Leave of Absence Union Officials a. Any bargaining unit employee who is a Council or Local union official may request LWOP for up to one (1) year to serve with AFGE, the Council or Local Union. Requests may be approved contingent upon the Activity being able to reasonably provide for the employee’s work being accomplished. Requests for extension of LWOP for more than one (1) year may be granted under the same circumstances. b. Upon return to duty after a period of LWOP, the bargaining unit employee will be trained as deemed necessary by the Employer. The Activity will return the employee to the position which he or she held prior to the leave, or to a similar position at the same grade and pay, provided such a position is available within Activity. If a position does not exist, the employee will be placed in accordance with applicable laws and regulations. c. Requests for annual leave or LWOP by Council or Local Union officials and members elected or designated by the Council/Local Union as delegates to conventions, caucuses, council meetings, district meetings, etc., may be approved or disapproved consistent with the work needs of the Activity.

Leave of Absence Union Officials. (a) All applications for leave of absence whether with or without pay shall be granted only to those official Union representatives whose absence in any specific case does not interfere with the operation of the Employer. Requests for such leave of absence shall nevertheless be given precedence over any other applications for leave on the same day. (b) With respect to any leave of absence granted without pay, the Employer shall continue to pay each representative's regular wage or salary and shall render an account to the Union for such amount, including the Employer's contribution on behalf of each such representative for Group Life Insurance coverage, Medical, Dental and Extended Health coverage, Sickness, and Accident Insurance Coverage and Municipal Superannuation. The Union shall then reimburse the Employer to the amount of the account rendered within sixty (60) days. (c) Upon application to, and upon receiving the permission of the General Manager, Human Resources in each specific case, official representatives of the Union may be granted time off for the purpose of collective bargaining with the Employer or for the purpose of settling a grievance as outlined elsewhere in this Agreement. Not more than three such official representatives shall be granted leave of absence without loss of pay for the time so spent. Further official representatives may be granted leave of absence without pay. (d) Upon application to, and upon receiving the permission of the General Manager, Human Resources in each specific case, official representatives of the Union shall be granted leave of absence without pay for the purpose of attending the National and B.C. Divisional Conventions of the C.U.P.E., the Annual Convention of the B.C. Federation of Labour and the Biennial Convention of the Canadian Labour Congress. (e) Members of the Union Executive will be granted leave of absence without pay for the purpose of transacting other business in connection with matters affecting members of the bargaining unit or in connection with other matters affecting the Canadian Union of Public Employees. (f) The Employer agrees that any full-time officer of the Union who is on leave of absence for the purpose of performing duties as an officer of the Union shall not lose seniority in the service of the Employer and shall continue to accumulate seniority while performing such duties. Leave of Absence Union Officials. (a) Employees required by the Corporation to attend any meetings for the purpose of processing any business between the Union and the Corporation shall suffer no loss of pay if such attendance is during such employee’s working day. (b) An employee within the scope of this Agreement holding office in a Provincial, National or International organization or association with which the Union is affiliated, who is duly appointed as a delegate to a meeting or convention of such association and/or organization shall be permitted to attend any meeting or convention of the aforesaid organization or association with seven (7) days' written notice to and prior approval from the Fire Chief; provided, however, the leave of absence is limited to a period not exceeding two (2) weeks, and the employee seeking leave of absence makes arrangements for a suitable relief without cost to the Corporation. In such cases the regular wages and benefits will continue for the employee who is on an approved leave of absence. (c) Employees of the Corporation who are elected to an office in a Provincial, National or International organization or association with which the Union is affiliated for a period longer than two (2) weeks must submit a written request to the Fire Chief for any leave of absence to fill that office at least thirty (30) days prior to the date such leave of absence is to take place, with the clear understanding that wages and/or benefits provided for under this Agreement will cease during the period of the said leave of absence. Seniority for re‐entry into service with the Corporation will be reviewed annually while on the said leave of absence and will continue subject to written notice to the contrary from the Fire Chief. (d) The Corporation will not discriminate against any member of the Union by reason of Union activities.

Leave of Absence Union Officials. ‌ a) All applications for leave of absence for official Union representatives, whether with or without pay, shall be submitted to the Chief Administrative Officer in writing and if possible, at least two (2) days in advance for approval and such leave shall not be unreasonably withheld, subject to the Employer’s operational requirements. b) With respect to any leave of absence granted without pay, the Employer shall continue to pay each representative’s regular wage or salary and shall render an account to the Union for such amount plus an additional flat rate of twenty-five percent (25%) of the wage or salary to offset the costs of benefits paid by the Employer while representatives are on leave of absence. The Union shall reimburse the Employer within thirty (30) calendar days of receipt of the account. c) The Employer shall maintain the straight-time pay and benefits for one (1) bargaining unit employee when such employee is present at collective bargaining with the Employer, provided the employee would otherwise be working a straight-time shift and provided that the maximum amount of time for which such pay and benefits will be maintained for purposes of negotiating any collective agreement shall be limited to twenty-four (24) straight-time hours.

Leave of Absence Union Officials. Section 1. Employees applying for reinstatement after a Leave of Absence of thirty (30) days or more must be able to qualify for the job under the then existing employment standard of the Employer and their compensation shall be at the then prevailing rate. Employees returning from Leave of Absence shall retain their original assignment at the time of leaving, except in cases where vacancies, new positions, or changes have been made during the period of their absence; in which event such employees shall be allowed to exercise their seniority in displacing a junior employee in such vacancies, new positions or changes. Section 2. The period of a Leave of Absence shall not be considered as time worked or as service with the Employer within the meaning of any of the other previous provisions of this Agreement. Section 3. The Employer shall provide a letter to each employee who is granted Leave of absence under this Article which shall authorize the Leave of Absence and set forth any other pertinent information in connection therewith. A copy of such letter shall be placed in the employee's personnel file. Section 4. Leaves of Absence not to exceed thirty (30) days may be granted by the Employer for any other purpose not consistent with this Article or other provisions of this Agreement.
