Return from Leave Of Absence Without Pay. Teachers on leave who wish to resume employment with the District shall notify the Superintendent, or his/her designee, by March 15 for the beginning of the school year or by November 1 for the beginning of the second semester. 1. Upon return from a leave of absence without pay, the Teacher shall be placed on the Salary Schedule step (Appendix B-1) and retain the seniority status (see Article 12) for which he/she was eligible when he/she left for the leave. 2. Upon return from an unpaid leave of absence, a Licensed Non-Classroom Personnel unit member shall be placed in his/her position held prior to the leave, if the position is open. If the position is not open, the Licensed Non-Classroom Personnel unit member shall be placed in an open position for which he/she is certified (licensed, authorized or approved) and qualified. An "open" position is one which is unfilled at any time or one which is held by a probationary Licensed Non-Classroom Personnel bargaining unit member at the beginning of the next school year. 3. If a teacher on a leave does not return, the Board shall interpret this as a resignation.

Return from Leave Of Absence Without Pay. Return from leave of absence without pay is subject to the following provisions: 8.4.1 Employees on leave for sixty (60) work days or less will be granted their former position and returned to work upon presentation of a physician’s statement that the employee is capable to resume regular duties. Leaves may be granted for other reasons at the discretion of the Employer. 8.4.2 Return from leaves of absence without pay in excess of the time limits specified in 9.4.1 above are subject to the following provisions: 8.4.2.1 Return from leave to be requested in writing fifteen (15) days prior to termination of leave. Failure to comply will be considered as resignation and forfeiture of seniority. 8.4.2.2 An employee returning from a leave of absence of more than sixty (60) work days in duration and there is no vacancy in his/her classification, shall exercise seniority in accordance with Article 16. 8.4.2.3 If the leave is for personal illness or injury, a physician’s statement that the employee is able to resume regular duties will be required.

There will be no advancement in seniority during the child care leave, but the Employee will be restored to the seniority level he/she was at prior to the begin- ning of the leave upon his/her return. 2. An Employee returning from a leave of absence without pay shall be reinstated in the same or equivalent position for which he/she is qualified (see Article 18, Section A, 6), providing a position is available. a. If the Employee desires to return to work and no position is available, or no position for which the Employee is qualified is available, the Employee will continue on month-to-month leave status until such time as there is a position available for which the Employee is qualified. b. When a position is available, for which the Employee is qualified, the District will implement the notification provisions of Article 13, Section C, Recall. The Employee will be placed on the same pay level on the Hourly Wage Rate Schedule (Appendix B) the Employee was on prior to the leave, as provided in Item 1 above. If the leave without pay was initiated between January and June, the Employee will advance one pay level upon the Employee’s return if eligible for a pay level advancement. If the Employee fails to respond to the notification or fails to assume the duties of the assigned position at the appointed time, the Employee will be considered to have terminated their employment rights with the District. c. Upon return from leave without pay exceeding thirty (30) calendar days, the employee’s anniversary dates shall be adjusted to exclude such leave time for the purpose(s) of:  Performance evaluation dates;  Step increase dates;  Seniority for promotional examinations; and  Benefit accrual calculations. 2. Upon return from a leave of absence without pay exceeding thirty (30) calendar days occasioned by illness or disability of the employee, the employee may be required to provide such medical information as required by the City’s physician to ascertain the employee’s fitness for duty. Failure or refusal to provide this information may delay the employee’s return to work, and may constitute grounds for disciplinary action.

The Governing Board may approve or reject the request. If the request is approved by the Board, the site supervisor and incumbent substitute shall be given ten (10) working days' notice prior to reinstatement of the permanent employee. 11.13.2 Failure to report for duty within two (2) working days after a leave has been canceled or expires shall be considered abandonment of the position. The employee may be terminated by the Board of Education. The termination may be appealed to the Personnel Commission in the same manner as any other dismissal for cause. 11.13.3 If the employee's classification has been abolished during the employee's absence, the employee shall be laid off for lack of work and placed on the reemployment list for the class effective the date of the termination of leave. The employee may be returned to a vacant position in a class at the same or lower salary level for which the employee is qualified.
