Assignments and Vacancies. A) When any certificated vacancy occurs within the District, the district agrees to solicit and utilize members of the Association (when available) in the interviewing process. Members chosen shall have input.
B) To assure that students are taught by teachers working within their areas of competence and/or specialties, employees shall not be assigned, except in accordance with the regulations of the State Board of Education, to subjects, grade levels and/or areas outside their teaching certification without consultation. Employees assigned outside his or her teaching certification will work with the administration to develop an Individual Teacher Plan consistent with Title II requirements. Assignments and Vacancies. A. All employees, whether on layoff or returning from leave, are entitled to participate and exercise their seniority in the bidding process. The most senior employee shall have first choice of assignment. Selection of assignments shall continue in order of the next most senior employee until all the available assignments are selected. Available shuttle routes shall be bid separately by seniority bid prior to school starting. Bidding for regularly scheduled bus routes will be as follows:
1. Routes will be established and available for review and driving no later than three (3) weeks prior to the beginning of the school year.
2. Routes will be posted for bid between the second (2nd) & first (1st) week prior to the beginning of the school year.
3. Drivers will drive their bid route and adjust route layout with the Transportation Office Manager and Director of Operations and determine safety issues no later than one (1) week prior to the beginning of the school year.
4. Drivers will be paid one (1) additional days to prepare their routes for the school year.
B. The Employer reserves the right to make any additions, deletions or changes in assignments, routes, shuttles, stops, length and number of assignments and routes as necessary, for the efficient operation of the transportation system in order to meet requirements and/or needs of the district.
C. If the time allotment for a bus route is reduced by more than fifteen (15) minutes from the original time allotment bid upon by the driver, a special conference will be held between representatives of the Employer and the Association to discuss the causes and any alternatives to deal with the impact upon the driver prior to implementing the reduction.
D. Buses will be assigned to employees and will move with the employee unless the Director of Operations deems the type of route and condition of the bus warrants a different assignment. A bus, as determined by the employee to be unsafe because of faulty parts or equipment, will be returned to the garage for evaluation by Mechanic. A bus shall not be operated until the Mechanic has given approval. If the employee and Mechanic are in disagreement over said bus, the Director of Operations shall be asked to determine the condition of the bus. If no bus is available for that employee, he/she shall not lose pay.

11-1 Subject to the provisions of the Agreement, full or part time teacher assignments to buildings are made by the Superintendent or his designee, and duty assignments within the buildings are made by the building principal with the concurrence of the Superintendent or his designee. A teacher on less than full time assignment as defined by Article 1-14 who declines an increase to a full-time assignment shall have the option of applying for any posted vacancy. However, they are not eligible to displace another less than full-time teacher.
11-2 Teachers shall be notified in writing of any change in their assignment for the following school year, including the schools to which they will be assigned, the grade and/or subject they will teach, and any special or unusual course that they will have not later than June 1. If unforeseen circumstances require a change in a teacher’s assignment after June 1, the teacher will be notified of the change as soon as practicable.

3.7.1 Definitions of Assignment or Transfer – An "assignment" is defined as the placement of an employee within one classification within one school building in the P-5 program or specialty area (e.g., an itinerant XXXX position). A "transfer" is a placement of an employee outside the employee's current classification or building. The move of a classroom (which does not involve a change of evaluator) or an entire program from one building to another will not constitute a transfer or change of assignment.

C) Employees shall be notified in writing no later than May 30 of any change in their teaching assignments for the ensuing school year.
D) If, after May 30, any curricular or extra-curricular assignment change is made, notification of such change shall be given to the affected employee no later than thirty (30) calendar days prior to the effective date of change. If any emergency change not covered by the above is required, the affected employee will be promptly consulted; and if possible, the employee’s preference will be followed.
E) To assure a quality program is offered, only qualified employees will be assigned to perform any supplemental stipend duties as they are cited in the extra-curricular schedule criteria form.
F) To assure that certificated employees are given consideration in filling any positions which occur at any time within the District, the following procedures shall be used:
1) During the school year, certificated employees and the Association shall be given notice of all vacancies and new positions by posting a notice thereof in the faculty lounge sufficiently in advance to enable District employees to submit a letter of interest to be considered for such vacancy or new position. Current employees will be considered finalists for any job they apply for provided they meet the stated requirements for the position. Bargaining unit members who currently hold bargaining unit designated extra curricular positions shall have first choice to retain the current assignment. Class advisors shall have the option to follow their classes. Bargaining unit co-curricular positions shall be posted by May 1 and bargaining unit members shall have seven (7) working days thereafter to apply for such positions.

Assignments and Vacancies x. XXXX teachers shall be assigned to classes in their area(s) of certification and for which they are highly qualified. Teacher assignments received at the end of a semester for the following semester shall be considered tentative until the completion of the fourth week of the respective semester. MAHS Master Class Schedules will be distributed as soon as available before each semester. As changes are made revisions will be distributed.
b. Teaching assignments will be made based on certification, qualification under the No Child Left Behind Act of 2001 (NCLB), seniority, and the instructional needs and operational requirements of the program.
c. The Board will attempt to maintain a teacher’s current assignment(s) (subject, time, location) to the extent such an attempt does not conflict with district instructional needs and the operational requirements of the adult education program. Full-time teachers will have priority over part-time teachers in classroom assignments. The Board shall attempt to offer teachers no fewer classes second semester than they taught first semester. Every attempt will be made to assign teachers to the same building for morning and afternoon classes.
d. When an adult education teacher position or class is created, applicants teaching in the adult education program shall be given first consideration. Assignments will be made on the basis of the criteria described in Paragraph J(1)(b) of this Article.
e. Reassignments shall be voluntary whenever possible. Reassignments within MAHS, whether voluntary or involuntary, may become necessary to meet load conditions, district instructional needs, and to meet the operational requirements of the adult education program. Teachers subject to involuntary reassignment will be given five (5) calendar days notice of such reassignment and an opportunity to meet with the Director of the Xxxx Adult High School to discuss the reassignment.
