Bargaining Unit Definition. The bargaining unit shall include full-time and part-time instructors (as described in the certification statement of BCGEU Local 701 Camosun College) employed by the College to teach vocational, technical and trades training programs or courses.

A new classification assigned duties that are a significant part of the work done by any classification currently in the bargaining unit shall be within the bargaining unit. The College shall inform AFSCME of any intention to place a new job classification in a bargaining unit. During the term of this MOU, if a new job classification(s) is created or the status of a classification within one of the bargaining units has changed, the College shall notify the Union at least sixty (60) days prior to the intended date of entry. If it is believed that the bargaining unit status of a position has changed, the College or the Union, whichever is proposing the change, shall notify the other as soon as possible. The parties will meet and attempt to resolve any disagreements concerning the relation of the position or classification to the bargaining unit. Any unresolved dispute between the parties regarding whether or not a position or positions should be included in the bargaining unit covered by this MOU may be submitted to the SHELRB by either party pursuant to its regulations. The decision of SHELRB shall be final and binding on both parties, as subject to any appeal rights provided by law or regulation.
Bargaining Unit Definition. Unless otherwise noted, the provisions of this Agreement shall apply to all full-time employees of the University Police Division in the civil service classification of University Law Enforcement Officer (hereinafter referred to as “ULEO” or “Officer”), and University Law Enforcement Officer Supervisor (ULEO Supervisor), which includes all full-time employees with the working title of “Lieutenant” and all full-time employees of the University Police Division in the civil service classification of Police Manager, which includes all full-time employees with the working title of “Captain” (hereafter referred to collectively as “Bargaining Unit Members”). Some provisions in this agreement may only apply to ULEO/Officers, Lieutenants and/or captains. Any such provisions will specifically refer to those working titles individually. The bargaining unit consists of all Adult Xxxxxx Care Home Providers as defined in this Section, excluding substitute caregivers, employees of the Provider and Providers who do not live in one of their adult xxxxxx care homes and other employees excluded from the protection of the Public Employee Collective Bargaining Act.
A. For purposes of this Agreement, the term "Adult Xxxxxx Care Home Provider" means:
(I) any natural person who:
(i) is licensed to and provides adult client services in and lives in the Provider’s home; and
(ii) receives service payment from state funds under Department of Human Services/Oregon Health Authority Adult Xxxxxx Home Programs; or
(II) any natural person who:
(i) is licensed to and provides adult client services in and lives in the Provider’s own home; and
(ii) owns a controlling interest in, or is an officer or partner of, an entity (e.g., corporation, Limited Liability Corporation (LLC) or partnership) that receives service payment from state funds under Department of Human Services/Oregon Health Authority Adult Xxxxxx Home Programs for services provided in such Provider’s own home.
B. For purposes of this Agreement, the following definitions apply: • "own home" means one's full-time domicile that is the licensed Adult Xxxxxx Home and where the Provider customarily and regularly conducts his or her activities of daily living, e.g., sleeping, eating, bathing, and recreating at that domicile. This language does not mean that the Provider is required to be present twenty-four (24) hours a day or seven (7) days a week, but rather is meant to clarify that a Provider resides on a full-time basis with a state- funded resident at that licensed domicile.

Bargaining Unit Definition. The bargaining unit shall include custodial, maintenance and food service employees who are employed at the colleges of technology in Billings, Butte, Great Falls, Helena and Missoula in positions and classifications within the bargaining unit as defined and certified by the Board of Personnel Appeals or as mutually agreed to by the parties.
