PERSONAL/CARER’S AND COMPASSIONATE LEAVE. 52.1 Employees are entitled to personal/carers and compassionate leave in accordance with the provisions of the NES, subject to the requirements set out in this clause.
52.2 Employees (excluding casual Employees) are entitled to accrue paid personal/carer’s leave in accordance with the NES. The NES presently prescribes 10 days of paid personal/ carer’s leave for each year of service with his/her employer.
52.3 An Employee is entitled to 2 days of compassionate leave for each occasion (a permissible occasion):
(a) when a member of the Employee’s immediate family, or a member of the Employee’s household:
(i) contracts or develops a personal illness that poses a serious threat to his or her life; or
(ii) sustains a personal injury that poses a threat to his or her life; or
(iii) dies
(b) a child is stillborn, where the child would have been a member of the employee's immediate family, or a member of the employee's household, if the child had been born alive; or
(c) the employee, or the employee's spouse or de facto partner, has a miscarriage.
52.4 Where an Employee’s spouse or de facto partner dies, the Employee, in lieu of the entitlement set out clause 52.3, is entitled to 10 days’ compassionate leave.
52.5 The compassionate leave entitlement for Employees (excluding casual Employees) is paid at the Base Rate.
52.6 Casual Employees have no entitlement to paid personal/carer’s leave. A casual Employee is entitled to
(i) compassionate leave in accordance with the above. The entitlement for casuals is unpaid; and
(ii) unpaid carer’s leave in accordance with the NES.
52.7 Estia Health may (but need not) require written evidence confirming an Employee’s eligibility to take paid or unpaid personal/carer’s leave, or compassionate leave within a reasonable time after being notified of an Employee’s absence, wherever:
(a) the absence is for 2 or more consecutive days, or occurs on or immediately before or after a Public Holiday, RDO, ADO or a day upon which the Employee was due to take pre-approved leave (such as annual leave);
(b) the Employee has already taken at least 5 days of personal/carer’s leave during the preceding 12 months; or
(c) the leave has been taken in circumstances that would reasonably lead the employer to question its veracity. In such circumstances,
(i) the employer will outline to the employee in writing the concern; and provide a timeframe for review;
(ii) Employees will be given the opportunity to respond in writing to the concerns – if genui...
PERSONAL/CARER’S AND COMPASSIONATE LEAVE. Personal/xxxxx's and compassionate leave are provided for in the NES.
PERSONAL/CARER’S AND COMPASSIONATE LEAVE. (a) The Executive will be entitled to 10 days’ paid personal/carer’s leave per year of service if the Executive:
(i) cannot attend work due to illness; or
(ii) needs to care or support an immediate family member or other member of the Executive’s household due to illness or emergency.
(b) Untaken paid personal/xxxxx’s leave accumulates from year to year but will not be paid out on termination.
(c) In addition, the Executive will be granted 2 days’ unpaid carer’s leave if the Executive has exhausted paid personal/carer’s leave and the Executive provides proof in accordance with clause 4.3(e). Rights under this clause arise each time the Employee needs to care for or support an immediate family member or other member of the Employee’s household due to illness or emergency.
(d) The Executive is entitled to 2 days’ paid compassionate leave in the event of the death or a serious life-threatening illness or injury of an immediate family member or member of the Executive’s household. Untaken compassionate leave does not accumulate from year to year and will not be paid out if the Executive’s employment ends.
(e) The Employer may require the Executive to provide a medical certificate or, if it is not reasonably practicable to do so, a statutory declaration for any absence from work for personal/carer’s or compassionate leave.
(f) The Executive must give the Employer notice of the Executive’s intention to take personal/carer’s or compassionate as soon as practicable. The Employee must also advise the Employer of the period or expected period of leave.
PERSONAL/CARER’S AND COMPASSIONATE LEAVE. 14.1 An Employee, other than a Casual, who is sick or injured or has an unexpected emergency, or who needs to care for an immediate family or household member who is sick, injured or has an unexpected emergency, is entitled to paid personal/carer’s leave.
