Loss of Service and Seniority. An employee shall lose all service and seniority and shall be deemed to have terminated if he:
(a) leaves of his own accord;
(b) is discharged and the discharge is not reversed through the grievance or arbitration procedure;
(c) has been laid off without recall pursuant to Article 11.07 for twenty-four (24) months.
(d) is absent from scheduled work for a period of three (3) or more consecutive working days, without notifying the Hospital of such absence and providing a reason satisfactory to the Hospital;
(e) fails to return to work (subject to the provisions of (d)) upon termination of an authorized leave of absence without satisfactory reason or utilizes a leave of absence, without permission, for purposes other than that for which the leave was granted;
(f) fails upon being notified of a recall to signify his intention to return within five (5) calendar days after he has received the notice of recall mailed by registered mail to the last known address according to the records of the Hospital and fails to report to work within ten (10) calendar days after he has received the notice of recall or such further period of time as may be agreed upon by the parties. (NOTE: Any other provision(s) related to seniority that existed in the expiring Collective Agreement will be continued and numbered in sequence as provisions of this Article.)

(d) is absent from scheduled work for a period of three (3) or more consecutive working days, without notifying the Hospital of such absence and providing a reason satisfactory to the Hospital;
(e) fails to return to work (subject to the provisions of [d]) upon termination of an authorized leave of absence without satisfactory reason or utilizes a leave of absence, without permission, for purposes other than that for which the leave was granted;
(f) fails upon being notified of a recall to signify her intention to return within five (5) calendar days after she has received the notice of recall mailed by registered mail to the last known address according to the records of the Hospital and fails to report to work within ten (10) calendar days after she has received the notice of recall or such further period of time as may be agreed upon by the parties;
(g) is a casual part-time employee who has failed to respond to offers of work or declined to work for three (3) consecutive months (or for five (5) consecutive call-ins during the period June 15 - September 15), unless the employee is not available for a call-in within her department/unit due to already being called into work in another department/unit within the Hospital, or is not available due to being on an approved leave of absence (including up to their level of vacation entitlement), or is not available due to a mutually agreed upon availability schedule, such call-in will not be included in the three (3) consecutive month period and five (5) consecutive call-ins referred to above. This Article will be applied in accordance with the Ontario Human Rights Code.

(c) retire;
(d) have been laid off without recall for twenty-four (24) months;
(e) are absent from scheduled work for a period of three (3) or more consecutive working days, without notifying the Employer of such absence and providing a reason satisfactory to the Employer;
(f) fail to return to work upon termination of an authorized leave of absence without satisfactory reason or utilizes a leave of absence, without permission, for purposes other than that for which the leave was granted;
(g) fail upon being notified of a recall to signify their intention to return within seven (7) calendar days after receiving the notice of recall mailed to the last known address according to the records of the Employer and fails to report to work within twenty (20) calendar days after he/she has received the notice of recall or such further period of time as may be agreed upon by the parties.
(h) are absent due to illness or disability for a period of thirty (30) calendar months from the time the disability or injury commenced. Interpretation and application of this clause is subject to the provisions of the Human Rights Code.
(i) are a casual employee who fails to declare their availability in accordance with Article 18.05 (b), and/or fails to be available pursuant to their declared availability if called upon without a reasonable excuse.

Seniority is a principle of granting preference to employees for promotion, transfers, demotions, layoffs and recall after layoffs, and all matters of seniority in accordance with length of accumulative service, but only when all other qualifications necessary to fill the requirements of the job are equal. Seniority means the relative ranking of the employees as determined by the respective length of accumulated service with the Hospital.
