TEACHER'S AUTHORITY AND PROTECTION.
9.01 In any case where a teacher is charged with a civil or criminal action arising out of, and in the course of, assigned duties and responsibilities, that teacher may request that the Board provide legal services. In any case where the teacher pleads guilty or nolo contendere or is found guilty of any such action, the teacher shall reimburse the Board for any legal services which the Board may have supplied pursuant to this section. If the Board declines to provide legal services in response to the teacher's request, and the teacher is subsequently found not guilty or not civilly liable, the teacher may renew his/her request and a recommendation shall be made to the Board for payment of the reasonable cost of legal services, and the Board shall reconsider such request previously declined. The selection of the attorney shall be mutually agreed upon by the teacher and the Board.
9.02 No disciplinary action against a teacher shall be taken based on a complaint by a parent of a student, a student or any other person or persons unless the matter is first reported to the teacher in writing. If a written report of any complaint against a teacher is included by the principal in a teacher's personnel file and the teacher chooses to respond in writing to said report, the teacher's response shall be attached to the report. Parental or student complaints shall remain in the teacher's personnel file no more than one (1) year except in cases when the teacher is being documented for unsatisfactory performance in accordance with Florida Statutes. It is understood by the parties that such complaints will be maintained in accordance with the public records law.
TEACHER'S AUTHORITY AND PROTECTION. 9.01 The Teacher recognizes his/her responsibility to promote proper conduct of all students under his/her supervision in the school buildings and on the school grounds as well as in his own classroom. The Teacher will cooperate with the Principal in securing and maintaining proper school discipline. Student discipline is based on the requirement that all students must adhere to a reasonable code of acceptable behavior and to comply with all school rules and regulations.
9.02 The Board recognizes its responsibility to adopt rules and regulations for the control, discipline and suspension of pupils and to decide all cases recommended for dismissal.
9.03 Teachers, with the assistance of the school administration as needed, are responsible for maintaining student discipline in the classroom and throughout the school grounds. In carrying out this task, the Teacher shall have the authority given him in accordance with F.S.1003.32
9.04 A Teacher may impose customary classroom discipline as outlined in Board policy and may use such force as is necessary to protect him/herself from attack or to prevent injury to another pupil.
9.05 A Teacher may refer a student to the Principal’s office when the grossness of the offense, the persistence of the misbehavior or the disruptive effect of the behavior makes the continued presence of the student in the classroom intolerable. If a Teacher refers a student from the classroom for any reason, the student must be sent to the Principal’s office with a written explanation of the reason for the referral, which the teacher will provide as soon as possible
9.06 Any case of assault upon a Teacher in the performance of his/her duties shall be promptly reported to the Board or its designated representative. The Teacher assaulted is free to exercise his/her right to file a complaint with the proper authorities and take whatever legal action he deems appropriate. Time loss by a Teacher in connection with such an assault shall be handled as follows:

School authorities shall attempt to correct student behavior through counseling, interviews and conferences, which, when warranted, shall be extended to include the child's parents. Suspension from class or from school shall be imposed by the school principal for serious or persistent infractions of school rules, in accordance to the Sumter County Schools Code of Student Conduct.
TEACHER'S AUTHORITY AND PROTECTION. A. All disciplinary actions taken by the teacher in the fulfillment of his/her teaching duties must be in accordance with the State of Florida Statutes and shall not be altered unless there is mutual consent of the teacher and principal.
B. No punitive action against a teacher shall be taken on a basis of a complaint by a parent or student or other individual nor any notice thereof shall be included in the teacher's personnel file, until the matter is first reported to the teacher in writing. The teacher shall have the right to respond in writing to such complaint, and to submit additional information to be placed in the teacher's personnel file.
C. Individual student discipline records will be maintained by principal and teacher. Any follow-up disciplinary action taken by the administration shall be recorded and the referring teacher notified of any action or inaction.
D. When all reasonable means of discipline have been exhausted, the teacher may recommend to the principal that the disruptive party be removed from the classroom. Unsatisfactory disposition at this point may be appealed to the Superintendent and/or Board.
E. For an emergency situation the teacher has the right to remove a disruptive student temporarily from the classroom by sending the student to the office.
