INTERNAL AFFAIRS INVESTIGATIONS. The City will conduct internal affairs investigations of police department personnel as expeditiously as possible. In the event that the investigation takes over sixty (60) calendar days to conclude, the department will provide a status report to the employee.
INTERNAL AFFAIRS INVESTIGATIONS. Section 1: The City hereby recognizes and agrees to the following Florida Statute 112.532(1) also known as the Law Enforcement's Officer's Xxxx of Rights:in instances when
A. The interrogation of any member being investigated for disciplinary violation must be conducted at a reasonable hour and, if possible, during the member's tour of duty.
B. The member under investigation must be informed, in writing, of the charges against the member prior to giving a statement to the investigator.
C. The member under investigation must be informed of the individual (s) in charge of the investigation and of the individual who will be conducting the investigation and/or interrogation. Any interrogation shall be conducted in the Margate Police Station.
D. The length of an interview must be reasonable, with rest periods being called periodically for personal necessities, meals and telephone calls.
E. The member shall neither be threatened with transfer, dismissal, or other disciplinary action as a means of obtaining information nor be subjected to abusive language or promise or reward as inducement for answering questions.
F. The member may have legal counsel and/or a FOP representative present during any interrogation and be granted reasonable periods of private consultation with that legal counsel and/or FOP representative.
A. When such counsel or representationve is not immediately available, the interrogation shall be postponed for not more than forty-eight (48) hours in order to afford the member the opportunity to secure counsel or representation.
G. There shall be no "off the record" questioning. All interrogations must be recorded, with a copy going to the member being investigated. All in conformance with State law.
H. A member shall answer all questions concerning a non-criminal matter that may result in disciplinary action; however, if during the course of an internal investigation or interrogation the member under investigation is suspected of committing a criminal offense, the member shall be advised of the member's rights under the Miranda Decision. The City hereby recognizes that a member has the right to refuse to answer all questions concerning criminal matters.
INTERNAL AFFAIRS INVESTIGATIONS. Investigations regarding alleged employee misconduct will be completed by the Department within a reasonable period of time following the initiation of the investigation. An employee subject to an investigation will be notified by the Department within seven (7) working days of the conclusion of the investigation of the intended action of the Department.
INTERNAL AFFAIRS INVESTIGATIONS. Every attempt will be made to complete internal affairs investigations within one hundred twenty days of the filing of the initial complaint. Employees or their representatives may request the status of their case.
INTERNAL AFFAIRS INVESTIGATIONS. Except when internal affairs investigations are assigned to a person(s) from an outside agency, all investigations shall be conducted by sworn officers of the Menlo Park Police Department, who shall be superior in rank to the officer(s) interviewed (except for sexual harassment investigations which may be conducted by the Personnel Office).
INTERNAL AFFAIRS INVESTIGATIONS.
Section 1. To ensure that internal investigations are conducted in a manner conducive to good order and discipline, while observing and protecting the individual rights of each officer on the force, interviews conducted by the Internal Affairs Division shall be conducted in accordance with the following rules:
(a) The interview of any officer shall be at a reasonable hour, preferably when the officer is on duty or during the daylight hours, unless the exigencies of the investigation dictate otherwise.
(b) The interview shall take place at a location designated by the investigating officer, usually the Internal Affairs Division office.
(c) The officer shall be informed of the rank and name of the officer in charge of the investigation, as well as the rank and name of the interviewing officer and the identity of all persons present during the interview. If an officer is directed to leave the officer's post and report for an interview to another command, the officer's command shall be promptly notified of the officer's whereabouts.
(d) Except in exigent circumstances, an officer involved in an officer-involved shooting, critical incident, and/or custody death shall be informed forty- eight (48) hours prior to being interviewed or asked to otherwise respond to an internal affairs investigation of the general nature of the investigation before any interview commences. “Exigent circumstances” include necessary cooperation during incident scene procedures, including securing the scene, controlling the public, obtaining witness information, obtaining and processing all physical evidence from the scene or from the officer. During the first forty-eight (48) hours, the parties also agree that an officer shall not be compelled to participate in a “walk-through” investigation without their legal counsel being present. The administration of a post- accident drug test is not defined as a "walk-though" investigation and therefore may be administered immediately following a shooting, critical incident and/or in custody death. The parties agree that a “walk-through” is defined as an investigative tool where El Paso Police Department investigators and/or supervisors request the officer to re-trace their actions in an officer-involved shooting, critical incident, and/or in custody death while being questioned concerning their observations and actions in the incident. INTERNAL AFFAIRS INVESTIGATIONS. Internal Affairs Investigations involve investigations into significant or continued violations or alleged violations of policy or procedure, which, if sustained may lead to discipline by the Chief of Police or, if designated, another member of Command Staff, up to and including suspension, demotion, or termination.
INTERNAL AFFAIRS INVESTIGATIONS. The Professional Standards Supervisor reports directly to the Chief of Police when providing results of Internal Affairs Investigations.
INTERNAL AFFAIRS INVESTIGATIONS. This procedure shall apply to all non-criminal investigations of misconduct by officers except investigations through the chain of command conducted under Section 1 above.
X. Xx interview of the charged Officer shall take place at a location designated by the investigating Officer, usually at the police facility to which the Officer is assigned or the Internal Affairs Office. If the Officer is required to complete written interrogatories, at the Officer’s request, such interrogatories shall be provided to the officer on a computer disk so that the officer may complete such interrogatories at a location other than a police facility. The Officer must return the completed interrogatories in accordance with a written agreement between the officer and the investigator in charge of the investigation. An Officer who requests to complete the interrogatories in this manner will do so during their off duty time and will not be compensated by the Department in any way. When the interrogatories are completed, the Officer shall return the computer disk and their responses to the investigator in charge of the investigation for review and clarification by either party. The Officer will sign the printed copy of the report in the presence of the investigator.
B. The Officer shall be informed of the rank, name and command of the Officer in charge of the investigation, and the identity of all persons present during the interview. If an Officer is directed to leave his post and report for interview to another command, the Officer’s assigned command shall be promptly notified of the Officer’s whereabouts.
C. The Officer under investigation shall be informed forty-eight (48) hours prior to being interrogated or asked to otherwise respond to an investigation of the general nature of the investigation, and sufficient information to reasonably apprise the officer of the allegations shall be provided. The Officer shall be allowed to review but not copy verbatim or photocopy any complaints, affidavits, other written statements, GPS/AVL readouts, video recordings, audio recordings, and photographs, which have been gathered as part of the administrative investigation. INTERNAL AFFAIRS INVESTIGATIONS. Those complaints which, if true, could affect the efficient or professional operation of the Department, allege a violation of the Department’s Code of Conduct, involve employee misconduct or impair the public’s perception of the integrity of the Department, shall be subject to an internal affairs investigation. In such event, departmental directives and policies regarding internal affairs investigations shall be followed.
