PLANT MOVEMENT. Except where prohibited by law, whenever the Company transfers operations from any plant covered by this Agreement to another plant owned, rented, acquired or built by the Company, in the Province of Ontario, any employee laid off as a result of such transfer may, if they so desire, request a transfer to the new plant with their existing seniority, service date, wages and benefits. Such requests for transfer must be made in writing by the employee within thirty (30) calendar days of notification of transfer of operations.

PLANT MOVEMENT. Except where prohibited by law, or previous Agreement with other Unions, whenever the Company transfers operations or departments from any plant covered by this agreement to a plant which is newly acquired or built by the Company, employees engaged on such operations or employed in such departments may, as they so desire, be transferred to the new plant with their full Company seniority.
PLANT MOVEMENT. 22.01 Except where prohibited by law, whenever the Company transfers operations from any plant or office covered by this Agreement to another plant or office owned, acquired or built by the Company, employees engaged in such operations or any employee laid off as a result of such transfer may, if they so desire, be transferred to the new plant or office with their full Company seniority including all the benefits provided for in this Agreement. 22.02 Any employee declining such a transfer may accept a termination and be eligible to receive severance pay in accordance with the requirements of Ontario law. 22.03 An employee accepting a transfer will be paid a moving allowance provided: (a) The plant location is at least eighty (80) kilometers from the plant at which he/she last worked and he/she moves his/her residence as a result of such relocation, and; (b) His/her application is received by the Company within six (6) months after commencing employment at the new plant. 22.04 The amount of the moving allowance will be as shown in the following table: Kilometers Between Plant Location Single Married
PLANT MOVEMENT. 3.01 In the event that during the term of this Collective Agreement, the Company decides to move in whole or in part from 0000 Xxxxxx Xxxxxx, Xxxxxx, Xxxxxxx to a new location in Ontario, not covered by another Collective Agreement, the Company agrees to meet with the Union Committee not less than thirty (30) calendar days prior to such move. The purpose of such meeting (s) will be to: (a) Confirm the method of recognition of Unifor at the new location. (b) Examine the feasibility of job opportunity for the employees affected, and working in the plant, at the time of such move. (c) Review the application of the terms of the Collective Agreement, as to how such terms may be applicable to this new operation. (d) The seniority of the employees shall be carried to the new plant with a continuance of seniority and service. 3.02 In the event of a lay-off, which is expected to result in seniority employees being permanently laid-off, such laid-off employees who make application through the Company, and who have a satisfactory employment record, will be offered employment at other locations that are hiring. 3.03 An employee hired under this provision shall retain recall rights per their Collective Agreement. They shall begin in their new plant as a seniority employee with their date of hire in the new plant being their seniority date. Their company accumulated seniority will be recognized for eligibility purposes of vacation and pension entitlements as provided in the new plant.

PLANT MOVEMENT. Except where prohibited by law, whenever the Company transfers operations or departments from any plant covered by this Agreement to a vacant plant which is newly acquired or built by the Company, employees engaged on such operations or employed in such departments, may, if they so desire, be trans- ferred to the new plant with their full Company seniority. Any employee declining such a transfer may accept a termination and be eligible to receive a severance pay in accordance with the requirements of Ontario law.
PLANT MOVEMENT. Should the Company during the life of this Agreement decide to move any or all of its operations from its existing location, an employee with seniority whose job is so transferred may, at his option, transfer to the same job at the new location or exercise his or her bumping rights as per Article 9 or receive severance pay in the amount stipulated in the severance program. The employee shall notify the Company of his desire to relocate within fourteen (14) days of being notified of the transfer. If the employee elects to transfer, then as of the date of transfer, he shall lose all his seniority rights at the old location and subject to the law in force at the new location and to the agreement of the bargaining agent (if any) at that location the employee shall be entitled to retain his seniority and be eligible for all applicable benefits.

(b) Confirm the method of recognition of Unifor at the new location. (c) Confirm the right of existing employees to transfer with the job they normally perform. (d) Review the application of the terms of the Collective Agreement, as to how such terms may be applicable to this new operation. (e) The seniority of the employees shall be carried to the new plant with a continuance of seniority and service.
PLANT MOVEMENT. In the event that the Company moves or transfers a portion of the production and equipment at Georgetown, to a new factory owned or leased or operated by it, then in that event, the Company will give the Union notice of move or transfer as far in advance as practicable and will meet with the Union for the purpose of working out a transfer of production agreement covering employees laid off as a result of such move or transfer, provided always however, that there is no Collective Agreement to which the Company is a party or is bound by reason of the provisions of the Labour Relations Act or Amendments thereto, covering a bargaining unit at the new factory. In the event there is a Collective Agreement covering a bargaining unit at the new factory, employees laid off as a result of the move or transfer shall, subject to said Collective Agreement, be offered the opportunity to transfer with their job. 32.01 All employees classified in the skilled trades department are subject to all the provisions of the Collective Agreement, except as specifically provided for in the skilled trades section. a) who presently holds a journey person's classification in the skilled trades occupation as listed above, or; b) has served a bona fide apprenticeship of four (4) years (8000 hours), 5 years (9000 hours) and holds a certification which substantiates his/her claim of such service; c) who has 8 years of practical experience in the trade or classification he/she claims journey person's designation and can prove same. A UNIFOR journey person's card will be accepted as proof in conjunction with an Ontario Ministry of Skills and Development certificate; d) any further employment in the Skilled Trades occupations as listed above, after signing this agreement, shall be limited to journey persons and apprentices. e) seniority lists shall be maintained by basic trades and shall not be interchangeable with other trades. f) present employees in any skilled trades classifications prior to May 1, 1997 shall have their total seniority applied in such skilled trades classification. Employees entering a skilled trades classification after April 30, 1997 shall have a seniority date established as of the date of entry in such classification. g) a production employee will not exercise his/her seniority in any skilled trades classification, nor will any skilled trades employee exercise seniority in any production classification. COST OF LIVING ALLOWANCE EFFECTIVE MAY A Cost of Living Allowance will be paid in accordance with the changes in the official Statistics Canada Index (1986 = 100) and hereinafter referred to as the Consumer's Price Index. Added to gross earnings will be a Cost of Living Allowance calculated on hours worked and on a basis of a one cent (0.01 ) adjustment for each change of in the Consumer Price Index in effect for the month of March, The Cost of Living Allowance will be adjusted up and down if as required for each quarterly period in accordance with the above calculation, provided, however, that in no event will a decline in the Consumers' Price Index below the established base provide for a further reduction in the base rate. Cost of Living shall be calculated as above for each quarter commencing with the Statistics Canada Index as published for June, printed in July and paid in August. Thereafter, Cost of Living adjustments will be made quarterly and paid in November, February, May and August for each year of the Collective Agreement. There shall be a one (1) cent roll back each quarterly calculation over the three (3) year agreement.
