Jury Duty/Subpoena Leave. ‌ (a) An employee, upon submission of the Certification of Jury Duty, may be absent from duty without loss of pay as a result of having been called for and appearing for jury duty, excluding a grand jury. (b) The District may refuse to grant paid leave for jury duty to an employee at any time when two percent (2%) or more of the total number of employees of the District are on paid jury duty leave. (c) The employee serving on jury duty, who receives pay from the District during such absence, shall be required to collect jury duty fees and remit such fees to the District. (d) The employee shall be required to perform assigned service to the District during any work day or fraction thereof that the employee is released from jury service, provided that a reasonable period of time shall be allowed for necessary travel. (e) An employee who is assigned to an evening or night work schedule who serves on jury duty shall be reassigned during each day of such service to a day work schedule. (f) The District will grant a leave of absence to a Unit Member for a judicial or other official appearance when subpoenaed as a witness in actions involving the District and not as a litigant. A copy of the subpoena will be provided to the supervisor prior to the required absence.

Jury Duty/Subpoena Leave. 4.7.1 An employee who is away from his/her duties because of jury duty shall be paid for such time lost at his/her regular rate of pay. The employee shall furnish the Superintendent or designee with a written statement from the court or a personal notarized letter showing the days of jury duty. The employee shall report to work each day he/she 1) is not actuallyassigned to jury duty; or 2) is not requested to remain available for jury duty during the work day; 3) is not assigned to jury duty after reporting, but is released in sufficient time to allow her/him to report for the second half of that employee’s work day. 4.7.2 An employee will be granted subpoena leave as may be required by the subpoena, and shall be paid his/her regular salary less any compensation received for his/her services, excluding transportation and per diem expenses, except when the employee is the plaintiff or defendant in such action. This exception shall not apply when the employee is named as plaintiff or defendant while in the performance of his/her duties. The Superintendent or designee may extend the definition and intent of the subpoena leave policy on an individual basis, in consultation with the Association President. 4.7.3 Any Employee who is a member of the Washington National Guard or of any Uniformed Services of the United States shall be entitled to and shall be granted military leave of absence from his or her employment in accordance with state or federal law. 4.7.4 Military leave shall be granted in order that the person may take part in training, periods of active military service, and funeral honors duty, as well as time spent being examined to determine fitness to perform such service when required to do so by the military service if such duty cannot be taken during non-contract days. 4.7.5 When military leave is granted, the employee shall receive his or her regular pay and benefits from the District.

Upon request, the employee may secure support from the District office in seeking relief from jury duty when it interferes with professional obligations to their District assignment. When an employee is subpoenaed as a witness in a court or other legal proceeding, leave shall be granted with full salary but with witness fees, if any, remitted to the District; provided that if said employee is subpoenaed in a case brought or supported by the Association or as a witness with a direct or indirect interest in the proceedings, leave shall be granted without pay (except as may be modified or required by the employee protection provision contained herein). In no event shall the District grant more than two (2) days of witness leave per employee associated with any separate court or legal proceeding.

In the event that an employee is summoned to serve as a juror, or is subpoenaed to appear as a witness in court, or is named as a co-defendant with the District, such employee shall receive a regular day's pay for each day of required presence in court. The jury duty fee or witness fee received by the employee shall be remitted to the District; provided, however, that the remittance shall not exceed the employee's regular daily pay from the District. Payments received as a travel allowance are not reimbursable to the District. In the event that the employee is a party in the case, except as provided in this section, the employee may request personal emergency leave, short term leave, or leave without pay. Upon receipt of jury summons or subpoena, the employee shall immediately notify the immediate supervisor and the personnel department. The employee shall be required to furnish a signed statement from a responsible officer of the court as proof of jury service or appearance as a witness and of the pay received for such service or appearance.

Any compensation received for jury duty performed on contracted days shall be reimbursed to the District. Leaves of absence with pay shall be granted when a teacher is subpoenaed to appear in a court of law when such an appearance is school related. If any witness fees are paid, then that amount shall be reimbursed to the District. Leaves of absence shall not be granted to teachers subpoenaed by the Association or its affiliates to testify against the District unless, after opportunity for argument of counsel, the subpoena shall have been endorsed by the trial judge stating that the teacher is a witness required to resolve the question before the court. No such leave will be granted if the employee has a direct interest in the outcome of litigation against the District.

Jury Duty/Subpoena Leave. Any teacher called for jury duty or who is subpoenaed to testify during school hours in any judicial or administrative matter (excluding cases in which the teacher is a party in interest) shall be paid the difference between compensation received for such duties and his/her salary, excluding travel allowances or reimbursement of expenses, for such time spent on jury duty or giving testimony without deduction from leave days. This clause shall not apply for any teacher in excess of thirty (30) days in any contract year.

If the certified teacher is paid (excluding travel and meal allowance) for such duty, any payments received will be paid to the district.
