Town ResponsibilitiesThe Town will:  Select the specific section of Town road to be adopted.  Provide safety vest, "Road Work" signs, transparent trash bags, safety information and training, flags and traffic cones.  Erect sign(s) with the group's name displayed at the beginning of each adopted section of road unless, in the opinion of the Town, erecting the signs would jeopardize the program, be counter-productive to its purpose, create a hazard to the safety of the public, or be in conflict with government or Town policies.  Remove and dispose of filled trash bags. Remove litter from the adopted road section under unusual circumstances (i.e. to remove large, heavy, or hazardous items) that have been flagged.  Monitor to ensure the objectives of the program are being met.  Approve the name, titles, or words placed on ADOPT-A-ROAD signs. The ADOPT-A-ROAD agreement or program may be modified in scope or altered in any manner at the discretion of the Town. Participants/Groups will have the option of renewing their agreement, subject to the approval of the Town and continuation of the program. Updated participant information is required at the time of the renewal. The Town may terminate the agreement and/or remove the ADOPT-A-ROAD signs bearing the participant's name it is found that:

Town Responsibilities. 1. The Town shall approve their own fire department members and incident commanders, including designations within their fire command structure. 2. The Town shall have the authority, in any circumstance deemed necessary, to call upon mutual aid resources, to respond to an emergency in the Three Hills Fire District. 3. The Town shall have the authority to decide how resources will be deployed should two occurrences happen at or near the same time in either of the municipalities, and that mutual aid for manpower and equipment will be put in motion. 4. The Town shall be responsible to ensure that the apparatus and equipment are kept in good condition, and meet NFPA standards where applicable. 5. As majority share owner, the Town will retain title and ownership to the Rescue, Command, Engine 5-1, and will be responsible for all required safety inspections, repair of said truck, and maintenance of the radios installed in the said truck. The Town will also be responsible to coordinate the replacement of the said truck. 6. The Town will be responsible for their proportionate share of insurance coverage as per the established ownership percentage of apparatus identified in Schedule B. 7. The Town will be responsible for their proportionate share of rental equipment, if necessary, coverage as per the established ownership percentage of apparatus identified in Schedule B. 8. The Town agrees that the County will be the managing partner for E – 911 call dispatch services and they will pay to the County their proportionate share of the service as outlined in Schedule B. 9. The Town will assume full and complete responsibility for the xxxxxxx and operation of their fire department and will ensure there is sufficient manpower, equipment, supplies and training available to provide protection to the district. The Town will ensure that all members operating vehicles have the necessary licensing to do so. 10. The Town will provide apparatus storage for all units as described in Schedule B. 11. The Town will carry life and/or accident insurance for all of their firefighter members. 12. The Town will be responsible for Worker’s Compensation Board coverage for their own fire fighters and/or volunteer fire fighters. The Town may have their own set of administrative compliances with respect to Occupational Health and Safety, however all Members will comply with OHS AB Regulations. 13. Town Responsibilities a. The Town is hereby appointed and authorized to perform all or any of the following services on behalf of CCPSA. i. Financial Asset Custodian ii. Accounts Payable iii. Accounts Receivable iv. Bank Statement Reconciliation v. Financial Recordkeeping b. The Town shall maintain a system of books and records which is adequate for the financial and tax reporting needs and requirements of CCPSA. c. Such books and records shall be maintained at the Town’s principal office or any other place designated and shall be available for examination by an authorized representative of CCPSA at any reasonable time. d. The Town shall provide to CCPSA, from time to time, on reasonable demand copies of any such books and records. e. The Town shall provide to CCPSA with such reports and statements concerning financial performance at such intervals as agreed between them. f. The Town shall remit payment on submitted and adequately approved invoices at an agreed upon periodic schedule. g. The Town shall reconcile all bank statements belonging to CCPSA in a reasonable interval after receipt. h. In performing services, the Town shall exercise the same degree of care as it exercises in respect of its own property except to such extent as may be otherwise provided in this agreement. i. The Town shall be responsible for contracting performance of an annual audit of financial reporting of the fiduciary accounts held on behalf of CCPSA during its own audit review at no charge to CCPSA. j. Should the Town note any irregularities in the documentation submitted with regarding to CCPSA transactions it shall notify the Policy Board. k. The Town shall not be responsible or liable for any loss, failure or delay in the performance of its obligations under this Agreement arising out of or caused directly or indirectly by circumstances beyond its reasonable control including without limitation, acts of God, loss or malfunction of utilities, computer (hardware or software) or communications services, accidents, regulatory changes, or acts of the government. l. The Town may, at its discretion, accept instructions reasonably believed to have emanated from authorized persons in which case, if it acts in good faith on such instructions, such actions shall be binding on CCPSA and the Town shall not be liable for doing so, whether the instructions were given by the authorized person.
