Overtime Pay and Compensatory Time. A. Compensatory time shall be granted at the rate of one and one-half (1 & 1/2) hours for every hour worked in overtime. B. Use of compensatory time shall be approved by the supervisor and scheduled subject to supervisor approval in the same manner that vacation time is requested and approved. C. Compensatory time shall be recorded on an employee's time sheet and a record of accumulated time kept by the BUSD Business Office. D. No employee shall accumulate more than sixty (60) hours of compensatory time. E. Compensatory time shall be utilized during the fiscal year accumulated and shall not be carried over from year to year unless remaining time is scheduled with the employee's supervisor. F. Unused compensatory time shall be paid off at the end of a fiscal year unless the time is scheduled for utilization by the employee with supervisor approval. G. Compensatory time shall only be awarded for overtime, i.e. beyond eight (8) hours a day or beyond forty (40) hours a week. H. The employee shall have the choice in electing compensatory time as opposed to receiving pay for overtime.

Overtime Pay and Compensatory Time. In accordance with the Fair Labor Standards Act (FLSA), non-exempt employees shall be paid for all hours worked in a Sunday through Saturday calendar week, including hours worked in excess of an employee's regularly scheduled work week. The additional work hours, however, shall be performed through the authorization of the Court Administrator of Juvenile Home Administrator, or his/her designee. Employees working unauthorized hours in excess of their regularly scheduled work shift shall be subject to disciplinary action. (a) In conjunction with an employee working additional hours in excess of his/her regularly scheduled work shift, the employee's supervisor or Juvenile Home Administrator, or his/her designee, may request that the employee "flex" his/her regularly scheduled work week, in a Sunday through Saturday calendar week, prior to the employee exceeding his/her authorized FTE hours for the week. Such "flex” may occur only if it is mutually agreed upon by the employee and the employee's supervisor or Juvenile Home Administrator. (b) Overtime pay shall be calculated on hours worked (excluding annual leave, sick leave and compensatory time used during regularly scheduled shifts) as follows: (1) For all hours over eight (8) in one workday for employees regularly scheduled for eight (8) hour shifts; or (2) For all hours worked over ten (10) in any one workday for employees regularly scheduled for ten (10) hour shifts. Overtime will be calculated in 15-minute increments by rounding time worked to the nearest quarter hour in any one day. Employee time from 1 to 7 minutes will be rounded down, and thus not counted for hours worked, Employee time from 8 to 14 minutes will be rounded up and counted as a quarter of an hour worked. (c) Overtime pay shall be calculated at one and one-half (1.50) times the hourly rate of the non-exempt employee for hours worked as follows: (1) For all hours over eight (8) in one workday for employees regularly scheduled for eight (8) hour shifts; or (2) For all hours worked over ten (10) in any one workday for employees regularly scheduled for ten (10) hour shifts. (d) Payment for overtime and/or accrued compensatory time shall be limited to non- exempt employees. Overtime Pay and Compensatory Time. 1. General Provisions: Overtime will be scheduled and approved by the District when it determines such work is needed and will be paid in accordance with applicable laws at the rate of time and one half. When budgeted funds are not available, the employer may compensate employees with compensatory time rather than overtime pay. Prior to the performance of the work, the employer will stipulate whether the work will be compensated by overtime pay or by compensatory time. The work week for purposes of calculating overtime pay and compensatory time commences at 12:01 a.m. Monday and ends at 12 midnight on Sunday. Overtime will be paid or compensatory time will be accrued for any work performed in excess of a forty (40) hour work week at a rate of time and one half. When a holiday or vacation day falls within a work week; overtime/compensatory time will be paid/accrued on a basis of time paid rather than time worked. The use of accrued compensatory time shall be mutually agreed upon by the employee and supervisor. Employees shall be permitted to use accrued compensatory time with prior approval from the supervisor provided the requested dates are not disruptive to the operation of the District. Overtime Pay and Compensatory Time. Employees assigned to 24-hour shifts shall be paid one and one-half times their regular hourly rate of pay for all hours worked in excess of 204 in their 27-day work cycle or in excess of 24 hours in a work day. Employees assigned to 7.5-hour days shall be paid one and one-half times their regular hourly rate of pay for all hours worked in excess of 150 hours in their 28-day work cycle or in excess of 75 hours in a two-week pay period. 1. Employees may have no more than 108 hours in their Comp Time bank at any time. All Comp Time hours must be used by the end of the calendar year. Any unused Comp Time hours in an employee’s bank on December 31 shall be paid out at the employee’s straight time hourly rate in effect as of December 31st. 2. A request to schedule Comp Time must be submitted no later than 5pm on the employee’s duty day prior to the date that time is requested off. 3. Comp Time shall be scheduled for a minimum of eight hours to a maximum of 24 hours, with time taken in ½ hour increments. 4. If the Comp Time request is scheduled to start after 8am, the time requested must complete the shift, i.e., run through the end of the scheduled shift. Comp Time may not be scheduled to start after 10pm. 5. No more than two employees shall be allowed off on Comp Time each day. Requests will be processed on a first-come first-serve basis. Only one of the two employees off on Comp Time on any day can be a lieutenant. 6. An employee off duty on Comp Time is ineligible for hirebacks or any other Department overtime except for General Callbacks.

Employees who have accrued compensatory time off, may request the use of compensatory time and shall be permitted to use such time within a reasonable period after making the request if the use of compensatory time does not unduly disrupt the operations of the Department.

If overtime hours are compensated in cash, payment shall be made in accordance with Section 7 of the Fair Labor Standards Act. If overtime hours are compensated with time off, compensatory time shall be provided at a rate of one and one half (1 1/2) hours for each hour of overtime employment. Compensatory time may be accumulated to a maximum of two hundred and forty (240) hours. If compensation is paid to an employee for accrued compensatory time off, such compensation shall be paid at the regular rate earned by the employee at the time the employee receives the compensation. One half of all accrued Compensatory time in excess of forty (40) hours of compensatory time must be used by January 10th or the value of one half of all accrued time any hours in excess of forty (40) hours of compensatory time will be paid in cash, prior to February 1st. Notwithstanding the use/payment requirements set forth above, employees may request a waiver for exceptional circumstances such as significant medical procedures. Such a request shall be submitted to Human Resources for consideration by the Board of Supervisors and will be granted only if approved by a majority of the Board. The decision of the Board is final and is not subject to the Grievance Procedures in Article IV. Employees will be paid in cash for accrued compensatory time prior to transfer to a higher paying position. Upon termination of employment, employees who have accrued compensatory time, shall be paid for unused compensatory time at a rate of compensation not less than: (1) the average regular rate received by the employee during the last three (3) years of the individual's employment, or (2) the final regular rate received by the employee, whichever is higher.   • Overtime and Compensatory Time Overtime work shall be compensated as follows: A. Hours in an active pay status in excess of forty (40) hours in any calendar week shall be compensated at the rate of one and one-half (1 1/2) times the total rate of pay, as defined by Section 43.01, for each hour of such time. Total rate of pay includes the base rate plus longevity, all applicable supplements, and shift differential where applicable. B. An employee may elect to take compensatory time off in lieu of cash overtime payment for hours in an active pay status more than forty (40) hours in any calendar week. Such compensatory time shall be granted on a time and one-half (1 1/2) basis. C. The maximum accrual of compensatory time shall be two hundred forty (240) hours and compensatory time must be taken within one (1) year of its being earned. D. When the maximum hours of compensatory time accrual is rendered, payment for overtime work shall be made in cash. Compensatory time not taken within one (1) year shall be paid in cash to a maximum of eighty (80) hours in any pay period. E. Compensatory time is not available for use until it appears on the employee’s earnings statement and on the date the funds are made available. F. Upon termination of employment, an employee shall be paid for unused compensatory time at a rate which is the higher of: 1. The final total rate received by the employee, or 2. The average total rate received by the employee during the last three (3) years of employment. For the purposes of this Article, active pay status is defined as the conditions under which an employee is eligible to receive pay, and includes, but is not limited to, vacation leave and personal leave. Sick leave and any leave used in lieu of sick leave shall not be considered as active pay status for purposes of this Article. Compensatory time requests must be submitted in writing twenty-four (24) hours in advance of the anticipated time off, unless the need for time off is of an emergency nature.

  • Overtime/Compensatory Time A. Employees working assigned, pre-approved time in excess of forty (40) hours per week shall be given either overtime pay or compensatory time at the rate of one and one-half times the employee’s regular rate of pay. The name of the supervisor authorized to approve overtime assignments shall be posted in each building. The employee may elect to take either overtime pay or compensatory time off. Holidays, sick leave, personal days, or vacation days shall be included as regular time for purposes of computing overtime. In the event overtime is required, the Assistant Superintendent or his/her designee shall solicit volunteers to fill the overtime positions. In the event no volunteers are available or the volunteers available are unqualified in the opinion of the Assistant Superintendent or designee, overtime may be assigned. Overtime assignments will be made on a rotational basis at each work site to employees who normally do the work assigned. Reasonable advance notice will be given to employees assigned overtime. An employee shall not be called in for snow removal duty sooner than 8 hours following the conclusion of his/her regular shift or any other work performed for the District. B. Only forty-five (45) hours of compensatory time can be earned in a contract year. Use of compensatory time must be approved by the employee’s immediate supervisor. Compensatory time earned must be used during the contract year in which it is earned or cashed in for pay at the rate in effect for the employee at the time the employee receives such payment. Employees who have accumulated more than forty (40) hours of compensatory time at the time of execution of this Agreement shall retain all such accumulated time, provided, however, that such employees shall not be allowed to use more than forty (40) hours in any contract year. All compensatory time must be submitted on a timesheet. C. All overtime worked must be submitted on a timesheet to the building principal in accordance with business office procedures for processing payroll. Requests for use of compensatory time off shall be submitted in writing to the building principal in accordance with business office procedures for processing payroll. X. Xx employee called in to work on his/her day off will be paid for a minimum of two (2) hours at the appropriate rate. E. The decision to assign overtime will not be based upon an employee’s preference for either compensatory time or overtime pay. F. In the event an employee’s regular permanent assignment requires the performance of duties in more than one job classification, the overtime rate to be used to calculate compensation for the employee for the overtime work shall be the rate of the classification which caused the employee to work such overtime hours.

  • Extra Compensation The Board shall pay no fees, other than described above, to the PA/E unless authorized by the Board as follows: A. If the scope of the Project or site is changed, the Board and the PA/E shall negotiate a reasonable fee based upon the probable estimated construction cost in changing the scope of the work and the approximate percentage of the estimated construction cost which was used to negotiate this Agreement if, and, as such may be applicable. B. If the DOE or Board requires the PA/E to make major or costly changes to the Schematic, Preliminary or Construction Document Phase submittals, which changes are not caused by architectural or engineering error or oversight, the PA/E shall be paid to redesign for additional expenses in an amount agreed to by the parties. Under no circumstances will the principals of the PA/E and the principals of his consultants be paid a fee in excess of $125.00 per hour.

  • Compensatory Time Off Utilization of compensatory time off shall be by mutual agreement between the department head and the employee. The smallest increment of compensatory time which may be taken off is six (6) minutes.

  • Compensatory Time A Bargaining Unit member may choose to take compensatory time in lieu of overtime compensation if such choice is indicated during the tour of duty in which the overtime is worked. Compensatory time shall be credited to the Bargaining Unit member and accumulated at the rate of one and one-half (1 ½) hours for each overtime hour worked. Each Bargaining Unit member’s compensatory time bank shall be limited in accumulation to a maximum number of two hundred forty (240) hours. Once a Bargaining Unit member has reached the maximum hours of compensatory time as compensation for overtime hours worked, all additional overtime will be paid. The Bargaining Unit member may choose to carry over any balance into the following year. Any balance of compensatory time carried over into the following year shall count towards the two hundred forty (240) hour cap in that year. Compensatory time off must be taken at a time agreeable to the Department and the Bargaining Unit member. Approval for compensatory time off shall not be unreasonably withheld. Compensatory time off should be requested as far in advance as possible but no later than forty eight (48) hours in advance. When Bargaining Unit members request compensatory time off at least 45 calendar days in advance, the employer will, within five (5) working days of the request being made, notify the member whether or not his/her request has been approved. Approval for compensatory time shall not be unreasonably withheld. As soon as the employer notifies the member that his/her request has been approved, and if the employer determines that the shift will be filled, the employer will post the overtime assignment to cover the member’s request. If there are no volunteers to cover this need for overtime, and if the employer determines that the shift will be filled, a mandate to cover the shift will occur no less than seven (7) calendar days in advance of the beginning of the shift that needs to be covered. The employee being mandated will have the lowest number of overtime hours worked and will be notified by a supervisor. In the event the employee being mandated is on an approved leave and cannot be provided seven

  • Maximum Compensatory Time Employees may accumulate no more than one hundred and sixty (160) hours of compensatory time.
