Deployments. 11.01 It is recognized by both parties that the employees covered by this Agreement may be required to deploy, at the direction of the Company, at locations other than at the Customs and Border Protection, Miami Air Site, Miami, Florida. All such employees are subject to deployments. The length of any deployment is determined by Customs and Border Protection. The Company agrees whenever a domestic deployment is of such duration as to involve multiple deployment of the same individual, the length of each deployment required shall not exceed thirty (30) days including travel; however, when it is known and posted in advance for the employee(s) prior to the assignment that the TDY will exceed the thirty (30) days, the normal limit may be exceeded. If an employee suffers a hardship (by definition) while on TDY status, the Company will work to facilitate the employee’s needs without interrupting the mission of the customer. a. A Temporary Duty deployment (TDY) is considered as any duty or function, away from the Customs and Border Protection Air Site, Miami, Florida requiring a period of time longer than twenty-four (24) hours. A TDY roster of all qualified personnel will be maintained and used in the selection process by the Company for off-site TDY assignments, except when the customer dictates in writing. Such roster will be posted listing employees by seniority and qualifications. A Temporary Duty (TDY) deployment from the Customs and Border Protection Miami Air Site requiring a period of time longer than twenty four (24) hours and for the purpose of attending training/school will not have any effect on the TDY roster. The individual assigned to a TDY training/school deployment upon their return will not move to the bottom of the TDY roster maintained by Management. Upon return from a training/school deployment, an Employee will be afforded a period of seven (7) days from the date of his/her return before being sent on TDY again unless no other qualified candidate exists. b. To be considered as qualified, the individual must be appropriately licensed for the aircraft or services required, i.e., A&P, daily and turnaround inspections, engine run card, taxi license, APU run card, etc. On civilian aircraft, a mechanic must have an A&P license. c. When selecting TDY assignments, the top listed name will be given first opportunity to accept or decline, and so on down the list. Deployments. 34. The SOPs shall limit canine deployments, searches, and other situations in which there is a significant risk of a canine bite to instances in which the suspect is wanted for a serious felony or is wanted for a misdemeanor and is either known to be armed or is reasonably believed to be armed based upon particularized, specific facts. 35. The SOPs shall require canine handlers to have approval from a Canine Section supervisor before a canine can be deployed. The PGPD shall make every reasonable effort to ensure that a Canine Section supervisor supervises searches and deployments and responds as appropriate. In any case, the approving supervisor shall not serve as a canine handler in the course of the deployment. 36. When a deployment or search is permitted, a canine handler shall not allow a canine to bite or to apprehend a suspect by biting except in those circumstances in which: a. the suspect poses a risk of imminent danger to officers or others; b. the suspect is actively fleeing from officers (as contrasted to hiding); c. the suspect is hiding and presents a specific, known, and articulable risk of death or serious bodily injury to officers or others, such as a hostage or barricade situation; or d. other reasonable alternatives for apprehending the suspect that involve a lesser use of force have been exhausted or would clearly be ineffective. 37. For these purposes, “imminent danger” is limited to situations in which the suspect, whether armed or not, is attempting to inflict serious bodily injury upon another person. This includes situations in which: a. the suspect has assaulted, or has attempted to assault, or is assaulting or attempting to assault officers or others with a weapon or other instrumentality capable of producing serious bodily injury; or b. the suspect has threatened or is threatening to make such an assault or the suspect is attempting to inflict serious bodily injury to another person (example strangulation). 38. The SOPs shall require that whenever a canine-related injury occurs, the handler is responsible for ensuring that the injured individual or individuals receive immediate medical treatment through transportation to an emergency room or admission to a hospital.
Deployments. Since this contract provides for services world-wide, the contractor shall be able to deploy its aircraft, personnel, and required support equipment to perform at any airfield capable of supporting its aircraft. The only additional cost allowable for deployed operations are travel and per diem for personnel, and shipping if necessary. Deployments. Off-duty employees for deployments will be selected from a volunteer deployment list. Employees voluntarily deployed for a deployment will be paid overtime for hours actually worked on the days they would otherwise be off duty. Deployments. 9.1 All planned upgrades and deployments will be scheduled during Business Days. BrightStarr will use its best endeavours to ensure that disruption to the Application performance is kept to a minimum. Further, minor releases will be automatically deployed to staging sites which includes patches and hotfixes as and when they become available. 9.2 All major release upgrades and deployments will be scheduled during Business Hours between 09.00 BST and 17.00 BST Monday to Thursday. BrightStarr will use its best endeavours to ensure that any disruption to the Services be kept to a minimum. Where a planned upgrade and /or deployment results in an extended period of downtime greater than the planned scheduled hours, BrightStarr will continue to work to restore Services while providing regular updates. A post- implementation report (PIR) can be provided upon request. 9.3 The Licensee will be required to stay within three (3) major versions of the Unily Application to continue to benefit from the latest platform capabilities, optimisations, and Support Services. Please note, if a critical or security risk is identified by BrightStarr, this may prompt BrightStarr to upgrade or deploy as part of the Emergency Change/Deployment process. Before contacting the Fire Chief, ensure that the unit member to be deployed name is on the calendar for all of the days that are requested for the deployment (up to 14 days). Let the Fire Chief know the days where Call Back would be needed. The deployed unit member will be required to use their time off for shift days that they are deployed. C. If the unit member is approved for deployment by the Fire Chief, he will be responsible for replying “Yes” on the OK-TF1 Team App stating that he is available for deployment. D. Only one employee will be allowed to deploy at a time. If multiple members are asked to deploy, the Fire Chief will determine which member will be allowed on the deployment.
