Overtime Pay and Compensatory Time. A. Compensatory time shall be granted at the rate of one and one-half (1 & 1/2) hours for every hour worked in overtime. B. Use of compensatory time shall be approved by the supervisor and scheduled subject to supervisor approval in the same manner that vacation time is requested and approved. C. Compensatory time shall be recorded on an employee's time sheet and a record of accumulated time kept by the BUSD Business Office. D. No employee shall accumulate more than sixty (60) hours of compensatory time. E. Compensatory time shall be utilized during the fiscal year accumulated and shall not be carried over from year to year unless remaining time is scheduled with the employee's supervisor. F. Unused compensatory time shall be paid off at the end of a fiscal year unless the time is scheduled for utilization by the employee with supervisor approval. G. Compensatory time shall only be awarded for overtime, i.e. beyond eight (8) hours a day or beyond forty (40) hours a week. H. The employee shall have the choice in electing compensatory time as opposed to receiving pay for overtime.
Overtime Pay and Compensatory Time. In accordance with the Fair Labor Standards Act (FLSA), non-exempt employees shall be paid for all hours worked in a Sunday through Saturday calendar week, including hours worked in excess of an employee's regularly scheduled work week. The additional work hours, however, shall be performed through the authorization of the Court Administrator of Juvenile Home Administrator, or his/her designee. Employees working unauthorized hours in excess of their regularly scheduled work shift shall be subject to disciplinary action. (a) In conjunction with an employee working additional hours in excess of his/her regularly scheduled work shift, the employee's supervisor or Juvenile Home Administrator, or his/her designee, may request that the employee "flex" his/her regularly scheduled work week, in a Sunday through Saturday calendar week, prior to the employee exceeding his/her authorized FTE hours for the week. Such "flex” may occur only if it is mutually agreed upon by the employee and the employee's supervisor or Juvenile Home Administrator. (b) Overtime pay shall be calculated on hours worked (excluding annual leave, sick leave and compensatory time used during regularly scheduled shifts) as follows: (1) For all hours over eight (8) in one workday for employees regularly scheduled for eight (8) hour shifts; or (2) For all hours worked over ten (10) in any one workday for employees regularly scheduled for ten (10) hour shifts. Overtime will be calculated in 15-minute increments by rounding time worked to the nearest quarter hour in any one day. Employee time from 1 to 7 minutes will be rounded down, and thus not counted for hours worked, Employee time from 8 to 14 minutes will be rounded up and counted as a quarter of an hour worked. (c) Overtime pay shall be calculated at one and one-half (1.50) times the hourly rate of the non-exempt employee for hours worked as follows: (1) For all hours over eight (8) in one workday for employees regularly scheduled for eight (8) hour shifts; or (2) For all hours worked over ten (10) in any one workday for employees regularly scheduled for ten (10) hour shifts. (d) Payment for overtime and/or accrued compensatory time shall be limited to non- exempt employees. Overtime Pay and Compensatory Time. Unless the employee and the Facility Director agree that overtime hours will be compensated with time off, overtime hours shall be compensated in cash. If overtime hours are compensated in cash, payment shall be made in accordance with Section 7 of the Fair Labor Standards Act. If overtime hours are compensated with time off, compensatory time shall be provided at a rate of one and one half (1 1/2) hours for each hour of overtime employment. Compensatory time may be accumulated to a maximum of two hundred and forty (240) hours. If compensation is paid to an employee for accrued compensatory time off, such compensation shall be paid at the regular rate earned by the employee at the time the employee receives the compensation. One half of all accrued Compensatory time in excess of forty (40) hours of compensatory time must be used by January 10th or the value of one half of all accrued time any hours in excess of forty (40) hours of compensatory time will be paid in cash, prior to February 1st. One half of all accrued Compensatory time in excess of forty (40) hours must be used by June 10th or the value of one half of all accrued time any hours in excess of forty (40) hours of compensatory time will be paid in cash prior to July 1st. Notwithstanding the use/payment requirements set forth above, employees may request a waiver for exceptional circumstances such as significant medical procedures. Such a request shall be submitted to Human Resources for consideration by the Board of Supervisors and will be granted only if approved by a majority of the Board. The decision of the Board is final and is not subject to the Grievance Procedures in Article IV. Employees will be paid in cash for accrued compensatory time prior to transfer to a higher paying position. Upon termination of employment, employees who have accrued compensatory time, shall be paid for unused compensatory time at a rate of compensation not less than: (1) the average regular rate received by the employee during the last three (3) years of the individual's employment, or (2) the final regular rate received by the employee, whichever is higher. Employees who have accrued compensatory time off, may request the use of compensatory time and shall be permitted to use such time within a reasonable period after making the request if the use of compensatory time does not unduly disrupt the operations of the Center.

Employees assigned to 7.5-hour days shall be paid one and one-half times their regular hourly rate of pay for all hours worked in excess of 150 hours in their 28-day work cycle or in excess of 75 hours in a two-week pay period. 1. Employees may have no more than 108 hours in their Comp Time bank at any time. All Comp Time hours must be used by the end of the calendar year. Any unused Comp Time hours in an employee’s bank on December 31 shall be paid out at the employee’s straight time hourly rate in effect as of December 31st. 2. A request to schedule Comp Time must be submitted no later than 5pm on the employee’s duty day prior to the date that time is requested off. 3. Comp Time shall be scheduled for a minimum of eight hours to a maximum of 24 hours, with time taken in ½ hour increments. 4. If the Comp Time request is scheduled to start after 8am, the time requested must complete the shift, i.e., run through the end of the scheduled shift. Comp Time may not be scheduled to start after 10pm. 5. No more than two employees shall be allowed off on Comp Time each day. Requests will be processed on a first-come first-serve basis. Only one of the two employees off on Comp Time on any day can be a lieutenant. 6. An employee off duty on Comp Time is ineligible for hirebacks or any other Department overtime except for General Callbacks.
