Institution Responsibilities. 1. The Institution will use its best efforts to select students for participation in the A.L.E. who are prepared for effective participation in the training phase of their overall education. The Institution will retain ultimate responsibility for the education of its students. 2. Prior to the commencement of the A.L.E., the Institution will, upon request and with proper authorization, provide responsible Facility officials with such student records as will adequately disclose the prior education and related experiences of prospective student participants. 3. The Institution will use its best efforts to see that the A.L.E.s at the Facility are conducted in such a manner as to enhance the resources available to the Facility for the providing of care to its clients and patients. Only those students who have satisfactorily completed the prerequisite 4. The Institution will not assign any faculty member to the Facility in connection with the operation of the A.L.E. who is not appropriately licensed or certified, and will make evidence of the licensure or certification of all its assigned faculty available to the Facility upon request. It is agreed that all Institution faculty are employees of the Institution, unless otherwise agreed upon in writing. 5. The Institution will inform all its participating students of the Facility's requirement that they must procure and maintain throughout the A.L.E. professional liability insurance in amounts, form, and by a carrier satisfactory to the Facility and the Institution, and covering their activities at the Facility, and to provide evidence of such insurance to the Facility prior to participation in any A.L.E. Institution faculty members will be provided professional liability coverage pursuant to the terms and conditions of the Georgia Tort Claims Act (O.C.G.A. 50‐21‐20 et seq.). The Institution will provide Worker's Compensation Insurance coverage for its participating faculty members. However, the Institution will not provide Worker's Compensation Insurance or other insurance coverage for its students. This paragraph will survive the termination of this MOU. 6. The Institution will encourage participating student and faculty compliance with the Facility's rules, regulations and procedures, and use its best efforts to keep students and faculty informed as to the same and any changes therein. Institution Responsibilities. The specific responsibilities of the Institution are: 1 To plan, develop, implement and evaluate the Program at Facility, and to provide Facility with copies of current course outlines, course objectives, and curriculum philosophy.
Institution Responsibilities. The Institution shall be responsible for the following: Designate a coordinator, hereinafter referred to as “Clinical Coordinator” to administer the Institution’s responsibilities related to the Training. Maintain full authority, responsibility and control over the business, policies, operations and general administration of the counseling program, including curriculum, evaluation of Students, administration, instructor appointments, and other matters that are normally reserved Institution functions, such as granting degrees and advising Students. Prior to Training commencing, Institution shall furnish a list of Students and any additional relevant information as reasonably requested by Facility. Advise Trainees of their responsibilities regarding participation in the clinical rotation to abide by all applicable rules, regulations, policies and procedures of the Facility and comply with all applicable federal and state laws and regulations. Ensure Trainees attend clinical rotation orientation, if required by Facility.
Institution Responsibilities. 1. The Institution agrees to comply with applicable Federal WIC program regulations by: a. Allowing WIC clients access to their WIC foods without constraints. b. Ensuring that WIC foods do not become a part of the communal food supply. c. Allowing WIC foods to be available exclusively to the WIC client who the food was intended for. d. Providing all other foods the WIC client would normally receive as a resident of the institution in addition to the WIC foods. e. Ensuring that the client has access to WIC services including nutrition education and referrals. f. Certifying that the facility will not receive any financial gain from the WIC client’s participation in the WIC program. 2. The Institution will immediately notify ITCA when the facility ceases operation or changes ownership. 3. Changes in name or address will be sent to the ITCA within ten days of such change at the address below. 4. An authorized representative of the Institution will accept training from ITCA staff as necessary. 6. The Institution will not treat WIC clients differently from other clients. 7. The institution will notify ITCA immediately if it ceases to meet any of the conditions outlined in the agreement. 8.

Specifically, the Institution will keep each participating student and faculty member appraised of his or her responsibility, including but not limited to the following: a) To follow the administrative policies, standards, and practices of the Internship Placement when in the Internship Placement. b) To report to the Internship Placement on time and to follow all established regulations of the Internship Placement. c) To not publish any material related to the internship experience that identifies or uses the name of the Institution, the Internship Placement, Board of Regents of the University System of Georgia, or its members, clients, students, faculty or staff, directly or indirectly, unless prior written permission is received from the Institution, the Internship Placement, and the Board of Regents of the University System of Georgia. However, the Internship Placement hereby grants to the Institution the right to publish Institution administrative materials such as catalogs, course syllabi, accreditation self-studies, internship experience reports, etc. that identify or use the name of the Internship Placement or its members, staff, directly or indirectly. d) To comply with all federal, state and local laws regarding the use, possession, manufacture or distribution of alcohol and controlled substances. 4. The Institution shall have the full responsibility for the implementation of any student conduct or faculty disciplinary proceedings and shall conduct the same in accordance with all applicable statutes, rules, regulations and case law. Institution Responsibilities. 1. The Institution agrees to accept final financial and administrative responsibility for management of an effective food service program and to comply with the CACFP regulations under 7 C.F.R. § 226, and any instructions or procedures issued in connection therewith, and the CACFP policies and guidance of the Agency including, but not limited to, attending training and maintaining records. 2. The Institution agrees to maintain financial viability, administrative capability, and have and enforce internal controls that demonstrate compliance with CACFP regulations under 7 C.F.R § 226, including, but not limited to having adequate financial resources to withstand temporary interruptions in Program payments and/or fiscal claims against the Institution. 3. The Institution understands and agrees that noncompliance with Federal regulations and the policies of Bright from the Start could lead to adverse action against the Institution. Adverse action that leads to a seriously deficient designation could result in the institution, as well as Principals, Responsible Principals, and Responsible Individuals involved in the operation of the CACFP, being placed on the National Disqualified List. Institutions and individuals included on the National Disqualified List are prohibited from participating in any federal food program for seven years from the date of disqualification and must repay all outstanding CACFP advances, reclaims, judgments and /or other identifiable program fees and debts owed to the Agency. 4. The Program applicant hereby agrees that it will comply with Title VI of the Civil Rights Act of 1964 (P.L. 88-352) and all requirements imposed by the regulations of the Department of Agriculture (7 CFR Part 15), DOJ (28) CFR Parts 42 and 50) and FNS directives or regulations issued pursuant to that Act and the regulations, to the effect that, no person in the United States shall, on the ground of race, color, national origin, sex, age, or disability, be excluded from participation in, be denied the benefits of, or be otherwise subject to discrimination under any program or activity for which the Program applicant received Federal financial assistance from USDA; and hereby gives assurance that it will immediately take any measures necessary to fulfill this agreement. The Institution will retain ultimate responsibility for the education of its students. 2. Prior to the commencement of the F.E.E., the Institution will, upon request and with proper authorization, provide responsible Facility officials with the names and information pertaining to relevant education and training for all Students enrolled in the F.E.E. program within a reasonable time before the beginning date of the F.E.E. program. 3. Institution will assign only those Students who have satisfactorily completed those portions of Institution curriculum that are prerequisite to Program participation. 4. The Institution will assign faculty/staff representative(s) as liaison(s) between the Facility and the Institution. 5. Solely for the purpose of defining the student’s role in relation to the use and disclosure of Facility’s protected health information, such students are defined as members of the Facility’s workforce, as that term is defined by 45 CFR 160.103, when engaged in activities pursuant to this agreement. However, such Students are not and shall not be considered to be employees of the Facility. Institution will notify each student of his or her status and responsibilities pursuant to this Agreement.
