Policies, Procedures, and Practices. 1. As of the Effective Date of the Agreement, Recipient shall not take any judicial or administrative action to enforce the Ordinance. 2. As of the Effective Date of the Agreement, Recipient shall not impose any fines or penalties or otherwise initiate or pursue any enforcement action against any properly licensed Employee Housing units operating prior to the effective date of the Ordinance, or any owners, operators, employees, staff or agents of such homes, because such homes did not apply for or receive a ministerial permit. If any fines or penalties have been collected due to the enforcement of the Ordinance, such fines and penalties may need to be returned to the original payee. HUD agrees that any fines collected pursuant to an inspection or other code enforcement action pursuant to the Ordinance for building code infractions that are applicable to any residential properties within the City will be considered non-refundable. However, any fines collected pursuant to an inspection or other code enforcement action pursuant to the Ordinance for building code infractions specific and only applicable to Employee Housing may be subject to refund to the original payee. a. Within thirty (30) days of the Effective Date of this Agreement, Recipient shall provide an itemized listing of all health and safety code violations and associated fines collected pursuant to an inspection or other code enforcement action pursuant to the Ordinance. This list will include the violation date, violation address, relevant building code citation, amount of associated fine, corrective action required, corrective action undertaken, date undertaken, and date of violation cure. b. Within ninety (90) days of the Effective Date of this Agreement, HUD will provide the City with the list of any refundable fines identified on the above- referenced list. c. Within one hundred eighty (180) days of the Effective Date of this Agreement, Recipient will refund any fines identified by HUD, providing documentation and evidence of refund. 3. Recipient shall, within ten (10) days of the Effective Date of this Agreement: a. provide to all employees, contractors and subrecipients who are involved in implementation and enforcement of the Ordinance notice that the Ordinance is discontinued and shall no longer be enforced pending repeal. As of the Effective Date of this Agreement, Recipient shall not take any judicial or administrative action to enforce its existing Xxxxxx Xxxxxxxxxxxx and Crime-Free Rental Housing Program. 2. Recipient shall, within ten (10) days of the Effective date of this Agreement: a. provide a written statement to all of its employees, contractors, and subrecipients involved in implementation of Xxxxxx Xxxxxxxxxxxx and Crime-Free Rental Housing Program that the Program is discontinued and the forms in Subsection c of this Section (V.B.2.c) are withdrawn; b. publish a written statement on the City website1 that implementation of Xxxxxx Xxxxxxxxxxxx and Crime-Free Rental Housing Program is discontinued and the forms in Subsection c of this Section (V.B.2.c) are withdrawn; c. withdraw from effect documents implementing the Xxxxxx Xxxxxxxxxxxx and Crime-Free Rental Housing Program, including, but not limited to, the Residential Rental Dwelling Unit Crime Free Lease Addendum, the Crime Prevention Through Environmental Design (CPTED) inspection Checklist, The Interior Xxxxxx Xxxxxxxxxxxx Inspection Reference Checklist, the Residential Rental Dwelling Unit Property Owner Certification Form, and the Residential Rental Dwelling Unit Frequently Asked Questions. 3. Within ninety (90) days of the Effective date of this agreement, the Recipient shall repeal Ordinance Nos. 1870, and 1873 or shall otherwise notify residents of the jurisdiction that the Ordinances are no longer in effect. 4. Recipient shall not adopt, maintain, enforce, or implement any Xxxxxx Xxxxxxxxxxxx and Crime-Free Rental Housing or Abatement of Chronic Nuisance Programs that discriminate against any protected classes in violation of Title VI, the Fair Housing Act, or any other applicable fair housing or civil rights laws. Specifically, Recipient will not expend any CDBG funds on any aspect of a Xxxxxx Xxxxxxxxxxxx and Crime- Free Rental Housing Program, unless the following criteria are met: a. Recipient has submitted to HUD for review the text of the authorizing ordinance(s), operative documentation, and any implementation plans. b. The district will review and revise, as necessary, its policies, procedures, and practices (collectively “the procedures”) with regard to the provision of a free appropriate public education and related aids and services for students with disabilities that apply to XXXXXXX Elementary School (the school). Specifically, the review will ensure that the procedures include the district’s responsibility to: a. implement students’ Section 504 Plans and Individualized Education Plans as part of the duty to provide a free appropriate public education regardless of the nature or severity of the disabling condition to qualified students with a disability; and b. ensure that qualified students with a disability are educated with students who do not have a disability to the maximum extent appropriate to the needs of the student with a disability. The district will place disabled students in the regular educational environment unless the district demonstrates that regular educational environment with the use of supplementary aids and services cannot be achieved satisfactorily. 2. Upon receiving OCR’s written approval of the procedures, the district will adopt the procedures if they were revised, and ensure the procedures are placed on the district’s website in a location easily identifiable for students, parents, guardians, and the public. 3. By May 3, 2019, the district will submit to OCR for review and approval the district’s proposed procedures. If OCR requires changes to the procedures, the district will re-submit the revised procedures to OCR for review and approval within 30 days of receiving notice of the revisions required by OCR. OCR and the district will follow the same process until OCR approves the district’s revised procedures. 4. If the district revises their procedures pursuant to section A.3, above, then within 60 days of receiving OCR’s approval of the district’s revised procedures, the district will provide OCR with a description of the adoption of the revised procedures and the location of the revised procedures on the district’s website that reflects the specific actions taken to comply with Action Item A.2.

