Union Delegate Training Leave. The Company shall review each request for the elected Union Delegate to have appropriate paid time off for training purposes where it is deemed there is mutual benefit to the employee and the company.
Union Delegate Training Leave. (a) Union delegates shall be entitled to up to 6 days of training, subject to the approval of the General Manager Employee Relations, which are directed at the enhancement of the skills and effectiveness of Union delegates.
(b) Attendance at training shall be arranged having regard to the operational requirements of the business so as to minimise any adverse affect on those requirements.
(c) Approval for training shall not be unreasonably withheld.
(d) Attendance at training shall be paid, for each full day of Union delegate training, at the base rate (i.e. excluding extraneous payments such as Shift allowances or penalty rates and overtime).
(e) Attendance at training pursuant to this clause shall count as service for all purposes of this agreement.
(f) Subject to operational requirements the Employer will be prepared to grant Union delegates reasonable paid time off to attend Union meetings and conferences. Union delegates seeking such leave shall be required where possible to give two (2) weeks’ notice to the Employer. Approval for such leave will not be unreasonably withheld.
(g) Special paid leave will be granted to Employees who are delegates to attend their Union’s National Council, National Executive, State Council, State Executive, Divisional Committee and Unions NSW Annual Conference.

Union Delegate Training Leave. 14.1 Employees of Council who are Union delegates/shop stewards and other workplace representatives will be entitled to, and Council will grant, up to 10 days leave over two years (non-cumulative), without loss of pay, to attend courses, conferences and seminars conducted by an accredited training provider/organisation on the following conditions:-
14.1.1 The scope, content and level of the courses are directed to the better understanding of their role.
14.1.2 Reasonable notice is given to Council by the Employee;
14.1.3 The taking of leave is arranged having regard to the operational requirements of Council;
14.1.4 The Employee taking such leave will be paid all ordinary time earnings which normally become due and payable during the period of leave;
14.1.5 Leave of absence granted pursuant to this clause 13.3.1, will count as service for all purposes under this Agreement.
14.2 Council may increase the period of leave entitlement above 10 days, in accordance with the criteria specified in this clause 13.3.1, to enable workplace representatives to carry out their roles.
Union Delegate Training Leave. (a) Xxxx elected union delegates are eligible to attend up to five (5) days’ paid leave per annum to attend training courses conducted by the Union, up to a maximum of twenty (20) paid days per annum across all delegates. Such training does not accrue if not used each year. This will be subject to reasonable notice of a minimum of fourteen (14) days being given to the company. The Company will reasonably consider all requests and on the basis of being satisfied with course content and ability to release the delegate with minimal impact to operations.
(b) The number of Eligible Employee Representatives entitled from year to year to take paid union delegate training leave will be according to the following quota table:

Union Delegate Training Leave. 20.2.1 In addition to clause 20.1, Union delegates or elected workplace representatives, with approval of the union and upon application in writing, will be granted up to 75 days leave with pay, pooled across the workplace, each calendar year, non-cumulative, to:
(a) consult with union members and other Employees for whom the delegate is a bargaining representative;
(b) participate in the operation of the union;
(c) attend union education;
(d) address new Employees about the benefits of union membership at the time that they enter employment;
(e) attend courses conducted by an approved training provider, that are designed to provide skills and competencies that will assist the delegate or workplace representative contribute to the prompt resolution of disputes and or grievances in the workplace.
20.2.2 The application to the Employer must be in writing, include the nature, content and duration of the course to be attended, and normally be provided with 28 days’ notice of the proposed training.
20.2.3 The granting of leave pursuant to this clause will be subject to the Employer being able to make adequate staffing arrangements amongst current Employees during the period of such leave. The Employer will not use this sub clause to avoid an obligation under this clause.
20.2.4 Leave of absence granted pursuant to this clause, will count as service for all purposes of this Agreement.
20.2.5 Each Employee on leave approved in accordance with this clause, will be paid all ordinary time earnings. For the purpose of this sub clause "ordinary time earnings" for an Employee means the classification rate, over-award payment, superannuation and shift loading, which otherwise would have been payable.
20.2.6 All expenses (such as travel, accommodation and meals) associated with or incurred by the Employee attending a training course as provided in this clause will be the responsibility of the Employee or the union.
20.2.7 An Employee may be required to satisfy the Employer of attendance at the course to qualify for payment of leave.
20.2.8 An Employee granted leave pursuant to this clause will, upon request, inform the Employer of the nature of the course attended and their observations on it.
20.2.9 In the event of a disagreement arising from the outcome of this clause, the matter may be settled using the dispute settlement procedures of the agreement.
Union Delegate Training Leave. Union delegates shall be entitled to up to 6 days of training, subject to the approval of the General Manager Employee Relations, which are directed at the enhancement of the skills and effectiveness of Union delegates.
Union Delegate Training Leave. 19.8.1 A workplace delegate has the right to reasonable paid time to attend union training in relation to their role in representing their union, union members and eligible members.
19.8.2 Each union delegate will be entitled to up to five (5) per delegate under this clause (pro-rata for part-time employees).
19.8.3 This leave will be non-cumulative.
19.8.4 A workplace delegate must be nominated by their union to participate in such training, and the training course must be approved by the union.
19.8.5 The union union delegate(s) to attend union training.
19.8.6 An employee who holds an elected officer position in the union shall be able to access up to three (3) additional days paid Leave per annum to attend to the duties of an elected officer, including union conferences and national union meetings.
19.8.7 Where the School is required to engage a Relief Teacher to replace an elected officer on Union Executive Leave, the union will, on presentation of an invoice, reimburse the School for the cost of engaging the Relief Teacher for the day(s).
Union Delegate Training Leave. 44.1 Subject to this clause, three (3) Union delegates will be allowed up to six (6) days leave with pay each, annually, to attend courses authorised by the Union dealing with matters contained in this Agreement. The entitlement to such leave will not accumulate from year to year.
44.2 In order for the leave to be approved, the Union will provide Kmart with one (1) months’ notice (or such lesser time as may be agreed between the parties) of the dates on which such courses are to be held. Leave will be granted to the Union delegate or delegates to attend courses provided that no courses will be scheduled in the months of December or January, in the week before or the week after Easter; or the week preceding a quarterly stocktake, unless by agreement between the parties.
44.3 Each Employee on leave in accordance with this clause shall be paid their Base Rate of Pay for the period of leave.
44.4 Leave granted will not incur any additional payment to the extent that the course attended coincides with any other period of paid leave granted pursuant to this Agreement.
44.5 Leave granted pursuant to this clause shall count as service for all purposes of the Agreement.
44.6 Any additional travel costs associated with attendance at the course will not be paid by Kmart.
44.7 On the completion of the course, the Employee will, upon request, provide Kmart proof satisfactory to Kmart of their attendance of the course. Kmart will not be required to make payment for any period of leave granted that is not utilised in the attendance at the course, unless the Employee can substantiate that the failure to attend the course was due to the taking of paid leave otherwise authorised by this Agreement.
