HEALTH, SAFETY & ENVIRONMENT. 25.01 The Employer, the Union and the employees shall promote and maintain standards of general office and Plant safety. The Employer and its employees shall comply with all applicable federal and provincial health and safety legislation and regulations. It shall be the objective of the Health, Safety and Environment Program to eliminate accidents and health hazards. To that end, the parties agree to create a: (a) Joint Safety Committee operating in accordance with WorkSafe BC Regulations. (b) The Joint Safety Committee shall meet once every month and operate in accordance with the WorkSafe BC published Regulations and guidelines. Meetings will be held during regular shift working hours and shall be considered time worked. 25.02 The parties acknowledge the importance of ensuring that new employees are oriented and trained to the safety standards in the Employer. (a) An employee has the right to refuse to do work when the employee has reasonable grounds to believe that the performance of this work will endanger his/her health or safety or that of another employee. (b) An employee who refuses the work must immediately: (1) Inform the supervisor of his/her refusal(s) and the reason for his/her refusal(s). (2) The supervisor must immediately investigate the matter, together with a Shop Xxxxxxx. The employee is entitled to be present during the investigation. (3) If, in the supervisor’s opinion, the refusal is not valid, the supervisor shall so inform the employee and the Union. (4) If the investigation does not resolve the matter and, the worker continues to refuse to carry out the work, the worker and/or his/her union must notify the WorkSafe B.C. officer, who must investigate the matter without delay. (5) During the above investigation, the Employer agrees to provide the employee with alternative duties and, the employee shall not suffer any loss of pay. (6) If its is concluded that there was no reasonable basis for the refusal, the Employer will meet with the employee and his/her shop xxxxxxx to address the employee’s conduct; and, discipline may result.

HEALTH, SAFETY & ENVIRONMENT. ‌ 9.01 The parties agree that they mutually desire to maintain standards of safety and health in the facility in order to prevent injury and illness. 9.02 A Joint Health and Safety Committee will be established with representation from employees who are represented by the Union and an equal number of Employer Representatives. The CAW will be entitled to one representative for every fifty bargaining unit members in Hillside Park Retirement Residence, with a minimum of one (1) representative. It is understood however, that in the event that the CAW bargaining unit for Hillside Park Retirement Residence increases to fifty bargaining unit members, the CAW will be entitled to two (2) representatives. Where the certified worker representative on the Joint Health and Safety Committee is not a CAW representative, the Employer will recognize a CAW certified representative from Hillside Park Retirement Residence and will pay for the training costs of one CAW certified representative (a total of one to represent both this bargaining unit and the CAW bargaining unit for Hillside Retirement Residence). However, the Employer's obligation to pay for the certification training costs for a CAW certified representative under these circumstances is limited to a maximum of once every three years if the Committee has a certified worker. 9.03 At no time shall the number of company members be allowed to outnumber the amount of union members. 9.04 Two (2) co-chairpersons shall be elected by and from the members of the committee. One co-chair shall be a union member, and the other shall be an Employer member. The union members of the committee will elect the Union co-chair. 9.05 The committee shall operate in accordance with the Occupational Health and Safety Act, as it may be amended from time to time. Meetings will be held quarterly, or more or less frequently as the committee may determine. 9.06 Without limiting the generality of the foregoing, the committee shall: i) ensure that inspections have been carried out at least once a month by the co- chairs or designate of the work place and equipment. ii) make recommendations for the improvement of the health and safety of workers. iii) recommend to the Employer and to the workers the establishment, maintenance and monitoring of programs, measures and procedures respecting the health or safety of workers. iv) record the minutes of the meetings which shall be signed by the co-chairs, distributed to the committee members, and posted ...

HEALTH, SAFETY & ENVIRONMENT. The Supplier warrants that it and its employees shall comply with all legal and governmental health, safety and environmental regulations, and of the Buyer and the Buyer’s customer HSE requirements including work site procedures.
