Bulletining and Filling Positions. 12.1 Permanent positions and positions temporarily vacated for an anticipated period of more than twenty-five (25) days which require to be filled shall be bulletined.
12.2 The Corporation shall select the candidate it considers the best qualified for appointment to a bulletined position. Subject to this overriding factor, applications of employees in the Bargaining Unit (in order of their seniority) shall be given preference before applications from outside the Unit are considered, for all positions certified within the Unit, including those of a same hierarchical level as that of the candidate. In the absence of any qualified candidates from within the bargaining unit, the Corporation may then select candidates from outside the bargaining unit. In situations where the spread in the final evaluation scores amongst the candidates for positions bulletined under this Article, is five (5) percentage points or less, or where the senior applicant is not selected, the Corporation, five (5) days prior to announcing an appointment, will meet with the Union to review the results of the selection process, and the reason for the selection of the successful candidate. In order to facilitate this, the Corporation will provide the Union with the final evaluation scores for each candidate. Should the Union disagree with a selection, it may initiate a grievance at Step 2 of the grievance procedure. Should the Union disagree with the outcome from the Step 2 grievance, it shall have the right to take the issue to arbitration. To ensure as consistent a selection process as possible, the Corporation will maintain comparable selection systems for a given occupation in both Regions.
12.3 When a newly created position has been bulletined as temporary, it will be re-bulletined as permanent after ten (10) months, or when it is known that it will last for more than ten (10) months.
12.4 At the expiration of a temporary assignment, an employee shall be returned to his former position.
12.5 When a permanent vacant position is to be abolished within the Bargaining Unit, the Corporation will provide written notice to the Local Chairperson with the reasons for doing so twenty-five (25) days prior to the abolishment.
12.6 Employees returning from vacation or short term sick leave may make application for positions bulletined during their absence provided a successful candidate has not yet been chosen. A file of these bulletins shall be made available to the employees upon request.

(a) Except as provided in clause hereof, temporary vacancies, newly created positions or seasonal positions, any of which are known to be of more than calendar days duration, and vacan- cies in permanent positions shall be bulletined in the respective seniority groups within days of such vacancies occurring, or new positions being estab- lished. Temporary vacancies, or new positions of indefinite duration (except those which are known to be of more than calendar days) need not be bulletined until the expiration of calendar days. Prior to that time they will be covered by the provi- sions of Article Positions of janitors, will not be bulletined ex- cept that when a vacant position of janitor is not filled by an incapacitated person in accordance with Article and it is considered that the position is still required, it shall be bulletined in the normal man- ner. The bulletin shall show. location, general de- scription of duties, rate of pay, hours of assignment of the position, and, if temporary, the approximate duration, and shall be posted for seven days in places accessible to all employees affected. Copies of all bulletins issued under this rule shall be fur- nished to the National Representative. When the regularly assigned starting time of a permanent position is changed two hours or more, or the rate of pay is decreased, or the assigned rest days are changed, the holder of such position shall have the right to vacate the position within 7 days from the effective date of such change, and exercise his or her seniority rights, the same as though the position were abolished. c l e Temporary vacancies, seasonal positions and newly created positions, when known to be for calendar days or less will not be bulletined. However, suitable advance notice will be posted at the station or terminal affected. Such position shall be awarded to the qualified senior employee who makes applica- tion within five calendar days from the date notice is posted. Applications from regularly as- signed employees shall only be accepted when it is known the vacancy is for five working days or more and when it involves one of the following:
(a) An increase in rate of pay; A change in shift; A change in rest day or days. When other qualified employees are available regu- larly assigned employees will not be allowed to com- mence work on a temporary vacancy and their reg- ular assignment on the same day.

