Extended Personal Illness Leave. Extended paid leave shall be provided to teachers as follows:

The period of probation for a teacher will be extended in accordance with the length of leave of absence pursuant to the Colorado Revised Statutes 00-00-000.

Any teacher, after using their accumulated paid personal illness leave and who is still unable to work due to illness or injury, shall be entitled to extend personal illness leave, subject to verification every three (3) weeks from a health practitioner licensed by the state. Extended personal illness leave shall begin after all accumulated paid personal illness leave has been used and shall extend no more than five (5) calendar months (calculated as 152 calendar days) during the school year. During the period of extended personal illness leave, the bargaining unit member shall receive partial pay equal to the difference between their regular pay and the daily substitute rate. If no substitute is employed, the bargaining unit member shall receive partial pay equal to the difference between their regular pay and the daily substitute rate. A bargaining unit member shall not be provided more than one (1) five (5) month period per illness or accident in any school year. If a school year terminates before the five (5) month period is exhausted, the bargaining unit member may take the balance of the five (5) month period in a subsequent school year. When a bargaining unit member has exhausted all available sick leave, including accumulated sick leave, and continues to be absent on account of illness or accident for a period beyond the five (5) month period, and the bargaining unit member is not medically able to resume the duties of their position, the bargaining unit member shall be placed on a reemployment list for a period of twenty-four (24) months if the bargaining unit member is on probationary status, or for a period of thirty-nine (39) months if the bargaining unit member is on permanent status. When the bargaining unit member is medically able, during the twenty-four (24) or thirty-nine (39) month period, the bargaining unit member shall be returned to employment in a position for which they are credentialed and qualified. The twenty-four (24) or thirty-nine (39) month period shall commence at the expiration of the five (5) month period provided above. In the absence of a vacancy this may require placement in the substitute pool at the applicable rate of pay. a. Request for such leave must be accompanied by a statement from an attending physician that such leave is medically necessary.
b. Request for such leave must also be approved by the Department of Employee Benefits. An external consultant may be used, but the District will make the final decision.
c. Upon return from such leave, a teacher will be assigned to the same position, if available, or, if not, to a substantially equivalent position. When required by law, the District will return the teacher to the vacated or equivalent position with equivalent employment benefits, pay and other terms and conditions of employment. If a position is held for the teacher’s return, it shall be held for a maximum period of one (1) year, unless otherwise required by law.
d. Certain teachers are eligible for benefits under the Family and Medical Leave Act (FMLA). The District shall require FMLA-eligible teachers to utilize their FMLA leave concurrently with such leave. The District shall at the time of approving the teacher’s request for such leave, give the teacher written notice specifying which portion of such leave will be designated as FMLA leave. Other provisions of FMLA and District policy may apply to the FMLA portion of the leave.
Extended Personal Illness Leave. 1. Any teacher whose personal illness extends beyond the period of accumulated and extended sick leave will, upon written application and approval of the Superintendent, be granted an unpaid leave of absence for such time as is necessary for complete recovery from such illness, up to a maximum of four (4) years. Such request for leave of absence shall be granted for up to one (1) year and must be supported by a physician's certificate. The leave may be renewed and each subsequent request for renewal shall also be supported by a physician's certificate. At the end of four (4) years, the teacher's employment may be terminated, subject to the applicable tenure provisions of the New York State Education Law.
2. Employees returning to active teaching after such leave will, upon request, furnish the Board with a doctor's certification indicating fitness to return to full employment.
3. Employees exhausting accumulated sick leave who are ill but do not request personal illness leave of absence may be placed on inactive status for a period not to exceed (4) years and then dismissed for neglect of duty, subject to the applicable tenure provisions of the New York State Education Law.
Extended Personal Illness Leave. When any Teacher exhausts all accumulated paid leave and temporary disability leave time during an extended illness while under the care of a physician, the Teacher may apply for an extended personal illness leave for up to 175 teaching days for that illness. If granted by the Board, said leave shall be without pay. Requests for such discretionary leave shall be made in accordance with Article 4.16 of this Agreement and shall be subject to all the terms and conditions set forth in that Article.
