Catastrophic Illness/Injury Leave. In accordance with the provisions of AB 2007, Catastrophic Illness/Injury leave shall be available to all eligible employees. The purpose of this leave is to permit employees with a catastrophic illness or injury to have sick leave donated to them by fellow employees. A. A catastrophic illness or injury is one that is expected to incapacitate an employee for an extended period of time and the employee has used all of their paid leave of absences. B. A catastrophic illness/injury request shall be approved by the Catastrophic Illness/Injury Committee (CII) consisting of one (1) member assigned by the District, one (1) member assigned by the Guild, and one (1) member assigned by CSEA. The committee members shall elect its Chair. 1. Medical verification by the requesting employee's physician must be presented to the committee. 2. The requesting employee must be incapacitated or absent for an extended period of time no fewer than thirty (30) consecutive calendar days. 3. A written request must be submitted to the committee by the requesting employee or his/her representative. 4. The requesting employee may use donated leave as half or whole days and can use the leave retroactively. a. Four (4) hours in paid status and four (4) hours of donated leave or eight (8) hours of donated leave equals eight (8) hours pay and full health and welfare benefits. b. Four (4) hours of donated leave equals four (4) hours pay and, for this purpose, full health and welfare benefits. 5. Approved leave must be used within a twelve (12) month period after approval. a. Approved leave shall be placed in a special donated leave account for each approved employee. b. Each approved employee may draw upon their account for the twelve-month period only for the approved or related catastrophic illness/injury. c. Any unused leave shall revert to the Leave Bank for use of other employees who have been approved for a catastrophic illness/injury leave. d. In unusual circumstances, the CII Committee may consider a request to extend the period for up to one (1) additional year. C. Any employee may donate accrued sick leave, but must maintain seventy percent (70%) of accrued sick leave on record. Catastrophic Illness/Injury Leave. In cases of personal hardship to a bargaining unit employee brought on by catastrophic illness or injury, where the employee has exhausted all accumulated, unused paid leave as a result of the catastrophic illness or injury, the Board and the Union may enter into an agreement pursuant to the following guidelines to assist the affected employee through the donation of accumulated unused sick leave by other bargaining unit employees who volunteer to do so. Any decisions made by the Board and the Union through the Joint Committee established under this section shall be final, and the same shall not be subject to the grievance and arbitration procedure. A. For purposes of this agreement, the term "catastrophic illness or injury" shall include only those illnesses or injuries which are calamitous in nature, constituting a great misfortune. The "catastrophic illness or injury" must be unusual, extraordinary, sudden, an unexpected manifestation of the forces of nature which cannot be prevented by human care, skill, or foresight. B. Applications for catastrophic illness/injury sick leave donation must be submitted to the Executive Director of Personnel Services. Applications will include, but not be limited to, the following information: 1. The nature of the claimed catastrophic/illness or injury; 2. Physician(s) diagnosis and prognosis of the catastrophic illness or injury; 3. Projected date of return to duty; 4. Explanation of previous leave usage; and 5. Any other pertinent information the applicant can submit to the committee for its consideration. D. Upon receipt of the application, the Executive Director of Personnel Services shall notify the Joint Committee. The Joint Committee will meet as soon as practicable after receipt of a request and make a decision regarding the request. In order to approve a request for catastrophic illness/injury sick leave donation, two-thirds (2/3) vote of the entire committee must prevail. Catastrophic Illness/Injury Leave. Upon submission of satisfactory medical evidence that demonstrates an existing catastrophic illness or injury, the Appointing Authority Employer shall grant the employee on a one-time basis, up to an additional twenty-six (26) weeks of non-intermittent non-FMLA leave. A catastrophic illness or injury is a severe or life-threatening condition that requires prolonged recovery or hospitalization and that totally incapacitates the employee from working. An employee may be granted leave under this paragraph not more than twice during their employment provided that the total aggregate amount of leave granted to any one employee shall not exceed 26 weeks.
Catastrophic Illness/Injury Leave. In the event of a catastrophic illness or injury to an employee’s spouse or dependent child that requires long term treatment with the presence of the employee at the place of treatment, the superintendent may at his or her sole discretion grant paid leave beyond that which is available through other contract leave provisions. A candidate would be eligible for catastrophic leave for an amount of days not to exceed forty (40) school days during his or her term of employment in the District. Payment for catastrophic leave will be based on the Employee’s position on the salary schedule at the time of the request. Payment for part-time Employees will be pro-rated. An Employee may apply for a maximum of twenty (20) days per request. Each subsequent request for catastrophic illness/injury leave must be submitted in writing to the Superintendent. All catastrophic leave days are to be “repaid” to the District. This repayment may include future sick leave, emergency, vacation, in-service, personal leave and/or financial reimbursement. All requests will be reviewed by the Administrative Committee of the Board, which will recommend action to the full Board. All decisions of the Board will be final.

