Shop Steward. A. There shall be at all times one shop xxxxxxx designated by the Union and one alternate shop xxxxxxx designated by the Union, authorized to act in the absence of the shop xxxxxxx. All references herein to responsibilities and duties of the shop xxxxxxx shall apply to the alternate shop xxxxxxx in the absence of the shop xxxxxxx. B. Shop Xxxxxxx shall suffer no loss of pay for the time spent during working hours in the performance of his duties, provided the Public Works Manager or General Xxxxxxx has approved his deviation from his work in advance. The Public Works Manager or General Xxxxxx shall not withhold such permission unreasonably when it does not interfere with the normal routine of work. The Employer shall recognize an employee as Shop Xxxxxxx only after having received written notice of his/her selection or designation by the Union. Under no circumstances shall the Shop Xxxxxxx be discriminated against by the Employer. C. The authority of the Shop Xxxxxxx and Alternate Shop Xxxxxxx so designated by the Union shall be limited to, and shall not exceed, the following duties and activities: 1. The investigation and presentation of grievances in accordance with the provisions of this collective bargaining agreement; 2. The collection of dues when authorized by appropriate Local Union action; 3. The transmission of such messages and information which shall originate with, and are authorized by the Local Union or its officers; provided such messages and information (a) have been reduced to writing; or (b) if not reduced to writing, are of a routine nature and do not involve work stoppages, slowdowns, refusal to handle goods or any other interference with the Employer’s business. 4. The representation, at the request of any employee covered hereunder, in discussion initiated by the Public Works Manager or General Xxxxxx, concerning the work performance of said employee, or any other matter in which an employee feels he/she needs such representation, subject to paragraph B above. 5. Any abuse of the provisions of paragraph C4 above, by the Shop Xxxxxxx shall, in the first instance be discussed with a representative of the Local Union D. Neither the Shop Xxxxxxx nor any shop committee or group of employees covered by this Agreement is authorized to cause or engage in any strike, slowdown or stoppage in the place of business of the Employer nor order the discharge of any employee. The investigation and presentation of grievances to the EMUA in accordance with the provisions of this Agreement. 2. The collection of dues when authorized by appropriate local union action. 3. The transmission or receipt of such messages and information to or from the local union or its officers provided that telephone messages be limited to one call per week not exceeding fifteen (15) minutes in length and are of such a routine nature that do not involve work stoppages, slow downs, refusal to handle goods or any other interference with the normal and routine operation of the EMUA. B. The shop xxxxxxx and alternate have no authority to take strike action or any other action interrupting the normal and routine operation of the EMUA. The EMUA shall have the authority to impose proper discipline, including discharge in the event the shop xxxxxxx or alternate has taken strike actions, slow downs or work stoppage in violation of this agreement. C. Except as specifically stated above, the shop xxxxxxx and alternate shall be prohibited from performing any other union activities while on company time. The shop xxxxxxx or alternate has no authority to and shall not give orders to employees, nor countermand orders of supervisory personnel. The alternate shop xxxxxxx shall have the authority to act if the primary shop xxxxxxx is unavailable or if the alternate shop xxxxxxx is requested by a member. D. The designation of the shop xxxxxxx and alternate shall be certified to the EMUA by the Union in writing.