14.2 A full-time Employee is entitled to 10 days’ personal/xxxxx’s leave per year that accrues progressively and accumulates from year to year. A part-time employee accrues personal/carer’s leave on a pro rata basis.
14.3 An Employee, other than a Casual, is entitled to paid compassionate leave if a member of his or her immediate family dies or has an injury or illness that poses a serious threat to his or her life or where the Employee or the Employee’s spouse or defacto partner has a miscarriage or gives birth to a stillborn child.
14.4 A full-time or part-time Employee is entitled to up to two days of paid compassionate leave per occasion.
14.5 Payment for personal/carer’s leave or compassionate leave is calculated on the basis of the Employee’s contracted hours for the period of leave.
14.6 A casual Employee, or a full time Employee who has used up or not accrued sufficient paid leave entitlements, is entitled to up to two days of unpaid carer’s and compassionate leave on the same basis as 14.1 and 14.3 respectively.
14.7 Where practicable, an Employee may be required to provide a medical certificate or statutory declaration to support that their absence is reasonable due to illness or injury.
14.8 An Employee who is absent from work due to sick leave, xxxxx’s leave, or compassionate leave must notify the Employer as soon as possible.
14.9 An Employee is not entitled to payment for absence while he or she is receiving paid worker’s compensation.
PERSONAL/CARER’S AND COMPASSIONATE LEAVE. 15.1 Entitlement
i) Personal Leave is provided in accordance with NES
ii) Personal leave includes sick leave and xxxxx’s leave
iii) An employee absent from work by reason of personal illness or injury (not being illness or injury resulting out of employee’s misconduct or default or from injury arising out of or in the course of employment) is entitled to leave of absence, without deduction of pay, subject to the following conditions and limitations.
PERSONAL/CARER’S AND COMPASSIONATE LEAVE. 19.1 Employees' entitlements to paid and unpaid personal/xxxxx's leave and compassionate leave are prescribed by with the NES.
19.2 For each year of service with the Employer, an Ongoing Employee and Maximum-term Employee is entitled to 12 days paid personal/carer's leave.
19.3 Other than in respect of the first 2 days personal/carer's leave that is taken by the Employee in any year, reasonable evidence may be required by the Employer to support applications for personal/carer's leave, including (but not limited to):
(a) absences of more than 1 day, or
(b) an absence adjacent to a weekend, public holiday or period of annual or long service leave. If reasonable evidence is not provided on request, the Employer will not approve the application for personal/carer's leave.
PERSONAL/CARER’S AND COMPASSIONATE LEAVE. 19.1 Personal leave
PERSONAL/CARER’S AND COMPASSIONATE LEAVE. 23.1 Employees are entitled to personal leave in accordance with this clause: Paid Personal Leave Paid
PERSONAL/CARER’S AND COMPASSIONATE LEAVE. (a) Employees are entitled to personal/xxxxx’s leave and compassionate leave in accordance with the provisions of the NES (refer to Chapter 2, Part 2-2, Division 7 of the Act).
(b) Personal/carer’s and compassionate leave entitlements for casual employees are as set out in the NES.
23.1 Entitlement to Paid Personal/Carer's Leave
(a) For each year of service with the employer, an employee is entitled to 10 days of paid personal/xxxxx's leave.
(b) An employee's entitlement to paid personal/xxxxx's leave accrues progressively during a year of service according to the employee's ordinary hours of work, and accumulates from year to year.
PERSONAL/CARER’S AND COMPASSIONATE LEAVE. 17.1. Personal/carer’s leave and compassionate leave are provided for in the NES.
17.2. Casual employees may take unpaid carer’s leave if the leave is taken to provide care or support to a member of the employee’s immediate family, or a member of the employee’s household, who requires care or support because of a personal illness, or personal injury, affecting the member or an unexpected emergency affecting the member.
17.3. An employee may take unpaid carer’s leave for a particular permissible occasion as:
(a) A single continuous period of up to 2 days; or
(b) Any separate periods to which the employee and his or her Employer agree.
