Employment and Staffing. 7.1. Non-discrimination in Employment and Service Bedford TV shall adhere to state and federal laws as they may apply regarding equal opportunity and shall not discriminate against any person or applicant for employment or for the provision of services as subcontractor or in the delivery of services on the basis of age, race, color, creed, religion, sex, sexual preference, marital status, ancestry, national origin or physical or mental handicap.
Employment and Staffing. 56Employees Details relating to existing Transferring Employees are set out in part 1 of Schedule 4. These details are believed to be correct at the date hereof but the Council does not give any guarantees or warranties in this respect. Without prejudice to clause 56.4 the Council shall be responsible for all salaries and other emoluments including but without limitation holiday pay, tax and National Insurance payments allowances and contributions to retirement benefit schemes in respect of the Transferring Employees up to but not including the Commencement Date and all requisite apportionments shall be made. The Organisation shall employ all the Transferring Employees on broadly comparable terms and conditions as to pension and death-in-service benefits and it is acknowledged by the Organisation that some of the Transferring Employees are members of the local government statutory superannuation scheme to which the Council belongs. The Council shall indemnify and hold harmless the Organisation against each and every cost, claim, liability, expense or demand arising out of: anything done or omitted to be done prior to the Commencement Date by or on behalf of the Council in respect of any contract of employment or any collective agreement or any persons employed in the Undertaking which notwithstanding that it relates to employment prior to the Commencement Date is deemed by reason of transfer of the Undertaking pursuant to this Agreement to have been done or omitted to be done by or in relation to the Organisation in accordance with the Regulations, the failure of the Council to pay any of the Transferring Employees any sums properly due by it in respect of the period prior to the Commencement Date, any claim by any trade union, staff association or staff body recognised by the Council in respect of all or any of the Transferring Employees arising out of the Council's failure prior to Commencement Date to comply with its legal obligation in relation to information and consultation to or with such trade unions or staff associations or bodies save insofar as any such failure results from a failure by the Organisation to provide information as required pursuant to the Regulations. Employment and Staffing. The Consultant shall maintain an office located within a reasonable distance of the project location(s) assigned under this Contract. Such office shall be staffed with professional personnel adequate in number, training and experience to perform the services required by this Contract. Prior to commencing services, the Consultant shall submit the names, titles and salary rates of personnel to be assigned to the project. In addition, education and experience records of key personnel, who will actively participate in the Project shall be submitted, if so requested by MassDOT. If,at any time- during the term of this Contract, a key position is vacated, notice shall be immediately sent to the Engineer as to the person vacating the position and the name, title, education, experience record and rate of pay of the person who will fi ll the vacancy. MassDOT reserves the right to disapprove key personnel staff changes proposed by the Consultant. ·Authorized representatives of MassDOT (and FHWA) may inspect or review the Consultant's in process design work. Plans and documents, including those in the formative stage, shall be readily available in the Consultant's local office during normal working hours. Every person employed in the work covered by this Contract shall lodge, board or trade where and with whom he/she elects, and neither the Consultant nor its agents or employees shall directly or indirectly require, as a condition of employment therein, that an employee shall lodge, board or trade at a·particular place or with a particular person. MassDOT personnel are not allowed to be under the employ of the Consultant to perform any portion of the work of this Contract.
