LEAVE OF ABSENCE FOR RETRAINING AND STUDY. 24 The District recognizes that technological and other changes may occur which could 25 displace otherwise desirable bargaining unit employees. Accordingly, the Board will 26 encourage employees to prepare themselves for such changes, when necessary, by the 27 following procedures:

LEAVE OF ABSENCE FOR RETRAINING AND STUDY. 12 An employee may request a leave of absence without pay for up to one year for retraining and job 13 enhancement and upon approval of the Board of Trustees shall be granted such leave. Such leave may be 14 granted not more than once every five (5) years. The leave of absence may be taken in separate six (6) 15 month periods rather than for a continuous one (1) year period provided the separate periods of leave of 16 absence shall be commenced and completed within a three (3) year period.
LEAVE OF ABSENCE FOR RETRAINING AND STUDY. 8.14.1 An employee may request a leave of absence for up to one (1) year for study or retraining purposes and upon approval of the Board of Trustees shall be granted such leave. Such leave may be granted not more than once every three (3) years for retraining nor more than once every seven (7) years for study.
8.14.2 An employee may request a leave of absence for study upon the completion of seven (7) consecutive years of service with the District. An employee requesting such leave shall submit to the appropriate supervisors, in writing, a detailed description of the study program identifying particularly those areas that will improve the employee’s ability to carry out the duties and function of the job, to keep abreast of the latest technological changes, and/or benefit the operation of the District.
8.14.3 A retraining program may be mutually agreed to upon the employee’s completion of three (3) consecutive years of service.
8.14.4 The maximum number of employees on such leave at any one time may not exceed five percent (5%) of employees in the classified service.
8.14.5 While on such leave, the employee will receive “difference pay.” Difference pay is defined as the residual of the employee’s pay after deducting the cost of what is paid or the cost of what would have been paid a substitute during the period of the leave.
8.14.5.1 Employees must return to two (2) years employment in the District after such leave.
8.14.5.2 Employees will receive their difference pay in two equal, annual, installments, one (1) during the first (1st) year and one (1) during the second (2nd) year after returning from such leave.
8.14.6 Any leave of absence granted under this policy shall not be deemed a break in service for any purpose with the sole exception being that if the employee does not maintain insurance benefits during the leave, some insurance benefits may be, thereby, modified.
8.14.7 Such leave shall not be counted in computing the period, which must elapse before the granting of another, leave for retraining or study purposes.
8.14.8 Upon returning from a leave of absence, the employee shall assume the duties of the absented position with seniority as of the date of beginning the leave.
LEAVE OF ABSENCE FOR RETRAINING AND STUDY. 26.1 The Board of Trustees, at its sole discretion, may grant an unpaid leave of absence for study or retraining.
26.2 Study or retraining leaves may be granted in such increments as are designated by the Board of Trustees, but the cumulative leave for any unit member shall not exceed a maximum period of one (1) year. The total leave of one (1) year shall commence and complete within a three (3) year period. Leave shall not be granted for more than two (2) classified employees to be absent on study or retraining leave at any one time.
26.3 Study or retraining leave, to be granted, requires the unit member to have completed five (5) consecutive years of full-time paid service to the District.
26.4 No more than one (1) study or retraining leave of absence shall be granted to any unit member in each five (5) year period.
26.5 Prior to any Board of Trustees' consideration, applications for study or retraining leaves require a written submission by the unit member of the total study or retraining plan, the institution which will be used by the unit member, proof of acceptance in the program, detailed description of the program, courses, etc., a detailed description of the anticipated abilities, skills, or knowledge the unit member expects to acquire, a statement of how those abilities, skills or knowledge will benefit the District in the unit member's future service, and the specific times of leave requested. An agreement shall be attached to each request, on the approved District form that the unit member agrees as a condition of the leave to render at least two (2) years of service in the employ of the District after completion of the study or retraining leave.
26.5.1 Completed applications must be submitted through the immediate supervisor for endorsement and be approved for submission to the Board of Trustees not later than four (4) months prior to the proposed beginning date of the leave.
26.5.2 Unit members granted study or retraining leaves shall perform services to the District during such leaves as the District may require as a condition of the grant.
26.6 Unit members on study or retraining leave shall not accumulate seniority, receive any fringe benefits provided by this Agreement, or earn or be entitled to use sick leave, vacation, holiday or any other form of paid leave provided by the District or this Agreement.
