BUMPING AND RECALL. Recall: It is understood and agreed that while persons who are laid off are not subject to the terms of this agreement, they shall, as long as their name remains on the seniority list, be subject to recall. Laid-off employees shall be recalled by courier or registered mail and shall return to work within five (5) calendar days of their receipt of the recall notice (unless otherwise reasonably prevented from doing so) or they shall forfeit their seniority. It shall be the duty of the employee or laid-off person to notify the Company promptly, in writing, of any change of address or telephone number. If an employee or laid-off person should fail to do this, the Company will not be responsible for the failure of a notice to reach the employee. Where it becomes necessary to reduce the workforce, employees with seniority within the affected area (job classification), will be laid off in reverse order of seniority. Probationary employees shall be laid off first. In the event of a route cancellation the displaced employee shall be able to bump any employee of lesser seniority within their classification site or satellite. This process of bumping by seniority shall continue until no positions remain within the affected classification site or satellite at which point Article shall apply. Employees who have been laid off, bumped or experience a substantial decrease in earnings may exercise their right to bump either the most junior full-time driving employee or full-time non-driving employee for which they are qualified within their own site or satellite. A laid off employee shall be able to displace the most junior employee in any classification in their site or satellite provided the employee has the required licences and ability to perform the job or Laid off employees will have the option to claim the severance pay immediately and terminate their employment with the Company or to accept six (6) months layoff status and receive the severance pay upon expiration of the six (6) months recall. period if they have not been recalled back to work, or be placed on the spare board where applicable. The qualifications are defined as the necessary training, experience, skill and ability to perform efficiently the remaining required work, as to be determined by the Employer. Employees laid-off or displaced will be allowed to bump into a job which is equal to, or lower, than the pay level of their current classification for which they have the seniority and the qualifications within their professional or technical classification. The qualifications are defined as the necessary training, experience, skill and ability to perform efficiently the required duties, as to be determined by the Employer.
BUMPING AND RECALL. When a regular driver is laid off due to a reduction in the work force, the regular driver will be permitted to exercise seniority rights to bump the least senior regular driver whose job(s) (s)he is qualified to perform. Any laid off regular driver shall be placed in a substitute status but shall retain regular route driver status for bidding purposes for sixteen (16) months following layoff (date last worked). When a laid off driver is offered a regular route and refuses to take it, the driver forfeits his rights of recall.