HEALTH, SAFETY & ENVIRONMENT. A. Health, Safety and Environment (HS&E) The Company will recognize an HS&E Committee consisting of three (3) Company representatives and three (3) Union representatives. that may be from the Grievance Union Committee This committee will act as an advisory committee to promote and assist the Company in maintaining a safe and healthy place to work. This committee will bring to the attention of the Company any unsafe or unhealthy conditions or environmental concerns in the plant, and participate in issue resolution and communications. The HS&E Committee will meet on a need basis, but in any event, not less than monthly. The Company shall continue to make reasonable provisions for the safety and health of its employees during the hours of their employment. An employee or Union Xxxxxxx shall draw any HS&E concern to the attention of the immediate supervisor who shall review the concern with the employee and/or Union Xxxxxxx. In the event the concern remains unsolved, the appropriate HS&E representative will review the concern. In the event the concern still remains, a Union representative of the HS&E Committee will review and attempt to resolve the concern. If the job is considered safe by the supervisor and the HS&E representative(s), the employee shall be required to perform it. When an HS&E representative is not available on the second and third shifts, the concern will be reviewed by a Management representative and a Union representative. If a more detailed review is needed, the appropriate HS&E representative(s), the supervisor and the Union representative involved will fully investigate the concern and the Company will render a decision. Should the decision of the HS&E representative not satisfy the Union and/or employee involved, the Union Business Representative will attempt to resolve the concern with the HS&E Director and shall be subject to the grievance procedure thereafter, beginning at Step 3. The Company, as it deems necessary, may have the Medical Department make such physical examinations of its employees as considered advisable to determine the physical fitness of employees for their jobs and to determine any health hazards. The Company will continue to provide necessary protective equipment for the use of employees.
HEALTH, SAFETY & ENVIRONMENT. (a) The Buyer shall ensure that its employees and agents comply with all health and safety requirements, obligations and recommendations relating to the handling of the Marine Fuels delivered hereunder and shall impose upon all its customers to whom the Marine Fuels are supplied the same obligation. (b) In the event of a Spill while the Marine Fuels are being delivered, the Buyer shall promptly take such action as is necessary to remove the spilled Marine Fuels and mitigate the effects of such Spill. Without prejudice to the generality of the foregoing, the Seller is hereby authorised in its full discretion and at the expense of the Buyer to take such measures and incur such expenses as are necessary in the Seller’s judgment to remove the spilled Marine Fuels and mitigate the effects of such Spill also on the environment. The Buyer shall fully cooperate and render such assistance as is required by the Seller in this respect. All expenses, claims, losses, damages, liability and penalties arising from spills shall be borne by the Party that caused the Spill by act or omission. If both Parties contributed to the Spill, all damage related costs shall be divided between the Parties in accordance with their respective degree of fault.
HEALTH, SAFETY & ENVIRONMENT. 3.1 Where fieldwork is involved, the Service Provider shall take all reasonable and necessary precautions to protect property, the environment and persons from damage, injury or illness arising from the performance of the Services, and comply with all applicable occupational health and safety and environmental laws and regulations and all client requirements, including any applicable Project health, safety and environment plans or policies. 3.2 Service Provider shall be solely responsible for its activity and that of the Service Provider’s employees or agents on the Site with respect to Site safety and environmental protection. Neither the professional activities nor the presence of MH, or their employees shall be interpreted as control or direction of the operations of the Service Provider. Service Provider is responsible for providing, at its own expense, all personal protective clothing and equipment required for its employees to perform their work in a safe and environmentally responsible manner. Service Provider is responsible for ensuring that such equipment is in good condition and is properly inspected and maintained. 3.3 Service Provider’s personnel are required to report “fit for work”, meaning its personnel are in a condition to work safely. A person may be considered unfit for work if they exhibit a physical, mental or emotional state that may compromise a safe work environment, including signs or symptoms of being impaired or under the influence of drugs and/or alcohol.
