Meal Breaks and Allowances. 22.1 An employee shall not be required to work for more than five hours without a break for a meal. Provided that by agreement between the Company and the majority of employees in the plant, work section or sections concerned, employees may be required to work in excess of five hours but not more than six hours at ordinary rates of pay without a meal break. 22.2 The time of taking a scheduled meal break or rest break by one or more employees may be altered by the Company if it is necessary to do so in order to meet a requirement for continuity of operations. 22.3 The Company may stagger the time of taking meal and rest breaks to meet operational requirements. 22.4 Subject to the provisions of sub-clause 22.1 hereof, an employee shall work during meal breaks at ordinary rates of pay whenever instructed to do so for the purpose of making good breakdown of plant or upon routine maintenance of plant which can only be done while such plant is idle. 22.5 Except as provided in sub-clauses 22.1 and 22.4 hereof, double time rates shall be paid for all work done during meal breaks and thereafter until a meal break is taken. 22.6 When an employee on day work is required to work overtime after the usual ceasing time for the day for two hours or more, he/she shall be allowed to take, without deduction of pay, a crib time of 30 minutes in duration immediately after such ceasing time and thereafter, after each four hours of continuous work, he/she shall be allowed to take also, without deduction of pay, a crib time of 30 minutes in duration. In the event of an employee remaining at work after the usual ceasing time without taking the crib time of 30 minutes and continuing at work for a period of two hours or more, he/she shall be regarded as having worked 30 minutes more than the time worked and be paid accordingly. 22.7 A day worker working overtime (including overtime on Saturday, Sunday or Public Holiday) shall be allowed a meal break of thirty minutes without deduction of pay after each four hours of overtime worked where the overtime is to be continued after such meal break, at a time which will ensure the efficient operation of work and meet the reasonable needs of the employee. 22.8 A meal break shall not be regarded as time worked for the purpose of determining when the next meal break falls due. 22.9 Shift Workers 22.9.1 Each shift of more than four hours' duration shall include a meal break of thirty minutes which shall be taken so as not to interfere with the ...

Meal Breaks and Allowances. (a) A Monday to Friday worker will be allowed an unpaid meal break of 30 minutes to be taken between 4 to 6 hours after the commencement of work. (b) Employees who are required to work through a meal break period (as described in sub clause (a) of this clause) due to an emergency or to maintain production, shall be allowed to take their meal break when relief is available. (c) Because of the requirement for continuous operation of the Plant, maintenance personnel and then staff may be used to operate the Plant while a relief employee is being obtained or is not available. (d) An employee required to work overtime for more than 2 hours on any one day and who was not notified of the requirement on the previous day or earlier will be supplied with a meal by the Company or paid the sum as set out in Appendix A. (e) An employee required to work overtime for more than 2 hours after normal ceasing time will be allowed a paid rest break of 30 minutes before commencing such overtime, and a similar break before commencing each further 4 hours of overtime to be worked. This break must be taken by the employee in order to be paid for it. (f) An employee will be allowed a paid refreshment break of 10 minutes in the first half of ordinary hours worked on each day, to be taken to suit the needs of the operation.

The break is paid at the ordinary rate applying at that time. Day workers required to work unplanned overtime without notice are entitled to a meal allowance in accordance with Annexure 2 in the following circumstances: (a) when the working period extends beyond 5.00pm; (b) when the overtime continues on from ordinary working hours; or (c) when called back and entitled to an overtime meal break (see clause 11.4). Where a continuous shift worker works a shift with less than 12 hours' notice, they are entitled to a meal allowance in accordance with Annexure 2 after five hours of work, and a second meal allowance after a further four hours of work.

Meal Breaks and Allowances. There will be sufficient and reasonable meal and/or rest breaks within and between periods of duty, to be agreed in advance by managers/team leaders and staff consistent with the provisions of Occupational Health and Safety legislation.