(a) All vacancies and appointments for 60 days or over will be bulletined promptly over the entire Railway and when allotted shall be known as Established positions. A position bulletined as temporary after having been continuously established for one year shall be bulletined as a permanent position, unless it is known at the time that the position will only continue to be required temporarily; if it is known prior to the expiration of one year that the position will be required permanently, it shall be so bulletined, except in cases of sickness.
(b) When there are positions working at different locations which do not require that the entire shift(s) be covered, the Company may bulletin such positions as one assignment.
3.2 When vacancies are bulletined the bulletins shall be numbered consecutively each year and shall state whether permanent or temporary, the rate of compensation, and whether or not the Railway supplies a dwelling. Applications for permanent vacancies must be filed within 10 calendar days from the date of bulletin and date of bulletin must coincide with date of first transmission. Example - A bulletin transmitted on the first of the month would expire at 12:00 midnight on the 11th.
Bulletining and Filling Positions. 12.1 a) Permanently vacated permanent positions shall be bulletined to the seniority group affected within ten (10) days of their becoming vacant, and the date of assignment provided for in Article 12.12 shall be within twenty-eight (28) days of the vacancy, or such longer period as is mutually agreed, except in cases where the vacancy has to be re-bulletined or in cases where the duties of the position are operational duties. In the latter case, where the vacancy occurs during the non-navigation season, the twenty-eight (28) day period may be deemed to expire the date of the opening of the next navigation season.
Bulletining and Filling Positions. 12.1 a) Permanently vacated permanent positions shall be bulletined to the seniority group affected within ten (10) days of their becoming vacant, and the date of assignment provided for in Article 12.7 shall be within twenty-eight (28) days of the vacancy, or such longer period as is mutually agreed, except in cases where the vacancy has to be re-bulletined.
Bulletining and Filling Positions. 5.1 Vacancies in permanent positions, temporary vacancies, newly created positions or seasonal positions, any of which are known to be of more than sixty (60) calendar days duration, shall be bulletined 3 calendar days and claimed by the senior qualified employees in the respective seniority groups within ten (10) days of such vacancies occurring, or new positions being established. Temporary vacancies or new positions of indefinite unknown duration, shall be bulletined to the system after the expiration of sixty (60) calendar days.
5.2 When vacancies occur, new jobs are created or additional staff is required for an expected period of 60 calendar days or less, such vacancies or new positions shall be bulletined for 3 calendar days and claimed by the senior qualified employees in the respective seniority group at the terminal; the local committee to be consulted in each case. Terminal means: North Bay, Cochrane, etc. Applications from regularly assigned employees shall only be accepted when it is known the vacancy is for five (5) working days or more. Vacancies of less than 5 working days shall be filled by spare employees when available and if required.
5.3 (a) Assigned employees filling positions under 5.2 shall be considered as temporarily assigned and on completion of such temporary positions shall return to their former assignments. He/she may, however, displace a junior employee on any other temporary assignment that was bulletined after they assumed the just completed assignment, before returning to his/her regularly assigned position.

Vacancies in regularly assigned positions or newly created positions other than the lowest classification in that division or department that will be of more than thirty (30) days duration shall be posted for five (5) working days on all regular bulletin boards within ten (10) working days after such vacancies occur, or such new positions are established. The daily hours and workweek of the vacant position will be included in the posted bulletin.
Section 2. Unit employees desiring such positions shall, within five (5) working days after bulletin is posted, apply in writing to the appropriate division head on forms provided by the department.
Section 3. Within fifteen (15) working days after the expiration of the advertising bulletin, appointments shall be awarded by the appointing authority. The name of the appointee shall be bulletined on all regular bulletin boards. Copies of this bulletin shall be furnished to the Shop Xxxxxxx.
Section 4. The Town of Framingham will make its best effort to promote the most qualified person to all its positions. When, in the opinion of the department head, there are qualified candidates for promotion who are relatively equal in qualifications, the most senior employee will be promoted. The following factors, in addition to others, will be considered in determining the best- qualified candidates for promotion:
1. A yes or no determination on whether the candidate meets the minimum requirements of the position relative to the mutually agreed upon job descriptions at the time of posting.
2. The actual amount of experience in duties performed at industry standards quality in duties listed under MAJOR DUTIES in the job description.
3. The ability to demonstrate the performance of functions in the major duties in the job description. The Union may have one observer to insure quality of tests.
4. Level of education and specialized education and training directly related to the MAJOR DUTIES listed in the job description.
5. The relative differences in the last two Performance Evaluations.
6. Unscheduled emergency work availability.
7. Reported accident history on the job.
8. If CDL required for position, the moving violation record on or off the job pursuant to procedures spelled out in section 383.31 Subpart C and section 383.33.

Applications must be filed to reach the designated officer not later than the tenth day after the date of bulletin. As evidence that an application has been submitted, a copy of the application must be forwarded to the Local Chairperson by the employee.