F. The Board shall establish a countywide code of student conduct that includes appropriate disciplinary measures.
TEACHER'S AUTHORITY AND PROTECTION. Teachers will receive communication from a xxxx or administrator regarding disposition of a written discipline referral within five (5) workdays after the referral is submitted by the teacher.
TEACHER'S AUTHORITY AND PROTECTION. A. Any case of school related assault upon a teacher, either physically or verbally, shall be promptly reported to the Board or its designated representative. Teachers have the right to report such assault to the appropriate legal authorities. The Board shall save harmless and protect all teachers to the extent of Board liability under the laws of Florida. Time for appearances before a judicial body or legal authority when in connection with any incident in this Article shall result in no loss of wages or reduction in accumulated leave. For the purpose of this provision, an “assault” is an intentional, unlawful threat by word or act to do violence to the person of another, coupled with an apparent ability to do so, and doing some act which creates a well-founded fear in such other person that such violence is imminent.
B. It is the responsibility of the teacher to maintain a satisfactory level of control and discipline. The Board recognizes its responsibilities to offer reasonable assistance to the teacher in meeting this responsibility.
C. A teacher may impose classroom discipline where necessary in cases of minor infractions and may use such reasonable force as may be necessary to protect themselves and other students from the disruptive student(s).
D. Every effort shall be made to informally resolve complaints made against instructional personnel by parents, students, or other individuals. Unless instructional personnel are notified and given an opportunity to respond within five (5) working days when the administrator becomes aware of an alleged incident/complaint, no official action will be taken nor official record kept, or referred to at a later time. Failure of instructional personnel to respond in a timely manner does not limit the time-line for taking administrative action. If investigation of a complaint warrants official action, (written notice, reprimand, recommendation for disciplinary action, etc.) documentation including written acknowledgment of instructional personnel must be filed in compliance with Personnel Record laws and rules. If the incident warrants a formal investigation, the maximum of thirty (30) calendar days shall be the limit for the completion of investigative procedural steps. However, an extension may be granted if both parties agree that additional time is warranted.
TEACHER'S AUTHORITY AND PROTECTION. A. A copy of the Board’s Student Code of Conduct shall be given to all teachers during pre- planning. The Principal or designee shall explain to his/her faculty the implementation procedures to be followed in the school.
B. All teachers will enforce all rules, regulations, policies, and directives of the school with regards to their responsibilities for student behavior in order to assist with management of student behavior:
a. Each teacher will have access to the applicable policies and procedures for maintaining student discipline.
b. Each teacher shall sign a release form stating he/she has received the materials and do/do not wish to receive additional training.
c. Beginning and new teachers to the District will be made aware of all policies, rules, etc. which are incorporated into Xxxxxxx County Beginning Teacher Program.
d. The Board, will upon the teacher’s request, provide support and assistance to teachers with respect to the maintenance of control and discipline in the classroom in accordance with School Board policy.
C. A teacher shall impose classroom discipline in accordance with Florida Statute 1003.32 and may use such force as is necessary to protect himself/herself from attack, or to prevent injury to himself/herself, another student, any other school employee, volunteer, or school property.
D. When, in the judgment of a teacher, a student is by his/her behavior seriously disrupting the instructional program to the detriment of other students, the teacher may refer him/her to the principal. The teacher, upon request, will be informed of the dispensation of the referral.
E. No formal action against a teacher affecting future employment status shall be taken on the basis of a complaint by a parent or student or other individual, nor any notice thereof, shall be included in the teacher’s personnel file unless the matter is first reported to the teacher in writing. The teacher shall be informed of the person(s) making any formal complaint. There shall be no disciplinary action taken against the teacher for said complaint without just cause.
F. A teacher’s personnel file shall be defined as a composite of the school file and the county office file, including any attachments as provided by Statute. There shall be no other personnel files.

Students not adhering to the expected code of acceptable behavior and those not conforming to school rules and regulations incident to normal school routine will be disciplined accordingly.
Section 2. Teachers will be provided the opportunity to participate in the organization and/or revision of the Student Code of Conduct.
Section 3. A record of student discipline cases shall be maintained. Upon administrative approval, a teacher may have access to an individual student's record.
