Recognition and Rights of Shop Stewards. The Employer recognizes the Union's right to Shop Stewards. The Union agrees to provide the Employer with a list of the employees designated as stewards and alternates. A Xxxxxxx or their alternate shall obtain the permission of their department head and in their absence the person in charge before leaving their work to perform their duties as a Xxxxxxx. Leave for this purpose shall be without loss of pay. Such permission shall not be unreasonably withheld. When a Shop Xxxxxxx is the only employee on duty in a department or where their absence would require the Employer to call in another employee or assign another employee to a higher rated position, or where their absence will unduly interfere with the employers operation, the Shop Xxxxxxx may be refused leave of absence to transact Union business. When such leave is refused, other time will be made available to ensure the Union business is transacted.

Recognition and Rights of Shop Stewards. (a) The Company recognizes the Union’s right to select shop stewards to represent employees. (b) The Union agrees to provide the Company with a list of the employees designated as shop stewards for each jurisdictional area, taking into account both operational and geographic considerations. A shop xxxxxxx, or his/her alternate, shall obtain the permission of his/ her immediate supervisor before leaving his/her work to perform his/her duties as a shop xxxxxxx. Such permission shall not be unreasonably withheld. On resuming his/her normal duties, the shop xxxxxxx shall notify his/her supervisor. The duties of shop stewards shall include: 1. investigation of complaints of an urgent nature; 2. investigation of grievances and assisting any employee which the shop xxxxxxx represents in presenting a grievance in accordance with the grievance procedure; 3. supervision of ballot boxes and other related functions during ratification votes; 4. attending meetings to which s/he is called by the Company.

(2) The Employer is to be kept advised of all Shop Xxxxxxx appointments. (3) One (1) Shop Xxxxxxx, or Union Committee member, shall be appointed by the Union as Chief Shop Xxxxxxx who may present or assist in the presentation of any grievance. (4) When the absence of more than one (1) Shop Xxxxxxx or Union Committee member may interfere with the proper operation of a department, then no more than one (1) Shop Xxxxxxx or Union Committee member from any one department may be given leave of absence to transact Union business at any one time.

(d) A shop xxxxxxx shall receive the permission of the immediate supervisor/designate before leaving work to perform duties as a shop xxxxxxx. Such permission, subject to operational requirements, shall not be unreasonably withheld. Leave for this purpose shall be with pay. The shop xxxxxxx shall notify the immediate supervisor/designate on completion of their union duties. The Union agrees that shop stewards and committee members appointed by the Union shall be regular employees of the Employer.

(d) Carrying out duties within the realm of assigned safety responsibilities for two (2) Union Representatives who are members of Safety Committees. (e) Attending meetings called by Management. When a Shop Xxxxxxx is the only employee on duty in a department or where his/her absence would require the Employer to call in another employee or assign another employee to a higher rated position, the Shop Xxxxxxx may be refused leave of absence to transact Union business. When such leave is refused, other time will be made available to ensure the Union business is transacted.

The Employer and the Union will agree on the number of shop stewards, taking into account the operational needs of the Employer and the administrative needs of the agreement. The duties of the shop xxxxxxx shall be to assist in the reporting, investigation, meeting with Employer's representatives at Step 1 and as well as disseminating bona fide information of the Union to the employees and the Employer. (b) The Employer agrees to recognize duly appointed shop stewards provided that the Union has first advised the Employer in writing of the names of the shop stewards so appointed. The Union agrees to advise the Employer in writing of any changes made by appointment from time to time. (c) The necessary time which is spent by shop stewards during their regular working hours, as approved by management, reporting, investigating and resolving grievances, or attending meetings specifically provided for herein, shall be considered to be time worked and paid at straight-time. Permission to deal with grievances or related issues during regular working hours shall not be unreasonably denied. In the event that a shop xxxxxxx is required by management to attend meetings outside of his/her regular working hours he/she will be paid at straight-time rates for all hours spent. (d) The shop xxxxxxx shall not be discriminated against or disciplined for performing his/her duties as a shop xxxxxxx. (e) Leave of absence without pay and with seniority shall be granted to shop stewards and elected representatives to attend to union business, which requires them to leave their premises of employment. (f) The Union and the shop xxxxxxx or elected representatives will make every effort to provide as much advance notice as possible, for leave requirements to facilitate scheduling of employees. To facilitate the administration of (e) above, when leave without pay is granted, the leave shall be given without loss of pay and the Union shall reimburse the Employer for appropriate salary costs, including travel time incurred. (g) Where possible, the Employer will make available private meeting space with a telephone, for the use of shop stewards, and for the Union to conduct union business and/or conduct union meetings if it relates to Starlight employees, as required.