  • Policies and Procedures i) The policies and procedures of the designated employer apply to the employee while working at both sites. ii) Only the designated employer shall have exclusive authority over the employee in regard to discipline, reporting to the College of Nurses of Ontario and/or investigations of family/resident complaints. iii) The designated employer will ensure that the employee is covered by WSIB at all times, regardless of worksite, while in the employ of either home. iv) The designated employer will ensure that the employee is covered by liability insurance at all times, regardless of worksite, while in the employ of either home. v) The designated employer shall have exclusive authority over the employee’s personnel files and health records. These files will be maintained on the site of the designated employer.

  • Policy and Procedures If the resident leaves the facility due to hospitalization or a therapeutic leave, the facility shall not be obligated to hold the resident’s bed available until his or her return, unless prior arrangements have been made for a bed hold pursuant to the facility’s “Bed Reservation Policy and Procedure” and pursuant to applicable law. In the absence of a bed hold, the resident is not guaranteed readmission unless the resident is eligible for Medicaid and requires the services provided by the facility. However, the resident may be placed in any appropriate bed in a semi-private room in the facility at the time of his or her return from hospitalization or therapeutic leave provided a bed is available and the resident’s admission is appropriate and meets the readmission requirements of the facility.

  • Safety Procedures The Contractor shall: (a) comply with all applicable safety regulations according to Attachment H; (b) take care for the safety of all persons entitled to be on the Site; (c) use reasonable efforts to keep the Site and Works clear of unnecessary obstruction so as to avoid danger to these persons; (d) provide fencing, lighting, guarding and watching of the Works until completion and taking over under clause 10 [Employer's Taking Over]; and (e) provide any Temporary Works (including roadways, footways, guards and fences) which may be necessary, because of the execution of the Works, for the use and protection of the public and of owners and occupiers of adjacent land.

  • Operational Procedures In order to minimize operational problems, it will be necessary for trade information to be supplied in a secure manner by the Subadviser to the Fund’s Service Providers, including: JPMorgan Chase Bank, National Association (the “Custodian”), Virtus Fund Services (the “Fund Administrator”) BNY Mellon Investment Servicing (US) Inc., (the “Sub-Accounting Agent”), any Prime Broker to the Series, and all other Counterparties/Brokers as required. The Subadviser must furnish the Fund’s service providers with required daily information as to executed trades in a format and time-frame agreed to by the Subadviser, Custodian, Fund Administrator, Sub-Accounting Agent and Prime Broker/Counterparties and designated persons of the Fund. Trade information sent to the Custodian, Fund Administrator, Sub-Accounting Agent and Prime Broker/Counterparties must include all necessary data within the required timeframes to allow such parties to perform their obligations to the Series. The Sub-Accounting Agent specifically requires a daily trade blotter with a summary of all trades, in addition to trade feeds, including, if no trades are executed, a report to that effect. Daily information as to executed trades for same-day settlement and future trades must be sent to the Sub-Accounting Agent no later than 4:30 p.m. (Eastern Time) on the day of the trade each day the Fund is open for business. All other executed trades must be delivered to the Sub-Accounting Agent on Trade Date plus 1 by Noon (Eastern Time) to ensure that they are part of the Series’ NAV calculation. (The Subadviser will be responsible for reimbursement to the Fund for any loss caused by the Subadviser’s failure to comply with the requirements of this Schedule A.) On fiscal quarter ends and calendar quarter ends, all trades must be delivered to the Sub-Accounting Agent by 4:30 p.m. (Eastern Time) for inclusion in the financial statements of the Series. The data to be sent to the Sub-Accounting Agent and/or Fund Administrator will be as agreed by the Subadviser, Fund Administrator, Sub-Accounting Agent and designated persons of the Fund and shall include (without limitation) the following:
