Overtime Pay and Compensatory Time. In accordance with the Fair Labor Standards Act (FLSA), non-exempt employees shall be paid for all hours worked in a Saturday through Friday calendar week, including hours worked in excess of an employee's regularly scheduled work week. The additional work hours, however, shall be performed through the authorization of the employee’s supervisor, department director, or their designee. Employees working unauthorized hours in excess of their regularly scheduled work shift shall be subject to disciplinary action.
Overtime Pay and Compensatory Time. (a) Non-Exempt Employees Those positions that are Non-Exempt as of the Effective Date of this MOU are listed in Exhibit A, which is hereby incorporated and made a part of this MOU. All overtime worked by employees designated as Non-Exempt in accordance with the Fair Labor Standards Act must be approved in advance by the General Manager, or designated representative. Any authorized time a non-exempt employee works in excess of 40 hours a workweek shall be compensated at or granted compensatory time at, the rate of one and one-half (1 ½) times the employee’s regular straight-time rate of pay. Paid holiday and employee leave bank hours constitute “hours workedfor purposes of determining if an employee has worked hours in excess of the regular work week.” A Non-Exempt employee will be allowed to annually accrue up to a maximum of forty (40) hours of compensatory time. The maximum amount of hours a non-exempt employee may keep in their compensation time bank shall be capped at 40 hours. Overtime usage shall be subject to the District Personnel Rules, as amended from time to time.
Overtime Pay and Compensatory Time. Employees assigned to 24-hour shifts shall be paid one and one-half times their regular hourly rate of pay for all hours worked in excess of 204 in their 27-day work cycle or in excess of 24 hours in a work day. Employees assigned to 7.5-hour days shall be paid one and one-half times their regular hourly rate of pay for all hours worked in excess of 150 hours in their 28-day work cycle or in excess of 75 hours in a two-week pay period. An employee’s regular hourly rate of pay shall be based upon a 49.8 hour work week for 24-hour shift personnel and a 37.5 hour work week for 7.5-hour personnel and shall be determined by dividing the employee’s annual salary by 2598 for 24-hour shift personnel and by 1950 for 7.5- hour personnel. In accordance with the policy and practice in effect prior to the effective date of this Agreement, the provisions of this section shall not be applicable to special details (e.g., race track) which are compensated at an hourly rate established by the Village. In lieu of overtime pay, employees may elect to take Compensatory Time (“Comp Time”). Employees electing Comp Time for some or all overtime earned will have a rolling bank for Comp Time. (e.g. An employee works a 24-hour hireback and elects to take the overtime hours as Comp Time. Comp Time of 36 hours is placed in the employee’s Comp Time bank. An employee who works a 24-hour hireback on a paid holiday would be entitled to bank 48 hours of Comp Time.). This banked time may be scheduled and used as time off under the following rules:

Notwithstanding the use/payment requirements set forth above, employees may request a waiver for exceptional circumstances such as significant medical procedures. Such a request shall be submitted to Human Resources for consideration by the Board of Supervisors and will be granted only if approved by a majority of the Board. The decision of the Board is final and is not subject to the Grievance Procedures in Article IV. Employees will be paid in cash for accrued compensatory time prior to transfer to a higher paying position. Upon termination of employment, employees who have accrued compensatory time, shall be paid for unused compensatory time at a rate of compensation not less than:

General Provisions: Overtime will be scheduled and approved by the District when it determines such work is needed and will be paid in accordance with applicable laws at the rate of time and one half. Compensatory time off must be taken at a time agreeable to the Department and the Bargaining Unit member. Approval for compensatory time off shall not be unreasonably withheld. Compensatory time off should be requested as far in advance as possible but no later than forty eight (48) hours in advance. When Bargaining Unit members request compensatory time off at least 45 calendar days in advance, the employer will, within five (5) working days of the request being made, notify the member whether or not his/her request has been approved. Approval for compensatory time shall not be unreasonably withheld. As soon as the employer notifies the member that his/her request has been approved, and if the employer determines that the shift will be filled, the employer will post the overtime assignment to cover the member’s request. If there are no volunteers to cover this need for overtime, and if the employer determines that the shift will be filled, a mandate to cover the shift will occur no less than seven (7) calendar days in advance of the beginning of the shift that needs to be covered. The employee being mandated will have the lowest number of overtime hours worked and will be notified by a supervisor.