LESSEE shall not discriminate against the Aircraft in providing such insurance. Each and any policy of insurance carried in accordance with this Subsection (A), and each and any policy obtained in substitution or replacement for any of such policies, (i) shall designate each Indemnitee as additional insureds as their interests may appear (but without imposing upon any obligation imposed upon the insured, including, without limitation, the liability to pay any premiums for any such policies, but the Indemnitees shall have the right to pay such premiums if it shall so elect), and (ii) shall expressly provide that, in respect of the interests of the Indemnitees in such policies, the insurance shall not be invalidated by any action or inaction of the LESSEE or any other Person (other than the Indemnitees, each for their respective interests), and shall insure, regardless of any breach or violation by LESSEE or any other Person (other than the Indemnitees, each for their respective interests) of any warranty, declaration or condition contained in such policies, (iii) shall provide that if such insurance is canceled for any reason whatsoever, or is adversely changed in any way with respect to the interests of the Indemnitees, or if such insurance is allowed to lapse for nonpayment of premium, such cancellation, change or lapse shall not be effective as to the Indemnitees for thirty (30) days (seven (7) days in the case of any war risks and allied perils coverage or such lesser time which may be standard in the insurance industry and ten (10) days in the event of nonpayment of premium), in each instance, after receipt by each of the Indemnitees of written notice by such insurer or insurers sent to the Indemnitees of such prospective cancellation, change or lapse, (iv) shall include coverage for any country in which the Aircraft is located, (v) shall provide that, as against the Indemnitees, the insurer shall waive any rights of set-off, counterclaim or any other deduction, whether by attachment or otherwise, and waives any rights it may have to be subrogated to any right of any insured against the Indemnitees, with respect to the Aircraft, (vi) shall provide war risk and allied perils coverage pursuant to the AVN52 extended coverage endorsement or its equivalent, and (vii) shall insure (to the extent of the risks covered by the policies) the indemnity provisions of Section 14. Each liability policy shall be primary without right of contribution from any other insurance which may be carried by any Indemnitee, and shall expressly provide that all of the provisions thereof (except the limits of liability) shall operate in the same manner as if there were a separate policy covering each insured. No liability policy shall permit any deductible or self-insurance provision except for baggage as is customary in the industry and such other deductibles only with the consent of the LESSOR, which consent shall not be unreasonably withheld or delayed, which from time to time LESSEE can demonstrate are standard in comprehensive liability insurance and, in particular, public liability risks (including, inter alia, contractual liability and passenger liability coverage) for U.S. Air Carriers in the then current United States insurance market.

  • Insurance, Subcontractor's Public Liability and Property Damage The Contractor shall require each of its subcontractors to secure and maintain during the life of the subcontract, insurance of the type specified in this Contract, or, the Contractor may insure the activities of its subcontractors in the Contractor’s policy, as specified in this Contract.

  • Property Damage Lessee shall obtain and maintain insurance coverage on all of Lessee's personal property, Trade Fixtures, and Lessee Owned Alterations and Utility Installations. Such insurance shall be full replacement cost coverage with a deductible of not to exceed $1,000 per occurrence. The proceeds from any such insurance shall be used by Lessee for the replacement of personal property, Trade Fixtures and Lessee Owned Alterations and Utility Installations. Lessee shall provide Lessor with written evidence that such insurance is in force.

  • Contractor’s Pollution Liability Insurance If specified in Schedule A, the Contractor shall maintain, or cause the Subcontractor doing such Work to maintain, Contractors Pollution Liability Insurance covering bodily injury and property damage. Such insurance shall provide coverage for actual, alleged or threatened emission, discharge, dispersal, seepage, release or escape of pollutants (including asbestos), including any loss, cost or expense incurred as a result of any cleanup of pollutants (including asbestos) or in the investigation, settlement or defense of any claim, action, or proceedings arising from the operations under this Contract. Such insurance shall be in the Contractor’s name and list the City as an Additional Insured and any other entity specified in Schedule A. Coverage shall include, without limitation, (a) loss of use of damaged property or of property that has not been physically injured, (b) transportation, and (c) non-owned disposal sites.
