed, the employee affected will return to his/her former position.
