Responsibilities of Resident. A Resident is an individual who is providing health care services to patients during the period the Resident is receiving training in a medical specialty. Resident shall meet the qualifications for resident eligibility as outlined by the Accreditation Council of Graduate Medical Education (ACGME) requirements. Resident agrees to become familiar with and abide by all applicable DCHD and UTSW policies, procedures and rules. As the position of Resident involves a combination of supervised, progressively more complex and more autonomous patient evaluation, medical and surgical management within the scope of training for Resident in a given specialty and formal educational activities, the academic, clinical and professional competence of the Resident is evaluated on a regular basis by the UTSW training program. The UTSW training program manages and maintains a record of Resident’s evaluations, which are confidential to the extent allowed by law. The position of Resident entails provision of care commensurate with the Resident’s level of advancement and competence, while under the supervision of appropriately credentialed and privileged attending faculty. The Resident’s educational activities may include without limitation: participation in safe, effective and compassionate patient care; developing an understanding of ethical, socioeconomic, medical and legal issues; applying cost containment measures in the provision of patient care; participation in the educational activities of the training program as appropriate; responsibility for teaching and supervising other residents and students; participation in institutional orientations, education programs and other activities involving the clinical staff; participation in institutional committees and councils to which the Resident is appointed or invited; and such other responsibilities as are assigned from time-to-time. Resident must perform these duties in accordance with the established practices, procedures and policies of DCHD, UTSW, and other institutions to which the Resident is assigned. The Resident agrees to provide appropriate and conscientious care to his/her patients, to cooperate with patient care, patient safety, quality improvement and safety directives issued by DCHD, and to discharge all duties of a Resident as determined by DCHD.

Responsibilities of Resident a. Resident is required to respect the privacy and lot lines of other resident's lots. Resident, members of resident’s household, and any guests shall conduct themselves in a way that does not disturb other residentspeaceful enjoyment of the park and shall refrain from illegal activities. Resident shall be responsible for the activities and behavior of persons residing with Resident including any guests. b. Resident shall not cause the Lot or any part of the park to be out of compliance with the terms of this Lease, or applicable State or local regulation. Resident, members of resident’s household, and any guests shall not deliberately or negligently destroy, deface, damage, alter or remove any fixture, mechanical or utility system, or furnishing. c. Resident shall maintain his/her mobile home free from rats and reasonably free from insects, vermin and other pests. d. Household waste that is placed outside the mobile home shall be stored in watertight, and to the extent possible animal-proof, receptacles of metal or other durable materials with tight fitting covers. No household waste shall be stored or accumulated under or around the mobile home or in any structure. e. Upon the termination of this Lease, Resident will leave the Lot in as good a state of condition as it was at the beginning of Resident’s occupancy, reasonable use and wear thereof and damage by the elements excepted.

RESIDENT shall conduct himself and require other persons on the Premises with his consent to conduct themselves in a manner that would not disturb the peaceful enjoyment of the Park by other occupants. By way of illustration only, the following applies: a. The RESIDENT is required to respect the privacy and lot lines of the other resident’s lots. Lot lines, as a rule, are measured as halfway between the mobile home. b. The RESIDENT shall be responsible for the conduct in the Park of the RESIDENT, the RESIDENT's household, and any guests or other persons who are in the Park with the permission of the RESIDENT, or at the RESIDENT's direction, or for the RESIDENT's benefit. The aforesaid individuals shall not engage in any conduct which adversely affects any other Resident or the operation of the Park. At no time shall RESIDENT or their guests, etc., harass or interfere with other inhabitants of the Park. RESIDENT shall be held responsible for the conduct of all members of their household and for any damages caused by them to private property or Park property. Abusive, threatening, demeaning, or otherwise hostile language and/or behavior against employees of OWNER or its agents including but not limited to park managers and independent contractors shall not be allowed. Similarly, abusive, threatening, demeaning, or otherwise hostile language and/or behavior against other residents, their family members, or their guests shall not be allowed. c. Possession, consumption, production, or sale of illegal substances shall not be permitted. Other criminal conduct constitutes a substantial violation of this Lease. All such conduct shall be promptly reported to local and State police and authorities, and OWNER cooperate with any prosecution. d. Excessive sound levels which disturb residents shall not be tolerated under any circumstances at any time. Accordingly, music, television, noisy parties, voices and other acts, sounds or behavior which interfere with peaceful enjoyment of other mobile homes by their occupants shall be