MANAGERIAL RIGHTS AND RESPONSIBILITIES. 6.01 Except as specifically provided herein, nothing in this Agreement shall limit the Employer in the exercise of its function of management under which it shall have, among other things, the right to direct the working force to the end that the Employer’s customers will be well and efficiently served.

MANAGERIAL RIGHTS AND RESPONSIBILITIES. A. The Association agrees that the Board has the exclusive right and responsibility to formulate and set policy in accordance with applicable state regulations and laws of Florida and the United States of America. B. The Association agrees that the Board has the exclusive right and responsibility to take whatever actions are necessary, within existing statutes and in this document, to fulfill the obligations of the Board in emergency situations. C. The Association and the Board agree that this Agreement, or any part thereof, shall not be interpreted so as to abridge, or in any way usurp, the authority and power of the Board as established by constitutional provision, State Board of Education Administrative Rules, Statutes or the Florida School Code existing at the time of this agreement; and further, the Board and the Association agree that should any term or condition of this Agreement be found to be contrary to any constitutional provision or State Board of Education Administrative Rules or Statutes or the Florida School Code, in effect or enacted subsequent to the signing of this Agreement, be null and void. D. The Association and the Board agree that this Agreement constitutes the entire agreement between the parties with respect to wages, hours, and terms and conditions of employment, for the unit members covered by this Agreement and that the determination of any question with respect to wages, hours, and terms and conditions of employment not expressly covered by this Agreement shall be the exclusive right and responsibility of the Board subject to State Administrative Rules, the Florida School Code and laws of Florida and the United States and supersedes any previous agreements of practices, written or oral.
MANAGERIAL RIGHTS AND RESPONSIBILITIES. The Association recognizes that the Board has the responsibility and authority to manage and direct, on behalf of the public, all operations and activities of the School District to the full extent authorized by law. These powers are limited by applicable laws or the express terms of this Agreement and include, but are not limited to, the right: A. To execute management and administrative control of the school system and its properties, facilities, and programs. B. To employ and re-employ all personnel, determine the methods, means, job classifications, and personnel by which operations are to be conducted. C. To select textbooks and other teaching materials to be used in all courses of instruction, to establish and supervise the curriculum, the manner of instruction, class schedules, days school will be in session, physical plant, and other facilities. D. To consolidate or eliminate any teaching position. E. Transfer and assignment of staff are management rights.
MANAGERIAL RIGHTS AND RESPONSIBILITIES. The Board shall not be required to bargain over matters of inherent managerial policy, which shall include such areas of discretion or policy as the functions of Rock Valley College, standards of services, its overall budget, the organizational structure, selection of new faculty members, and the direction of faculty members. The authority and powers of the Board as prescribed by the Statutes and Constitutions of the State of Illinois and the United States shall continue unaffected except as limited by the written provisions of this AGREEMENT, whether or not such authority and powers were exercised by the College prior to the execution of this AGREEMENT.
MANAGERIAL RIGHTS AND RESPONSIBILITIES. 4.01 The Union recognizes and acknowledges that the Employer has, and shall retain, the exclusive right and responsibility to manage its operation in all respects including, but not limited to, the following: (a) to plan, direct and control operations; to determine methods, processes, equipment and other operating matters; to determine the location of facilities and the extent to which these facilities or parts thereof shall operate; and (b) to direct the working forces including the right to decide on the number of employees, to organize and assign work, to schedule shifts and maintain order and efficiency, to discipline employees including suspension and discharge for just cause; and it is expressly understood that all such rights and responsibilities not specifically covered or modified by this Agreement shall remain the exclusive rights and responsibilities of the Employer. 4.02 Such rights will not be exercised in a manner inconsistent with the express provisions of this Agreement and shall be exercised in a reasonable manner. 4.03 New employees may be released during the probationary period for just cause. The employee may have access to the grievance process but may not refer a grievance to adjudication unless the release is disciplinary in nature. When a probationary employee is released the Employer shall provide a copy of the release letter to the Local Union President.
MANAGERIAL RIGHTS AND RESPONSIBILITIES. Except as specifically limited by the provisions of this AGREEMENT, the Board retains all traditional rights to manage and direct the affairs of the College in all respects and to manage and direct its employees, to unilaterally make and implement decisions with respect to the operation and management of the College in all respects, including, but not limited to, all rights and authority possessed or exercised by the Board prior to the Board’s recognition of the Association as the exclusive bargaining representative for the employees covered by this AGREEMENT. The authority and powers of the Board as prescribed by the Statutes and Constitution of the State of Illinois and the United States shall continue unaffected by this AGREEMENT except as expressly limited by the express provisions of this AGREEMENT, and then only to the extent that such authority and powers are delegable. These Board rights include, but are not limited to, the following: To plan, direct, control and determine all the operations and services of the College; to determine the College’s mission, objectives, policies and budget and to determine and set all standards of service offered to the public; to supervise and direct employees and their activities as related to the conduct of College affairs; to establish the qualifications and conditions for employment and to employ employees; to schedule and assign work; to assign or to transfer employees within the College; to establish work and productivity standards and, from time to time, to change those standards; to assign overtime; to layoff or relieve employees due to lack of work or funds or for other legitimate reasons; to determine the methods, means, organization and number of personnel by which operations and services shall be provided; to make and enforce rules and regulations; to discipline, suspend and discharge employees; to change, relocate, modify or eliminate existing programs, services, methods, equipment or facilities; to determine whether services or goods are to be provided to or produced for employees covered by this AGREEMENT; to hire all employees and, subject to provisions of law, to determine their qualifications, and the conditions for their continued employment, or their dismissal or demotion, and to evaluate and promote all such employees; and to determine the duties, responsibilities and assignment of those in the bargaining unit. MANAGERIAL RIGHTS AND RESPONSIBILITIES. 5.01 The Company recognizes and agrees that its rights, powers and authority are abridged, delegated, granted or modified by virtue of the granting of certification, the Canada Labour Code and the provisions of this Collective Agreement. 5.02 For greater certainty, and taking account of the unique nature of the workplace, and the terms of the Ellesmere Island Commercial Support Contract Statement of Work, but without limiting the generality of 1.02 and 1.01, and where the actions of the Company are not inconsistent with any terms of the Collective Agreement, the Union agrees that the Company has the sole and exclusive right to: a) Operate and manage its affairs and facilities in all respects as it sees fit, including the right to hire, direct and schedule its work force; b) Promote, classify, transfer and lay-off employees; c) Discipline, demote, suspend and discharge employees for just cause; d) Determine job content; assign work; determine the standards of performance and quality of work and the qualifications of employees to perform work; e) Establish methods, processes and means of performing work; f) Make, establish, publish and enforce reasonable rules and regulation; g) Introduce new and improved methods, equipment and facilities; h) Purchase supplies, equipment, materials and services from any source acceptable to the Company; i) Determine the number of employees to be employed and the duties to be performed; j) Establish, expand, reduce, alter, consolidate or abolish any job classification or department; and, k) Discontinue, reorganize or combine departments or any branch or unit of operations, with any consequent reduction or other changes in the work force. 5.03 Management will not exercise its responsibilities in an arbitrary, discriminatory or bad faith manner. 5.04 In order to remain compliant with the Ellesmere Island Commercial Support Contract with the Department of National Defence, the parties acknowledge that all Nasittuq employees are subject to the Code of Service Discipline as required under Part III of the National Defence Act, R.S. 1985, c.N-5., and must comply with all orders and instructions of the Station Commanding Officer. Failure to do so may result in removal of the Nasittuq employee from CFS Alert site which may result in termination of employment for just cause.