26.7 The Board of Trustees, in its sole discretion, and at its sole option, may terminate a study or retraining leave where the unit memb...
LEAVE OF ABSENCE FOR RETRAINING AND STUDY. 24.1 A leave of absence with or without pay for retraining and study may be granted to any member of the bargaining unit with or without pay at the district discretion. Such leave of absence may be taken in separate six (6) month periods or in any other appropriate periods rather than for continuous one (1) year period provided the separate periods of leave of absence shall be commenced and completed within a three (3) year period. Any period of service by the individual intervening between the authorized separate periods shall comprise a part of the service required for a subsequent leave of absence for study or retraining purposes.
24.2 Study leave cannot be granted to an individual who has not served at least seven (7) consecutive years preceding granting of the leave.
24.3 Retraining leave cannot be granted to an individual who has not served at least three (3) consecutive years preceding the granting of the leave.
24.4 No more than one study leave of absence shall be granted in each seven (7) year period.
24.5 No more than one retraining leave of absence shall be granted in each three (3) year period.
24.6 The District may establish the criteria, in consultation with CSEA, which shall entitle the employee to this leave of absence.
24.7 Any leave of absence granted under this policy shall not be deemed a break-in-service for any purpose, except that such leave shall not be included as a service in computing service to the granting of any subsequent leave under this type of leave, nor shall employees earn vacation pay, sick leave, holiday pay, or other benefits provided under this agreement.
24.8 Upon an employee's return from such leave, the District shall, upon request by the employee, consider the employee's expressed preference as to available assignments in the class in which the employee is employed. An employee granted a leave under this Article is guaranteed a position in the same class that the employee occupied prior to the granting of said leave, at the conclusion of leave.
LEAVE OF ABSENCE FOR RETRAINING AND STUDY. 39 The Board of Education may grant a bargaining unit employee a leave of absence not to 2 within the District. Such leave shall be without pay but the bargaining unit employee may advance 3 to the District the cost of fringe benefits if desired.
LEAVE OF ABSENCE FOR RETRAINING AND STUDY. 11.9.1 An unpaid leave of absence for Board approved study/training may be granted under the provisions of Section 11.6
11.9.2 Employees shall be granted paid leave for that period of time that they are required to be absent from work for purposes of retraining and study when such absence is mandated by the District or by law as a condition of continued employment.

LEAVE OF ABSENCE FOR RETRAINING AND STUDY. 22.1 The Board, at its sole discretion, may grant an unpaid or paid Professional Development Leave. The Board reserves the right to discontinue the paid Professional Development Leave program at any time if the program becomes financially burdensome and/or conflicts with the district’s compliance with Education Code 84362 otherwise referred to as the 50 percent law.
22.1.1 The President/Superintendent reserves to right to determine whether the district will accept applications for the Professional Development Leave program in any given year.
22.1.2 The President/Superintendent has the right to deny applications for the paid Professional Development Leave at any time.
22.1.3 The President/Superintendent will consider the needs of the district including but not limited to: sufficient staffing, budget priorities, institutional needs, instructional needs of the students, or Education Code 84362 when granting a Professional Development leave.
22.2 To encourage and enable SEIU employees to enhance their value to the District through furthering their education, upgrading of their job skills, or retraining to keep up with technological or other changes, a Professional Development Leave of Absence is established.
22.3 An eligible employee may apply for a leave to complete interrupted studies, learn by observing methods used in industry or other educational institutions, or get a substantial start on a goal of better education.
22.4 After seven (7) years of continuous service in the District if the leave is for general study, and three years of continuous service in the District if the Leave is for retraining to keep up with technological and other changes; an employee is eligible to apply for such leave for up one year at fifty percent (50%) of full pay.
22.4.1 The compensation shall be paid the employee while on the leave of absence in the same manner as if the employee is in active working status for the district.
22.5 Such a leave shall be taken in separate six-month periods, rather than for a continuous one-year period; provided that the separate periods of the leave of absence shall commence and completed within a three-year period.
22.6 Leave shall not be granted for more than two (2) classified employees to be absent on study or retraining leave at any one time. The needs of the district (not seniority) may dictate preference if more than two (2) employees apply for Professional Development Leave.
