Leave Privileges. A member who is pregnant or whose spouse is pregnant or adopts a child of preschool age shall be entitled to the use of up to forty-five (45) workdays of accumulated sick leave (additional days may be used as needed if the member or child is under a physician’s care, and document of such is provided) for maternity, paternity, or adoption. The days may not be used in two separate school years. Following the use of such paid leave, and upon request, the employee may be granted a leave of absence without pay for maternity, paternity, or adoption reasons (following the exhaustion of sick leave). At the discretion of the member, such leave shall be for (a) the balance of the school year (b) the balance of the school year and the next ensuing school year. Upon written request, the Board may grant an extension of such leave for one additional school year.

Leave Privileges. ‌ a. In addition to the provisions of sick leave provided, a person who is pregnant or adopts a child less than one year of age shall, upon request, be granted a leave of absence without pay for maternity/paternity reasons. Such leave shall begin at a time between the onset of pregnancy and the delivery of the child or, if adoption, receipt of custody, and to continue up to one year after the child is born or custody is received. This leave period may be extended for one additional year upon application for extension. b. If the person so elects, maternity/paternity leave may begin when the sick leave expires or is terminated. Maternity/paternity leave may continue for the balance of the current school year.

If the member so elects, maternity/paternity leave may begin when the sick leave expires or is terminated, if applicable; provided however, nothing herein shall authorize the use in such sick leave other than during the disability of such member. Members may use accumulated sick leave following delivery, which shall not exceed six (6) calendar weeks unless medical necessity is certified in writing by the member’s physician.

A member may elect to use sick leave or personal leave for the purposes of FMLA, provided that use falls within the definition of Article VI, A. Maternity/paternity leave shall be provided for a maximum of six (6) weeks immediately following the birth of a child. In order for maternity/paternity leave to be extended beyond this six (6) week period, the member will need: a. a leave of absence, b. a physician’s note to qualify for sick leave, or c. qualify for FMLA leave.

Use of Sick Leave Accumulated sick leave days may be used for the following reasons: a. Personal illness or non job-related injury of the employee. b. Illness in the immediate family (spouse, parent, parent-in-law, grandparent, child, stepchild, or stepparent) not to exceed 15 work days, except with approval of the Human Resources Office. Additional days may be used for FMLA qualifying leaves by FMLA eligible employees, as designated by either the Board or the employee. c. Absence necessitated by exposure to contagious diseases in which the health of students would be impaired by attendance on duty. d. Time necessary for attendance at the funeral service of a person whose relationship to the employee warrants such attendance, not to exceed 3 days per school year. e. All employees shall be allowed one (1) personal leave day. One extra personal leave day per year, purchased by exchanging two sick leave days, will be available to teachers. Such days shall not be cumulative and shall be subject to the following provisions: 1. Arrangements for said leave shall be made at least five (5) days in advance with the principal on the proper form. 2. Matters of an emergency nature shall be allowable upon advance notice to the principal. 3. Personal leave days shall not be used during scheduled parent-teacher conference times or immediately before or after holiday and vacation periods, except in emergencies and with the approval of the principal. Personal leave days shall be subject to the following daily building quotas: a) Each elementary building - 2 leaves b) Each middle school building - 3 leaves c) High school building - 5 leaves d) Adult/Alternative Education program - 3 leaves No building may exceed its building quota for personal leave days on any single day unless approved by the building principal. Employees who service more than one building shall have their personal leave approved by the "home building" principal.

Leave Privileges. A. Each HESPA, MEA/NEA employee shall be granted a maximum of eight (8) days sick leave per year with full pay, with the exception of twelve month employees who will be granted twelve (12) days sick leave per year with full pay due to: 1. Personal illness of employee; 2. Absence necessitated by exposure to contagious diseases in which the health of students would be impaired by his or her attendance on duty; 3. Illness or disability in the immediate family not to exceed five (5) consecutive days per incident except with the approval of the Superintendent. Immediate family shall be defined as mother, father, grandparent, grandchild, mother-in-law, father-in-law, spouse, child, sibling, and significant others. 4. The Board reserves the right to require a doctor’s certification or other evidence of illness or ability to work. B. All employees within the bargaining unit will receive four (4) personal business days per year, (twelve month employees shall receive three (3) days per year). These may be used with no questions asked provided advance notice of 48 hours is given to the Administration, except in cases of provable emergencies. Advance notice shall include both verbal and written notification. Use of email is an acceptable means of written communication. Prearranged leaves are encouraged. Unused personal business days may accumulate to five (5) days. The current year’s allowance shall be in addition to the stated maximum. Unused personal days, beyond the yearly allowable accumulation, will transfer to sick leave each year. C. Employees shall be entitled to Bereavement Leave consisting of three (3) days per death in the family (as defined below).The Superintendent may grant funeral leave, in excess of five (5) days, to be deducted from the employee’s sick leave. Bereavement Leave is intended to be used for the planning/attending services internment. Immediate family shall be defined as mother, father, grandparent, grandchild, mother-in-law, father-in-law, spouse, child, sibling, brother-in-law, sister-in-law, and or anyone of significance in the employee’s life. D. Unused sick leave may accumulate to a maximum of one hundred twenty (120) days. Each unused sick day and including unused personal days beyond the allowed 120 days will be purchased at a rate of thirty dollars ($30.00) per day, or put into a 403B Plan at the discretion of the employee.