Town Responsibilities. 2.1. Town will assume responsibility for the bidding and construction phases of the PROJECT. 2.2. Repayment of any loan either through the Municipal Bond bank or through the Clean Water State Revolving Loan Fund will be the responsibility of the TOWN. The TOWN will use the proceeds from any special assessments levied on the property owners in Meadowridge to cover all costs associated with the loan and other related expenses as provided for in 24 V.S.A. Chapter 87. 2.3. TOWN will maintain adequate financial records for the PROJECT including the disbursement and receipt of the Loan funds within the TOWN’S depository account. 2.4. TOWN shall take those actions necessary to obtain the Construction Loan funds; and 2.5. Upon expiration of the twoone year warranty and one year grace period following final completion of the Construction Contract and correction of replacement of any deficient work and materials, TOWN shall accept the work on behalf of the ASSOCIATION.
Town Responsibilities. A. Prior to the SIGNS being manufactured, the TOWN shall submit design drawings for the SIGNS to MDOT SHA for approval. B. The TOWN shall provide MDOT SHA with four (4) sets of proposed final PROJECT plans for review and comment, and MDOT SHA shall have final authority regarding approval. C. Prior to entering upon MDOT SHA’s right-of-way, the TOWN shall, on behalf of itself and its agents, contractors, and/or assigns, apply for, obtain, and comply with the PERMIT as referenced in Section II., Subsection C., above, for the purpose of performing the installation and maintenance activities as described herein. D. The TOWN shall be responsible to install the SIGNS in a manner acceptable to MDOT SHA. E. The TOWN shall be responsible for the design, installation, and maintenance costs of the SIGNS. F. The TOWN shall be responsible for the performance of maintenance activities on and around the SIGNS including, but not limited to, the activities described in the list incorporated herein and attached hereto as Exhibit B. G. The TOWN shall take action to correct any issues concerning the maintenance as directed by notification from MDOT SHA or the TOWN’s awareness of the need for maintenance. H. If the TOWN fails to take corrective action within five (5) business days of notification and MDOT SHA must perform any corrective action as to the maintenance, the TOWN shall reimburse MDOT SHA within thirty (30) days of receipt of any invoice for all documented costs incurred by MDOT SHA for such corrective action, including MDOT SHA’s direct salary and payroll burden, and overhead. If payment of the overdue amount is not received within thirty (30) days of the TOWN’s receipt of the invoice, MDOT SHA will then notify the TOWN in writing that MDOT SHA may make a deduction from the TOWN’s share of Highway User Revenue equal to the overdue invoice amount(s) or may refer the overdue amount to the Central Collection Unit, at 000 Xxxx Xxxxxxx Xxxxxx, Room 500, Baltimore, MD 21201-2365 for collection of the overdue amount. I. During the term of this MOU and the PERMIT, the TOWN shall provide written documentation that it, or any agent or contractor procured by the TOWN to perform the work of the PROJECT, (i) carries a valid insurance policy, with as a minimum, the following limits: $1,000,000 for general liability and $1,000,000 for automobile liability; (ii) has added MDOT SHA and the State of Maryland as additional named insureds; and (iii) has a policy that may only be cancel...

The TOWN agrees to provide the CONSULTANT with all the information, surveys, comments, reports, and professional recommendations requested by the CONSULTANT in order to provide its professional services.