prohibited. A violation of this paragraph after a second written warning of any noise disturbance in the Park will be deemed a substantial violation of this Lease and OWNER may terminate this Lease and begin eviction proceedings. Responsibilities of Resident. During the Term of this Agreement, Resident shall: 4.1.1. Participate fully, and in good faith, in the Residency Program and engage in the practice of medicine at the Broward Health Designated Facilities on behalf of Broward Health under the supervision of an authorized Broward Health physician or Resident’s Supervising Attending Physician, to the best of Resident’s abilities. Resident acknowledges and agrees that Resident may not initiate or conduct any act relating to the provision of medical services for the benefit of a patient of Broward Health without the consent and authorization of an authorized Broward Health physician or Resident’s Supervising Attending Physician. 4.1.2. Resident’s provision of services shall be rendered in accordance with the professional and ethical standards of the medical community in which Resident practices, as well as those of applicable national, state and local medical societies and licensing agencies. Additionally, Resident shall comply with Broward Health’s Medical Staff Bylaws, Broward Health’s Rules and Regulations, Broward Health’s Policies and Procedures Manual, Broward Health’s Code of Conduct, and any and all other rules and regulations of Broward Health and the Broward Health Facilities applicable to Resident (collectively, the “Broward Health Policies”). Resident shall also comply with all applicable standards and guidelines set forth by the Accreditation Council for Graduate Medical Education (“ACGME”), The Joint Commission and/or any other entity providing accreditation or certification for any Broward Health Designated Facility(ies) where Resident has been requested to provide services or any aspect of the Residency Program. Resident must acknowledge receipt of, or access to, the Broward Health Policies and Procedures Manual and Broward Health’s Code of Conduct by executing the Acknowledgement and Receipt Form attached hereto as Exhibit B and incorporated herein by this reference. 4.1.3. Resident shall comply with the provisions of Broward Health’s Human Resources Administrative Manual, and the Broward Health Code of Conduct, attached hereto as Exhibit C and incorporated herein by this reference, both as adopted and amended from time to time, in order to ensure ethical behavior and clinical competence in the treatment of patients. Responsibilities of Resident. During the Term of this Agreement, Resident shall: 4.1.1. Use his/her best efforts to provide safe, effective, and compassionate patient care under supervision at a level commensurate with Resident’s training and skills. Resident acknowledges and agrees that Resident may not initiate or conduct any act relating to the provision of medical services for the benefit of a patient of Memorial without the consent and authorization of an authorized Memorial physician or Resident’s Supervising Attending Physician. 4.1.2. Comply with Florida licensure requirements for physicians in training, which includes holding either a valid unrestricted Florida medical license or being registered with the Florida Board of Medicine or the Florida Board of Osteopathic Medicine, as applicable, before the start date of the Residency Program, and maintain all required licenses, permits and certifications throughout the Term of this Agreement. 4.1.3. Comply with accepted and recognized professional and ethical standards of care while Resident is participating in the Residency Program. Additionally, Resident shall comply with the standards and guidelines set forth by all applicable educational accrediting bodies, including but not limited to, the ACGME and CPME, as well as The Joint Commission and any other entity providing accreditation or certification for any Memorial Designated Facility . Resident shall comply with all relevant state and federal laws and regulations, including but not limited to, the Health Insurance Portability and Accountability Act of 1996, as amended, and those state and federal regulations applicable to Resident’s particular Residency Program. 4.1.4. Maintain standards of professional competence relative to Resident’s PGY Level and training as consistent with the Residency Program curriculum. 4.1.5. Act in a professional, collegial, and ethical manner at all times, including when treating patients of any Memorial Designated Facility. 4.1.6. Comply with all of the requirements of the Residency Program as determined by Memorial, including but not limited to abiding by Memorial’s Medical Staff Bylaws, Memorial Policies, Procedures and Standard Practices, Memorial GME Policies, and any and all other rules and regulations of Memorial and the Memorial Facilities applicable to Resident. 4.1.7. Responsibilities of Resident. During the Term of this Agreement, Resident shall: 4.1.1. Comply with the laws, rules, regulations, standards and recommendation related to the operation of a Residency Program, including without limitation, the governing educational accrediting bodies and any Residency Program specific rules, all as may be from time to time amended. Broward Health shall confer with the Residency Program to meet the criteria of the Residency Review Committee and the governing educational accrediting body and, where applicable, the licensing requirements of the Florida Board of Medicine, Florida Board of Osteopathic Medicine, Florida Board of Dentistry, or the Florida Board of Pharmacy as applicable in coordinating the duration and sequence of assignments to clinical, laboratory, or ambulatory care facilities. The Program Director will communicate with Resident regarding the assignments.
