The Public Works Manager or General ▇▇▇▇▇▇ shall not withhold such permission unreasonably when it does not interfere with the normal routine of work. The Employer shall recognize an employee as Shop ▇▇▇▇▇▇▇ only after having received written notice of his/her selection or designation by the Union. Under no circumstances shall the Shop ▇▇▇▇▇▇▇ be discriminated against by the Employer.
C. The authority of the Shop ▇▇▇▇▇▇▇ and Alternate Shop ▇▇▇▇▇▇▇ so designated by the Union shall be limited to, and shall not exceed, the following duties and activities:
1. The investigation and presentation of grievances in accordance with the provisions of this collective bargaining agreement;
2. The collection of dues when authorized by appropriate Local Union action;
3. The transmission of such messages and information which shall originate with, and are authorized by the Local Union or its officers; provided such messages and information (a) have been reduced to writing; or (b) if not reduced to writing, are of a routine nature and do not involve work stoppages, slowdowns, refusal to handle goods or any other interference with the Employer’s business.
4. The representation, at the request of any employee covered hereunder, in discussion initiated by the Public Works Manager or General ▇▇▇▇▇▇, concerning the work performance of said employee, or any other matter in which an employee feels he/she needs such representation, subject to paragraph B above.
5. Any abuse of the provisions of paragraph C4 above, by the Shop ▇▇▇▇▇▇▇ shall, in the first instance be discussed with a representative of the Local Union
D. Neither the Shop ▇▇▇▇▇▇▇ nor any shop committee or group of employees covered by this Agreement is authorized to cause or engage in any strike, slowdown or stoppage in the place of business of the Employer nor order the discharge of any employee.

Shop Steward. A. The Municipality will recognize that the Business Manager of IBEW Local 1547 retains the right to appoint and dismiss all shop stewards in accordance with the Union rules and regulations. There will be one full-time non-working chief ▇▇▇▇▇▇▇ and up to six total part-time working assistant stewards between this agreement and the International Brotherhood of Electrical Workers Local Union 1547 Technician’s Collective Bargaining Agreement. The full-time non-working Chief Shop ▇▇▇▇▇▇▇ position will always be subject to the wages, benefits, and working conditions of this Agreement and not the International Brotherhood of Electrical Workers Local Union 1547 Technicians Agreement. The Municipality shall recognize the shop stewards as the duly-appointed Union representatives of the employees. The Union will notify the Municipality as to the identity of all shop stewards. All shop stewards shall make every effort in cooperation with the Utility Manager, Department Director or duly-authorized representative to correct violations and infractions of this Agreement by either covered employees or management personnel. The duly-authorized assistant shop stewards, upon request made to their immediate supervisors, shall be given reasonable amounts of time during working hours and without loss of pay, to handle all work-related Union business pertaining to their areas of appointment, including but not limited to grievances and arbitration hearings, and shall keep both the Municipality and the Union informed as to their whereabouts. The Union shall reimburse the Municipality for wages paid by the Municipality to a municipal employee for time spent performing services primarily for the Union, such as, doing work for the union at another employer, attending ▇▇▇▇▇▇▇ training, or in contract negotiations (excluding the Chief Shop ▇▇▇▇▇▇▇’▇ time during contract negotiations); and the municipal employee will maintain accurate time records to reflect the performance of work for the union to be reimbursed. B. Where the complaint or difference involves more than one (1) employee, it must be presented to Management by the Shop ▇▇▇▇▇▇▇ alone for the employees involved unless presented outside of regular working hours, or unless the division head involved gives permission for other employees or more than one Shop ▇▇▇▇▇▇▇ to attend such presentation.
C. The Employer agrees upon discharge of an employee, to promptly notify the Shop ▇▇▇▇▇▇▇. The Employer will notify the Union in the event of the layoff or discharge of a Shop ▇▇▇▇▇▇▇ in advance of the termination, if possible.
D. An employee may request that a ▇▇▇▇▇▇▇ be present during an investigatory conference with supervision.
Shop Steward. A. The Employer agrees that Shop Stewards, during the term of office, shall have top seniority. Such seniority shall only be effective concerning layoffs and may not be invoked for promotion.
B. Shop Stewards and members of the Union Committee shall be permitted to adjust grievances or complaints during working hours without loss of pay provided, however, that no Shop ▇▇▇▇▇▇▇ or member of the Union Committee shall leave his regular work for the purpose of adjusting grievances or complaints without first (1st) reporting to and obtaining permission of his Supervisor. Such permission will be granted unless it interferes with production or any important operation in progress at that time. Upon entering a department other than his own, a Shop ▇▇▇▇▇▇▇ or member of the Union Committee, must first (1st) report to the Supervisor of such department, stating his reason for being there. Time spent in handling grievances or complaints shall not be unreasonable or excessive.
C. The Union may designate a reasonable number of Union Stewards from among non- probationary, regular employees of the Company, who are bargaining unit members. Newly appointed Shop Stewards will be recognized as such seven (7) calendar days after written notice is received by the Company’s plant operations.
Shop Steward a. The Union may appoint a maximum of six (6) shop stewards to consist of one (1) in housekeeping/laundry; one (1) in grounds; one (1) in maintenance; one (1) in transportation; and two (2) in food service. The Union may also appoint one (1) alternate ▇▇▇▇▇▇▇. One ▇▇▇▇▇▇▇ may be designated as the Chief ▇▇▇▇▇▇▇. The appointment shall be made in such a manner as the Union determines, and the Employer will be notified in writing of such appointment.
b. It is understood that the shop stewards designated in each department, as above, shall have at least twelve (12) months of full-time or part-time employment.
c. The shop ▇▇▇▇▇▇▇ shall only deal with the representative of the Employer designated to handle grievances.
d. The shop ▇▇▇▇▇▇▇ shall not direct any employee how to perform or not perform his/her work, shall not countermand the order of any supervisor, and shall not interfere with the normal operations of the Employer or any other employee. His/her activities as a shop ▇▇▇▇▇▇▇ shall in no way interfere with his/her assigned duties as an employee.
e. It is preferred that shop stewards handle grievances in their own department, provided, however, that shop ▇▇▇▇▇▇▇ may handle a grievance in another department if necessary. The Employer’s designated representative is only required to meet with one (1) shop ▇▇▇▇▇▇▇ on any grievance.
f. The Employer will release a shop ▇▇▇▇▇▇▇ from his/her work duties with no reduction in pay to present grievances at the first or second step of the grievance procedure, if such meetings are scheduled during said ▇▇▇▇▇▇▇’▇ work hours. In other situations (for example, to conduct investigations relevant to a grievance, or to participate in a Step 3 grievance meeting), the Union will make a request and the Employer will make its best efforts, given operational requirements, to release a shop ▇▇▇▇▇▇▇ from his/her work duties with no reduction in pay for a short period of time.
