Employment Pool. All certificated employees who are not recommended for retention in accordance with these procedures shall be placed in an employment pool for possible re- employment for a period of up to twenty-four (24) months from when they were placed on layoff status. Employment pool personnel shall be given the opportunity to fill any open positions for which they are qualified, as they occur. If more than one such employee is qualified for an open position, the criteria shall be applied as stated in section E. After district hiring procedures have been followed – if a vacancy still exists, and if a qualified employee is still in the pool – they shall be given the position as a voluntary assignment. There shall be no challenge to the unemployment compensation of any bargaining unit member on layoff status who declines substitute employment, except those individuals who have already been accepting substitute employment. By March 1 of each year, the District shall send by certified mail to each employee in the pool, a form to be signed by the employee to indicate his intent. If such notification is not received, the name of any certificated employee shall be dropped from the employment pool. It shall be the responsibility of each certificated employee placed in the employment pool to notify the Superintendent in writing, by April 1, if such employee wishes to remain in the employment pool. Employees in the employment pool have the responsibility to maintain a current mailing address with the Payroll Officer. When a vacancy occurs for which person(s) in the employment pool qualify, notification from the District to such individual shall be by certified mail with return receipt or by personal delivery. Such individual shall have seven (7) calendar days from receipt of the letter to accept the position. Between August 1st and October 1st: if all avenues to reach an employee within seven (7) days fails – the employee is unable to be reached – the position will be considered “declined.” If an individual fails to accept such position offered, such individual shall be dropped from the employment pool. Teachers who were previously assigned to full-time teaching positions shall be recalled to full-time teaching positions provided that such teachers shall have the option of accepting or rejecting any part-time teaching position that may exist without jeopardizing such person’s recall status for any full-time position which may become available. If such notification is not received, the name of any such employee shall be dropped from the employment pool. 3. When a vacancy occurs for which person(s) in the employment pool qualify, notification from the District to such individual will be by certified mail or by personal delivery. Such individual will have five (5) calendar days from the receipt of the letter to accept the position. If an individual fails to accept a position offered, such individual will be dropped from the employment pool. 4. The District will utilize employment pool personnel as substitutes on a first priority basis if the employee so requests. Refusal by an employment pool person to accept substitute employment shall in no way jeopardize his/her recall rights.
Employment Pool. A certificated employee receiving written notification of layoff shall retain an employment relationship with the District by being automatically placed on layoff and recall status. Credit for any education acquired during that year will be granted. Acceptance of contract employment as a certificated employee in any other school District while on layoff status shall constitute an automatic termination of the employment relationship as provided herein. Any employee accepting a temporary position shall not forego his/her seniority recall option in the event a permanent position becomes available. No certificated employee will be hired by the District from outside of the bargaining unit until all employees on layoff status shall have been determined to not be qualified for the position. Employment of substitutes shall come from those employees on layoff status except when no qualified employee is available. Upon the request of a certificated employee, the District shall make provision for the continuance of an employee’s participation in any District group insurance program. The entire premium required shall be paid by the employee to the District business office on a monthly basis as required by the business office.
Employment Pool. A. All certificated employees who are non-renewed shall be placed in an employment pool for re- employment. B. Staff members will be re-employed as vacancies occur in accordance with the ranking under Section C in reverse order. When a vacancy occurs, notification from the school District to the appropriate individual will be by certified or registered mail. Such individual shall have ten (10) calendar days from receipt of the letter to accept re-employment. C. Staff members whose names are in the employment pool will be given, upon request, preferred consideration in the District's day to day employment of substitute certificated employees. D. The individual employee shall remain in the employment pool, provided that the employee shall have in writing, notified the Superintendent of his/her intent to remain in the pool by April 1 of each year.

Employment pool personnel will be given the opportunity to fill open positions within the endorsed areas for which they are qualified. If more than one (1) such employee is qualified for an open position, the criteria as set forth herein shall be applied to determine who shall be offered such position. 6.2 It shall be the responsibility of each employee placed in the employment pool to notify the Superintendent by the first work day of each month of his/her current mailing address and availability for work if there has been a change from the previous month. 6.3 When a vacancy occurs for which a person (s) in the employment pool would qualify, notification from the school district to such individual will be by certified mail to the address last given by employee or by personal delivery. 6.4 Employees so notified shall accept or reject the recall within five (5) working days of notification and be available for work within ten (10) working days. If no response is received from an employee, the District will consider the recall rejected. If the employee rejects the recall assignment, he/she shall be dropped from the list and lose all rights for reemployment. 6.5 An employee on authorized leave at the time a reduction in force is implemented will be reinstated upon return from leave if he/she would not have been affected by the lay off and will be laid off if he/she would have been affected by the lay off.

If more than one such employee is qualified for an open position, the criteria set forth in Section 9.3.1 shall be applied in inverse order to determine who shall be offered such position. 9.4.2 A certificated employee placed in the employment pool shall notify the Superintendent or his/her designee in writing between March 1 and March 15 of each year if the employee wishes to remain in the pool and eligible for re-employment. If the Superintendent is not so notified, the person shall be dropped from the employment pool. 9.4.3 When a vacancy occurs for which an individual in the employment pool qualifies, the District shall so notify the person by certified mail at the employee’s last known address or by personal delivery. The teacher shall have ten (10) working days from the receipt of notice of such vacancy to accept the position. If the individual fails to accept the position offered, he/she shall be dropped from the employment pool, except that an employee enrolled in graduate work at the time of notification may refuse one offer without being dropped from the employment pool. 9.4.4 While in the employment pool, a person may continue in the District fringe benefit programs for which legally qualified. Such continuance shall require reimbursement to the District of the District's cost of the program(s) in advance by the first day of each month. 9.4.5 During the period the employee is in the employment pool, any credits completed shall be used in determining the employee's position on the salary schedule. 9.4.6 Employees whose names are in the employment pool shall be given, upon request, preferred consideration in the District's day-to-day employment of substitutes.

Such individual will have ten (10) calendar days from receipt of the letter to accept the position. d. Members of the employment pool will have first priority for substitute positions for which they are qualified. e. All benefits to which an employee was entitled at the time of his/her lay-off, including unused accumulated sick leave will be restored upon his/her return to active employment, and the employee will be placed on the proper step of the salary schedule for the employee’s current position according to the employee’s experience and education. f. Certificated personnel within the employment pool may continue their insurance benefits pursuant to their federal COBRA rights and the requirements of the School Employees Benefits Board.