Shop Steward. A. The Municipality will recognize that the Business Manager of IBEW Local 1547 retains the right to appoint and dismiss all shop stewards in accordance with the Union rules and regulations. There will be one full-time non-working chief xxxxxxx and up to six total part-time working assistant stewards between this agreement and the International Brotherhood of Electrical Workers Local Union 1547 Technician’s Collective Bargaining Agreement. The full-time non-working Chief Shop Xxxxxxx position will always be subject to the wages, benefits, and working conditions of this Agreement and not the International Brotherhood of Electrical Workers Local Union 1547 Technicians Agreement. The Municipality shall recognize the shop stewards as the duly-appointed Union representatives of the employees. The Union will notify the Municipality as to the identity of all shop stewards. All shop stewards shall make every effort in cooperation with the Utility Manager, Department Director or duly-authorized representative to correct violations and infractions of this Agreement by either covered employees or management personnel. The duly-authorized assistant shop stewards, upon request made to their immediate supervisors, shall be given reasonable amounts of time during working hours and without loss of pay, to handle all work-related Union business pertaining to their areas of appointment, including but not limited to grievances and arbitration hearings, and shall keep both the Municipality and the Union informed as to their whereabouts. The Union shall reimburse the Municipality for wages paid by the Municipality to a municipal employee for time spent performing services primarily for the Union, such as, doing work for the union at another employer, attending xxxxxxx training, or in contract negotiations (excluding the Chief Shop Xxxxxxx’x time during contract negotiations); and the municipal employee will maintain accurate time records to reflect the performance of work for the union to be reimbursed. Time codes for shop xxxxxxx duty shall be as reflected in the Municipality’s guidelines. No shop xxxxxxx shall be terminated for any cause until the Utility Manager or Department Director and Business Manager of the Union have completed an investigation into the alleged cause for termination and determined there has been just cause. Shop Steward. A. The Union shall have the right to designate Shop Stewards. The local Union shall, in writing, notify the Labor Relations office of the Employer as to the identity of the designated Shop Stewards. Shop Stewards shall have the right to receive, but not to promote complaints or differences and to discuss and assist in the adjustment of the same with the appropriate supervisor. The Employer will not discriminate against the Shop Xxxxxxx in the proper performance of their Union duties provided that such duties do not unreasonably interfere with their regular work or with the work of other employees and they shall not leave their work station without first notifying their appropriate supervisor as to their intent, the reason therefore, where they can be reached and the estimated time they will be gone. B. Where the complaint or difference involves more than one (1) employee, it must be presented to Management by the Shop Xxxxxxx alone for the employees involved unless presented outside of regular working hours, or unless the Division Head involved gives permission for other employees to attend such presentation. C. The Employer agrees, upon discharge of an employee, to promptly notify the Shop Xxxxxxx. In the event that a Shop Xxxxxxx is to be laid off, the Employer will give advance notice of this fact to the appropriate Union, either verbally or in writing, and will give advance notice to the Union of the discharge for "just cause" of a Shop Xxxxxxx if possible. D. Provided a Xxxxxxx or Business Representative is available in a timely manner, an employee may insist that a Xxxxxxx or Business Representative be present during an investigatory conference with supervision.

Shop Steward. A. The Employer agrees that Shop Stewards, during the term of office, shall have top seniority. Such seniority shall only be effective concerning layoffs and may not be invoked for promotion. B. Shop Stewards and members of the Union Committee shall be permitted to adjust grievances or complaints during working hours without loss of pay provided, however, that no Shop Xxxxxxx or member of the Union Committee shall leave his regular work for the purpose of adjusting grievances or complaints without first (1st) reporting to and obtaining permission of his Supervisor. Such permission will be granted unless it interferes with production or any important operation in progress at that time. Upon entering a department other than his own, a Shop Xxxxxxx or member of the Union Committee, must first (1st) report to the Supervisor of such department, stating his reason for being there. Time spent in handling grievances or complaints shall not be unreasonable or excessive. C. The Union may designate a reasonable number of Union Stewards from among non- probationary, regular employees of the Company, who are bargaining unit members. Newly appointed Shop Stewards will be recognized as such seven (7) calendar days after written notice is received by the Company’s plant operations.

The Department Xxxxxxx shall be permitted to visit with employees during working hours at their workstations for the purpose of investigating grievance matters by obtaining prior permission from the Department Head of the Department. Such permission will be granted as long as the work of the Department is not impaired. C. The Xxxxxxx shall not give orders to employees nor countermand orders or supervisory personnel. D. The Borough Agrees to sixteen (16) hours of Paid Leave per year to the Stewards for the purpose of attending the Union’s Shop Xxxxxxx Training Seminar.
